Proposal to expand the scope of residents crossing the border using passports

At the meeting with voters before the 5th session of the 15th National Assembly , voters in Mong Cai city proposed: "Propose to amend and expand the scope of residents crossing the border by passport, specifically opening it to residents of border districts, towns and cities instead of the current residents of border communes and wards".

After research, the Ministry of Defense responded as follows:

The Agreement on land border management regulations between Vietnam and China (hereinafter referred to as the Agreement) stipulates:

Clause 9, Article 1: “Border residents are permanent residents of each country belonging to communes (towns) adjacent to the border”.

Clause 1, Article 22: “Border residents of both sides may carry border entry and exit passes to operate in the border areas of the other side through border gates or border crossings agreed upon by both sides.”

Based on the above provisions, the Agreement only stipulates one type of travel document, "Border entry and exit travel document" and the subjects to be granted are border residents with the scope of activities being the opposite border area (border district, town).

Currently, the Government is assigning the Ministry of Foreign Affairs to preside over and coordinate with relevant ministries, branches, and People's Committees of border provinces adjacent to China to study and amend the Agreement. The Ministry of National Defense requested the National Assembly Delegation of Quang Ninh province to discuss and propose to the Ministry of Foreign Affairs to supplement the process of amending the Agreement.
