Improve the efficiency of fire fighting operations
On the morning of June 19, continuing the 7th session, the National Assembly listened to the presentation and examination report on the draft Law on Fire Prevention, Fire Fighting and Rescue.
Authorized by the Prime Minister, Minister of Public Security Luong Tam Quang presented the Proposal on the draft Law on Fire Prevention, Fire Fighting and Rescue.
Minister Luong Tam Quang said that the draft Law supplements regulations on rescue activities for incidents and accidents occurring in daily life that have direct impacts, limit human rights, civil rights and according to the provisions of the 2013 Constitution must be stipulated in legal documents.
The Draft Law will meet objective practical requirements and overcome limitations, difficulties and inadequacies of current laws.
The draft Law on Fire Prevention, Fire Fighting and Rescue consists of 9 chapters and 65 articles, supplementing regulations on the scope of regulation for rescue activities to specify and implement the provisions of the 2013 Constitution on ensuring human rights and civil rights.
At the same time, supplement and regulate more comprehensively the contents related to fire prevention and fighting management to meet practical requirements.
Regarding fire prevention, the draft Law inherits and supplements regulations to overcome difficulties and shortcomings and meet practical requirements for fire prevention activities, including adding more specific regulations on responsibilities and requirements in investment, production and business activities to ensure fire prevention safety conditions and further enhancing requirements and responsibilities in the management, supply and use of electricity and electrical equipment related to fire and explosion.
Regarding fire fighting, according to the Minister of Public Security, basically, the draft Law continues to inherit the provisions of the current Law, with some amendments and supplements to overcome difficulties and shortcomings and improve the effectiveness of fire fighting activities, meet practical requirements and enhance the effectiveness and efficiency of State management on fire prevention and fighting.
Additional management of electric vehicles
In the review report, Chairman of the National Assembly's Defense and Security Committee Le Tan Toi said that the Defense and Security Committee basically agreed on the necessity of promulgating the Law on Fire Prevention, Fighting, and Rescue for the reasons stated by the Government in the submission.
Regarding fire prevention activities, the National Defense and Security Committee believes that the draft Law is basically consistent with the position and role of the subjects in fire prevention and fighting, meeting practical requirements.
However, it is recommended to continue researching and clarifying fire prevention and fighting requirements for each type of planning in Clause 1, Article 13 to have solutions and designs on fire prevention and fighting suitable for each type of planning; more clearly define how to apply standards and conditions for each type of construction and project; clearly classify the level of renovation of construction works to which fire prevention and fighting solutions and designs are required;
Review and unify regulations related to authority, responsibility, order, procedures, and coordination in the examination, appraisal, acceptance, and inspection of fire prevention and fighting acceptance results; consider regulations assigning the responsibility of "organizing fire prevention and fighting acceptance" to project and construction investors and motor vehicle owners;
Continue to carefully assess the impact of regulations on fire safety conditions for housing, motor vehicles and facilities; study regulations on fire safety requirements and conditions suitable for each type of facility in each locality, especially housing combined with production and business.
In particular, it is necessary to specify requirements for design and installation of electrical systems; study and supplement regulations on management of electric vehicles.
Regarding firefighting activities, the National Defense and Security Committee believes that, in order to continue perfecting the draft Law, it is recommended to study and supplement the provisions in Article 26 to clarify the responsibility for paying for water usage costs from the complete centralized water supply system when practicing firefighting plans of the Public Security agency and serving firefighting work;
Clarify the arrangement of fire hydrants on the centralized water supply network in accordance with standards and technical regulations on fire prevention and fighting or standards and technical regulations on water supply;
Supplementing regulations allowing the fire fighting commander specified in Clause 2, Article 28 to have the right to "prohibit people and vehicles without duties from entering the fire fighting area" to ensure order in the fire fighting area; adding the subject " household head, household member " as the fire fighting commander in the village, residential group in case the village chief, residential group leader, or civil defense team leader is absent;
Consider stipulating that village chiefs and residential group leaders are responsible for ensuring water sources, substances, fire-fighting materials, communication information and implementing basic fire-fighting measures within their management scope ...
