Can I register my child's birth at my temporary residence?

According to Article 13 of the 2014 Law on Civil Status, the authority to register a child's birth is the People's Committee (PC) of the commune, ward or town where the father or mother resides.

On the other hand, Clause 1, Article 11 of the 2020 Law on Residence clearly explains that a citizen's place of residence is either a permanent residence or a temporary residence. In which:

Permanent residence is the place where a citizen lives stably, long-term and has been registered for permanent residence.

Temporary residence is where a citizen lives for a certain period of time outside of his/her permanent residence and has been registered for temporary residence.

Thus, according to current law, birth registration for children can still be done at the temporary residence of the father or mother.

Birth certificate procedure

The person who has the right to register the birth of a child is the responsible person (father, mother; grandfather or grandmother or other relative; individual or organization raising the child).

Documents to be prepared include:

- Birth registration form.

- Original birth certificate.

- Copy of marriage certificate (if any).

- Copy of ID card or CCCD card of child's parents (if any).

- The person registering the birth of the child must present identification documents such as a passport or ID card or CCCD card or other documents with a photo attached.

Depending on the locality, the People's Committee at the commune level will request the comparison of a number of documents to verify the accuracy of the information provided by the person registering the birth.

For children without a birth certificate, there must be a written confirmation of the birth from a witness. If there is no witness, there must be a written guarantee.

In case of abandoned children, there must be a record confirming the child's abandonment issued by a competent authority.

For children born through surrogacy, documents proving this must be provided.

Where to get a birth certificate?

Submit documents to the People's Committee of the commune where the father or mother resides. If the father or mother's place of residence is not determined, submit documents to the People's Committee of the commune where the child is actually living.

Birth registration for abandoned children is carried out at the People's Committee of the commune where the person temporarily raising the child resides or where the organization temporarily raising the child is headquartered (Clause 3, Article 13 of Decree No. 158/2005/ND-CP).

In case of foreign elements, the applicant shall submit the application to the reception and result return department of the district-level People's Committee or the Department of Justice.

The recipient is responsible for immediately checking the entire file, comparing the information in the declaration and the validity of the documents in the file submitted and presented by the applicant.

After receiving all documents, if the birth information is complete and appropriate, the civil status officer reports to the commune People's Committee Chairman, records the birth information in the birth registration book, and obtains a personal identification number. The commune-level People's Committee Chairman issues a birth certificate to the applicant.

Procedures for making birth certificate online

In addition, you can choose to register birth online by accessing https://dichvucong.gov.vn and following the required steps.

Specifically, the registrant performs online birth registration according to the following steps:

-Step 1: Create an account.

-Step 2: After creating an account, select the Regular birth registration (commune block) item in online submission.

-Step 3: Fill in all information in the online birth registration form, attach photos of birth certificate, ID card/CCCD, passport, marriage certificate of father and mother (if any)...
