On the morning of June 27, the National Assembly discussed the draft Law on People's Air Defense (PKND). The draft law clearly states that the task of PKND is to coordinate with the national air defense force and army air defense to be ready for combat, to fight, prevent and fight against enemy air attacks and to manage and protect the airspace at altitudes below 5,000m.
Explaining the reason for determining the height of 5,000m, General Phan Van Giang, Minister of National Defense, said that determining this height is "not difficult", the army has radar to determine heights below 10m and other heights. "The higher it is, the easier it is to determine, the lower it is, the more difficult it is because the terrain is greatly affected", General Phan Van Giang emphasized.
Regarding flight licenses, the Ministry of Public Security licenses ultra-light aircraft and unmanned aerial vehicles of the Ministry of Public Security. The Ministry of National Defense licenses aircraft of the Ministry of National Defense. Other aircraft must be registered at the Ministry of Public Security, but the management responsibility is with the Ministry of National Defense, because the Ministry of National Defense has the necessary equipment and is assigned this task by the Government.
The Minister of National Defense said that previously, the Ministry assigned the Department of Operations to issue licenses, but now the number of ultra-light aircraft and unmanned aerial vehicles has increased significantly, the Ministry will calculate and may stipulate that licensing be granted at the provincial, military region, and military branch levels. However, when deemed necessary, the Minister of National Defense and the Minister of Public Security can suspend flights.
Regarding the right to shoot when carrying out suppression, Minister Phan Van Giang explained that there are directives and circulars stipulating "in any case of suppression to land, if not complied with, then have the right to shoot", "the plane takes off, when requested to land, if not landed, then force, to the point of needing to destroy", to ensure safety and security of the airspace.
The Minister of Defense emphasized: "Protecting the airspace is an important task, carried out by many forces in coordination, at different heights, from far to near, at different levels and in many directions." Of which, below 5,000m is the responsibility of the People's Air Defense Force, higher levels are the responsibility of the Military Regions, and the higher strategic levels are directly the responsibility of the Ministry.
General Phan Van Giang emphasized that determining flight zones is extremely important in combat, this is a principle that has been drawn from wars.
Regarding the management of unmanned aerial vehicles, a National Assembly delegate said "some countries use aircraft that can fly thousands of kilometers", Minister Phan Van Giang informed "every country has this means of flying, we do not lack it". Therefore, he said that the management of aircraft must be assigned to the Ministry of National Defense.
Previously, at the discussion session, National Assembly Delegate Luu Van Duc (Dak Lak delegation) said that the use of drones is relatively popular in high-tech agricultural and forestry production such as irrigation and forest management. In the field of media and cinema, there are flycams; in tourism, there are hot air balloons.
Mr. Duc stated that unmanned aerial vehicles are currently not registered and classified. With the large number of flying vehicles as present, the draft law will create many procedures and administrative costs. Therefore, it is recommended to study and add regulations on classification or exemption for registration of unmanned aerial vehicles and ultralight aircraft to ensure convenience for socio-economic development activities.
National Assembly Delegate To Van Tam (Kon Tum delegation) proposed that the drafting agency add a provision allowing military and police agencies to "shoot down drones and ultralight aircraft" if they cause harm or pose a risk of harming national security.
