Regarding the Van Thinh Phat case, one of the characters mentioned by the Investigation Police is Mr. Duong Tan Truoc, General Director of Tuong Viet Trading and Production Company Limited (Tuong Viet Company). This tycoon was proposed by the Investigation Police to be prosecuted for the crime of Embezzlement of property as an accomplice with Ms. Truong My Lan .

According to the investigation conclusion, Mr. Duong Tan Truoc is not only the General Director of Tuong Viet Company but also the manager and operator of Thuan Tien Real Estate Trading Joint Stock Company (Thuan Tien Company) and Khanh Minh Real Estate Service Investment Joint Stock Company (Khanh Minh Company), Viet Duc Company.

In 2021, Mr. Truoc and Ms. Truong My Lan agreed to transfer Thanh Yen Project for VND 2,500 billion.

To carry out the agreement, Mr. Truoc directed his subordinates to contact the accused Truong Khanh Hoang (Acting General Director of SCB Bank), Tran Thi My Dung (Deputy General Director of SCB Bank) to use the legal entities of Thuan Tien Company and Khanh Minh Company to create fake loan documents at SCB Bank with the amount of 3,500 billion VND, the collateral being the Thanh Yen project.

The amount of 3,500 billion VND after disbursement was transferred to the accounts of many individuals and companies belonging to Truong My Lan's group - Van Thinh Phat Group to be used for many different purposes of Ms. Lan.

In addition, also according to the agreement with Ms. Truong My Lan, Mr. Truoc used two legal entities, Tuong Viet Company and Viet Duc Company, to contact Ms. Tran Thi My Dung and Mr. Truong Khanh Hoang to legalize documents and loan procedures to withdraw VND 1,746.5 billion from SCB Bank.

Of this amount, Ms. Lan used 240 billion VND, Mr. Truoc used 1,368.5 billion VND, and Tuong Viet Company used 138 billion VND.

As of October 17, 2022, the total debt of the above 4 loans was over VND 5,695 billion (principal debt of VND 5,090.5 billion and interest debt of over VND 605 billion). Meanwhile, the total value of collateral assets of the loans that Mr. Truoc directed to legalize the documents was determined to be over VND 337 billion.

The Investigation Police Agency affirmed that there was sufficient basis to determine that Mr. Duong Tan Truoc had assisted and abetted Ms. Truong My Lan in embezzling assets, appropriating more than 4,752 billion VND, causing losses in interest debt of more than 605 billion VND.

After the case was prosecuted on October 17, 2022, Mr. Truoc and Tuong Viet Company paid back SCB more than VND 813 billion (including principal balance of VND 801.8 billion and interest balance of more than VND 11 billion) for 2 loans of Tuong Viet Company and Viet Duc Company. This was assessed by the Investigation Agency as remedying the consequences.

The investigation agency determined that Mr. Truoc also received more than 2,697 billion VND from Ms. Truong My Lan. Of this amount, Mr. Truoc gave back 249.5 billion VND to Ms. Lan (through Ms. Lan's niece Truong Hue Van). Up to now, with more than 2,204 billion VND left, Mr. Truoc voluntarily returned all of this money to Ms. Lan to remedy the consequences of the case.

According to the investigation agency, Mr. Truoc confessed honestly, repented, and actively cooperated with the investigation agency during the process of solving the case. The defendant was fully aware of his violations and voluntarily cooperated with his family to use all of his assets to remedy the consequences of the case. Therefore, the investigation agency requested that the defendant be considered when sentencing.

Regarding the Van Thinh Phat case, the Investigation Police proposed to prosecute 86 defendants for many crimes. Of these, 7 defendants were proposed to be prosecuted for the crime of "Embezzlement of property". They include:

1. Truong Khanh Hoang, former acting General Director of SCB.

2. Tran Thi My Dung, former Deputy General Director of SCB.

3. Ho Buu Phuong, former Chairman of the Board of Directors of Tan Viet Securities Joint Stock Company, former Deputy General Director in charge of finance of Van Thinh Phat Group.

4. Nguyen Phuong Anh, Deputy General Director of Saigon Peninsula Company.

5. Dang Phuong Hoai Tam, Deputy Head of the Board of Directors Office of Van Thinh Phat Group Joint Stock Company.

6. Truong Hue Van, General Director of Windsor Real Estate Management Group.

7. Duong Tan Truoc, General Director of Tuong Viet Trading and Production Company Limited.
