\nAccording to the investigation's conclusions, Mr. Duong Tan Truoc was not only the General Director of Tuong Viet Company but also the manager and operator of the Thuan Tien Real Estate Business Joint Stock Company (Thuan Tien Company), Khanh Minh Real Estate Investment and Service Joint Stock Company (Khanh Minh Company), and Viet Duc Company.
\nIn 2021, Mr. Truoc and Ms. Truong My Lan reached an agreement to transfer the Thanh Yen Project for 2,500 billion VND.
\nTo implement the agreement, Mr. Truoc instructed his subordinates to contact the defendants Truong Khanh Hoang (Acting General Director of SCB Bank) and Tran Thi My Dung (Deputy General Director of SCB Bank) to use the legal entities of Thuan Tien Company and Khanh Minh Company to create fictitious loan applications at SCB Bank for 3,500 billion VND, with the Thanh Yen project as collateral.
\nThe 3.5 trillion VND, after being disbursed, was transferred around in the accounts of many individuals and companies belonging to Truong My Lan's group - Van Thinh Phat Group - for various purposes of Ms. Lan.
\nFurthermore, according to the agreement with Ms. Truong My Lan, Mr. Truoc used two legal entities, Tuong Viet Company and Viet Duc Company, to contact Ms. Tran Thi My Dung and Mr. Truong Khanh Hoang to legitimize loan application documents and procedures to withdraw 1,746.5 billion VND from SCB Bank.
\nOf this amount, Ms. Lan used 240 billion VND, Mr. Truoc used 1,368.5 billion VND, and Tuong Viet Company used 138 billion VND.
\nAs of October 17, 2022, the four aforementioned loans had a total debt of over 5,695 billion VND (principal debt of 5,090.5 billion VND and interest debt of over 605 billion VND). Meanwhile, the total value of collateral for the loans that Mr. Truoc instructed to legitimize was determined to be over 337 billion VND.
\nThe investigating agency affirmed that there was sufficient evidence to determine that Mr. Duong Tan Truoc assisted and colluded with Ms. Truong My Lan in committing acts of embezzlement, appropriating over 4,752 billion VND, causing losses of over 605 billion VND in accrued interest.
\nAfter the case was initiated on October 17, 2022, Mr. Truoc and Tuong Viet Company repaid SCB more than 813 billion VND (including 801.8 billion VND in principal and over 11 billion VND in interest) for two loans of Tuong Viet Company and Viet Duc Company. This was assessed by the investigating agency as mitigating the consequences.
\nThe investigating agency determined that Mr. Truoc also received more than 2.697 billion VND from Ms. Truong My Lan. Of this amount, Mr. Truoc returned 249.5 billion VND to Ms. Lan (through her niece, Truong Hue Van). To date, Mr. Truoc has voluntarily requested to return the remaining more than 2.204 billion VND to Ms. Lan to mitigate the consequences of the case.
\nAccording to the investigating agency, Mr. Truoc has honestly confessed, shown remorse, and actively cooperated with the investigating agency in the process of resolving the case. The defendant clearly understood his wrongdoing and voluntarily cooperated with his family to use all his assets to mitigate the consequences of the case. Therefore, the investigating agency recommends considering this for the defendant when determining the sentence.
\nRegarding the Van Thinh Phat case, the investigating agency has recommended prosecuting 86 defendants for various crimes. Among them, 7 defendants are recommended for prosecution on charges of "embezzlement of assets". They include:
