National Assembly delegates of Quang Tri province discuss in groups about draft laws

Today, November 9, the National Assembly discussed in groups the draft Law on Chemicals, the Law on Amendments and Supplements to a Number of Articles of the Law on Advertising, and the draft Law on Teachers. Delegate Hoang Duc Thang, Deputy Head of the Provincial Delegation of National Assembly Deputies; Delegate Ho Thi Minh, Deputy Head of the Provincial Ethnic Minorities Committee participated in the discussion.

Participating in the discussion on the draft Law amending and supplementing a number of articles of the Law on Advertising, delegate Hoang Duc Thang said that the regulation on the responsibility of advertising professional organizations with the task of "Developing, approving, and organizing the implementation of the code of conduct for advertising professionals; developing and promulgating basic standards for advertising" is not feasible because according to Decree No. 45/2010/ND-CP of the Government regulating the organization, operation and management of associations, professional associations and professional organizations are established from the commune, district, provincial to central levels. If the regulation as in the draft is not feasible for the commune level, it is recommended to specify which level of advertising professional organizations can exercise this right.

Regarding the regulations on requirements for advertising content of special products, goods and services in Article 19a, the delegate said: In Decree No. 181/2013/ND-CP of the Government detailing the implementation of a number of articles of the Law on Advertising, in the process of implementing the Law on Advertising in 2012, the Government has made adjustments when ministries and branches proposed amendments and supplements to the requirements for content and conditions for advertising of newly arising special products, goods and services.

Therefore, if the above content is stipulated in the draft law when it is necessary to amend or supplement the content requirements and advertising conditions for newly arising special products, goods and services, it will be difficult and impossible to flexibly and promptly adjust for special products and goods that are technical and specialized in nature and are easily arising and always fluctuating over time.

Therefore, the delegate proposed to remove the regulation in Article 19a and keep it as the current regulation, which is to assign the Government to specify this content in detail and add a regulation on not requiring confirmation of advertising content for special products, goods and services to ensure flexibility and timeliness when there are changes in practice.

Commenting on the draft Law on Chemicals, regarding the provisions on prohibited acts, delegate Hoang Duc Thang proposed to add to Article 7 a provision prohibiting the discharge of hazardous chemicals into the environment without treatment. This is a common problem today, causing great impacts on the living environment as well as human health. At the same time, it is also proposed to add a provision prohibiting acts of not complying with the regulations on state management of chemicals to this article.

Participating in the discussion of the draft Law on Teachers, delegate Ho Thi Minh, Deputy Head of the Provincial Ethnic Minorities Committee, suggested that the Drafting Committee consider the regulation that "salaries and salary policies for teachers in non-public educational institutions must not be less than salaries and salary policies for teachers in public educational institutions". According to the delegate, it is very difficult to balance implementation for non-public educational institutions.

In fact, the level of agreement between employers and employees is often lower than the average level of teachers with the same expertise in public educational institutions. However, the agreement is also based on the ability to balance the salary source of non-public educational institutions. Strict regulations like the draft may cause non-public educational institutions to be burdened with the cost of paying teachers' salaries, leading to some unwanted negative effects such as: increasing tuition fees, increasing surcharges for students.

Regarding the policy to support teachers working in areas with especially difficult socio-economic conditions to be paid for travel expenses to visit their families, delegates disagreed with the above regulation because it causes unfairness to other civil servants and public employees.

According to the delegate, when performing work duties in difficult areas, teachers have enjoyed special allowance policies, and being supported for personal leave to visit family would be contrary to the provisions of the Budget Law, which stipulates that civil servants and public employees are only supported to pay for transportation and travel expenses once a year when on leave. Therefore, the Drafting Committee is requested to remove this provision to ensure consistency and avoid conflicts and overlaps.

Regarding the retirement age of teachers in Article 30, delegates agreed that the Drafting Committee had stipulated that "Teachers in preschool education institutions can retire at a lower age but not more than 5 years older than the regulation and will not have their pension rate deducted due to early retirement".

However, delegates suggested that consideration should be expanded to include primary school teachers who wish to enjoy early retirement policies.
