On the afternoon of August 21, continuing the 36th session, the National Assembly Standing Committee organized questions and answers on the second group of fields, including: justice; internal affairs; security, order, and social safety; inspection; court; and prosecution.

Application of information technology in the field of justice and litigation

At the meeting, many delegates were interested in questioning the solution to unify the information technology application system in handling citizens' complaints and denunciations, which was an issue of concern to many delegates; breakthrough solutions to improve the quality of trials and settlement of cases; the issue of returning files for further investigation to avoid wrongful convictions and avoid letting criminals escape.

Reflecting on the current situation, delegate Dieu Huynh Sang (Binh Phuoc) said that each agency is using its own software and database on complaints and denunciations, and there is no interconnection. This makes it difficult to monitor and supervise the handling of citizens' petitions, especially between central and local agencies. The delegate said that the prolonged state of complaints and denunciations is also one of the consequences of this problem.

From there, delegate Dieu Huynh Sang requested the Government Inspector General to clarify solutions to unify the information technology application system in handling citizens' complaints and denunciations, ensuring compliance with the requirements in the resolutions of the National Assembly Standing Committee related to this issue.

Responding to questions, Government Inspector General Doan Hong Phong said that the application of information technology in receiving citizens and handling complaints and denunciations has been identified by the Government as one of the key tasks of state administrative reform and has been directed by leaders at all levels and sectors to focus on implementation in recent times.

The Government Inspectorate has advised the Government to issue Decree No. 55 dated August 23, 2022 stipulating the national database on citizen reception, handling of petitions, complaints, denunciations, recommendations and reflections; has built a national database on complaints and denunciations to deploy to ministries, branches and localities nationwide.

The Government Inspectorate has built and is implementing an online citizen reception model; a number of ministries, branches and localities have built software to receive citizens, handle petitions, complaints and denunciations.

Government Inspector General Doan Hong Phong also pointed out some difficulties and shortcomings in the process of applying information technology. That is, it has not met the requirements of connecting data nationwide and connecting within the system of Party agencies, the National Assembly, the Government and judicial agencies, the Vietnam Fatherland Front... Localities, ministries and branches have not regularly updated data into the national database on complaints and denunciations built and being deployed by the Government Inspectorate.

Some ministries, sectors and localities use their own software but do not have interconnectivity. The application of information technology requires large investments in financial and human resources, while the actual conditions in some ministries, sectors and many localities are still limited and have not received due attention.

Regarding solutions in the coming time, the Government Inspectorate continues to advise the Government and the Prime Minister to lead and direct the application of information technology in the work of receiving citizens and resolving complaints and denunciations. In particular, research on investment, upgrading and perfecting the national database on complaints and denunciations; directing ministries, branches and localities to regularly update data into the system; investing in facilities and arranging appropriate staff in this field. At the same time, the Government Inspectorate advises the Government to put the national database on complaints and denunciations into a branch of Project 06 for nationwide connection.

Regarding the court sector, delegate Trinh Minh Binh (Vinh Long) said that according to Resolution 755 of the National Assembly Standing Committee dated March 27, 2023, in the trial work, it is necessary to continue to implement solutions, especially breakthrough solutions to improve the quality of trials, resolve all types of cases to ensure in the proceedings, in the trial and strict compliance with the procedural time limit. From there, the delegate asked the Chief Justice of the Supreme People's Court to inform what breakthrough solutions have been implemented in the past time to effectively implement the above contents.

Regarding solutions to improve the quality of trials, Chief Justice of the Supreme People's Court Nguyen Hoa Binh said that the court has implemented 17 solutions to improve the quality of trials such as: implementing judicial reform tasks; strengthening the assurance of law enforcement in trials; innovating court sessions; improving the quality of judgments; publicizing judgments on the Electronic Information Portal for people to monitor; organizing timely online trials; enhancing mediation; closely coordinating with prosecution agencies and relevant agencies to resolve cases; organizing experience-sharing sessions. In which, the target is assigned to judges to have at least 1 experience-sharing session each year for lawyers, prosecutors, and investigators to participate in commenting on the good and bad aspects of the judges to improve the quality of their trials...

Correct application of returning additional investigation files between prosecution agencies

Questioning the Chief Prosecutor of the Supreme People's Procuracy, delegate Nguyen Thi Viet Nga (Hai Duong) requested to know the solutions that have been implemented and the changes in returning files for additional investigation requests after implementing the Resolution of the National Assembly Standing Committee.

Responding to the question of the delegates, the Chief Justice of the Supreme People's Procuracy, Le Minh Tri, affirmed that returning the case file for further investigation between the prosecution agencies is a permitted measure to prevent wrongful convictions and missed crimes. However, the issue is the need to use this measure correctly. Because during the investigation, prosecution, and trial, if the court or the prosecutor's office develops new circumstances that change the nature of the case, the case file must still be returned for further investigation to avoid wrongful convictions and missed crimes.

Therefore, Director Le Minh Tri said that this content raises unforeseen issues, while we face many new difficulties and complications regarding crime, while at the same time we must ensure human rights, no injustice, no criminals are left out.

Therefore, the Chief Justice of the Supreme People's Procuracy, Le Minh Tri, found that additional investigation is necessary but should not be abused. In addition, in recent times, the 2015 Penal Code and the Criminal Procedure Code have raised some issues that have not been explained by competent authorities, leading to differences in the perception of law application by the prosecution agencies, especially by the investigation agencies and prosecutors...
