Delegate Nguyen Duy Thanh (Ca Mau) commented that mini apartments are very necessary in solving the housing needs of people with limited income. This is a very popular type of housing for young families, students, and workers in big cities due to its moderate area and affordable price, contributing to solving the housing needs of millions of people.
"However, the consequences of this type of housing need to be carefully studied, and regulations need to be in place to meet fire safety requirements, ensure planning, and ensure safety for people, " said Mr. Thanh.
Mr. Thanh cited examples of many small alleys where cars cannot enter, where dozens of floors of apartments with dozens of rooms have been built. A mini apartment building has been built on a few hundred square meters of land without a project, without design, and without ensuring fire prevention and fighting.

According to Mr. Thanh, the Draft Law on Housing (amended) has proposed a type of mini apartments under the name of multi-storey houses, which means that an individual household with a plot of land of several hundred square meters can build a mini apartment for sale without having to establish a business; without having to establish an investment project to carry out investment procedures according to the Investment Law, Housing Law, Real Estate Business Law, etc.
“ Moreover, this also raises issues regarding design feasibility study reports, appraisal basis, fire prevention and fighting, fire prevention and fighting acceptance... If this type is included in the draft law, it will lead to the booming development of mini apartments, not only the issue of fire prevention and fighting safety but also related to solving the problem of social technical infrastructure such as schools, medical services, administration for mini apartment households, which will be a burden in large cities ”, delegate Thanh expressed his opinion.
Also discussing mini apartments, answering the press on the sidelines of the National Assembly on the morning of October 26, delegate Hoang Van Cuong (Hanoi delegation) - Member of the National Assembly's Finance and Budget Committee - said that in current laws, there is no law regulating mini apartments. In reality, mini apartments are built by people who have land, build and resell.
Mr. Cuong said that mini apartments need to adjust two issues: repair and renovation according to apartment standards with built projects.
" Mini apartments that have been built and sold need to be reviewed and considered to see if they have been licensed and designed. We already have housing standards, and we need to apply policies here. If any mini apartment building does not meet the standards after review, the investor himself must repair it to have an escape route, a place for entertainment and public activities, " said Mr. Cuong.

" The first responsibility for the occurrence of mini apartments that are not in accordance with the conditions and standards is the investors. The responsibility of the State management agency in managing and approving incorrectly and uncertainly also needs to be handled administratively. This is not accepting to correct the mistake but must determine that mini apartments have already occurred and must be remedied to ensure people's lives, " Mr. Cuong emphasized.
Regarding the development of multi-storey, multi-apartment housing for individuals, also known as mini apartments stipulated in Article 57 of the draft law, delegate Nguyen Quoc Luan (National Assembly Delegation of Yen Bai province) supported the addition and completion of policies to develop this type of housing, both mobilizing social resources, especially those of the people participating in housing development, and creating conditions for a part of workers, the poor, low-income people, students in urban areas to have more opportunities to access housing at reasonable costs and with simple and flexible conditions.
However, the provisions in Article 57 are not really complete and difficult to implement. Mr. Luan proposed to amend and supplement the provisions in this article in the direction that: The State focuses on managing and controlling planning, urban architecture management regulations, construction permits, quality standards, ensuring environmental hygiene, fire prevention and safety, etc.

The process of land use management transactions does not generate disputes; at the same time, it simplifies administrative procedures so that individuals with land use rights and financial potential can easily participate in developing this type of housing.
In case the draft law cannot be fully researched and supplemented with regulations, it is possible to put forth basic, principled regulations and assign the Government to specify the detailed implementation of the development of this type of housing, especially issues related to sale, lease-purchase, and granting of management and use certificates.

To overcome the shortcomings and limitations in the development, management and use of this type of housing in the past, on the basis of receiving the opinions of National Assembly Deputies and the Government's opinions in Report No. 529/BC-CP dated October 10, 2023, the National Assembly Standing Committee proposed to revise Article 57 more strictly.
Specifically, for multi-storey houses and individual apartments, if there are two or more floors and a scale of less than 20 apartments for rent, they must meet the requirements on construction standards according to the regulations of the Minister of Construction.
Must be designed, approved for fire prevention and fighting and implement fire prevention and fighting safety management measures according to the provisions of law on fire prevention and fighting.
In case an individual builds a house with two floors or more for sale or rent-to-own, or a house with two floors or more and a scale of 20 apartments or more for rent, he/she must prepare an investment project and meet the conditions to be the investor of a housing construction investment project.
