Insufficient legal basis
On October 10, the Department of Education and Training of Da Nang issued Official Dispatch 3018 to its affiliated public service units to notify them of the consideration of promotion of professional titles for civil servants. Accordingly, the consideration of promotion of professional titles for public preschool and primary school teachers will be temporarily suspended.
Accordingly, the Department of Education and Training of Da Nang has developed a Project to organize the review of promotion of professional titles from level III to level II for preschool and general education teachers in affiliated public educational institutions and reported and requested competent authorities to appraise and approve the targets for implementation.
In assessing the promotion criteria, the Department of Home Affairs requested the Department of Education and Training to consider the timing of considering promotion of professional titles to professional titles of grade II or higher when ensuring full legal basis.
Specifically, according to the provisions of Clause 2, Article 32 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government on recruitment, use and management of civil servants (amended and supplemented in Clause 16, Article 1 of Decree No. 85/2023/ND-CP), for the consideration of promotion to professional titles of grade II and grade I, in addition to the general conditions as prescribed, the Ministry managing specialized professional titles must issue specific regulations on standards and conditions for consideration of promotion.
To date, the Ministry of Education and Training has not issued a Circular regulating the conditions and criteria for considering promotion of professional titles of public preschool and primary school teachers. The Department of Education and Training of Da Nang has proposed that the Ministry of Education and Training soon issue a Circular so that localities have a legal basis for considering promotion of professional titles of preschool and primary school teachers from level III to II.
After the Ministry's circular is issued, the Department of Education and Training will immediately implement the promotion consideration for teachers under its management authority; units will send people to the Department of Organization and Personnel (Department of Education and Training of Da Nang) to receive the records of teachers who have registered for promotion consideration, keep them or give them to teachers to keep to continue implementing the registration when there are instructions from the Department of Education and Training.
Previously, the People's Committees of districts and towns of Da Nang City established a Council to consider promoting the professional titles of preschool, primary and secondary school teachers from grade III to grade II in public education and training units under their management. For example, Hai Chau district had 427 officials passed the promotion exam held in July 2024, including: 296 in preschool; 73 in primary school; 58 in secondary school. Thanh Khe district had 301 teachers promoted from grade III to grade II.
Hoa Lu Primary School (Thanh Khe District) has 12 out of 13 teachers recognized for promotion from Grade III to Grade II and will start receiving new salaries from October 2024. Ms. Huynh Thi Thanh Tinh - Principal of the school said: "The promotion results have created more motivation for teachers to strive, from teachers who were transferred from Grade III to Grade II and young teachers who do not have enough seniority to participate in the promotion review.
The effort in self-improvement of professional qualifications and teaching experience demonstrated through professional competitions such as E-learning lesson design, excellent homeroom teacher competitions, excellent teachers at all levels... will be an advantage to enrich the achievements of teachers when participating in the promotion consideration.

Teacher's thoughts
At the time when the People's Committee of Lien Chieu District (Da Nang) organized the review of promoting the professional title of preschool, primary and secondary school teachers from grade III to grade II in public education and training units under its management, Mr. Le Vo Minh Hop - teacher of Nguyen Binh Khiem Secondary School had 3 months left for the working time criterion.
Although he has nearly 10 years of teaching experience, because he did not count the 1-year internship, Mr. Hop is not eligible to participate in the promotion review until August 2024. So when he heard that the Da Nang Department of Education and Training had temporarily suspended the review, Mr. Hop said he was only a little concerned about when the promotion review would be held again.
Mr. Le Minh Hieu - teacher of Le Dinh Chinh Primary School (Hai Chau District, Da Nang City) registered for the school-level excellent teacher competition in the 2024-2025 school year and strived to meet the criteria to participate in the school-level emulation fighter title selection.
“In July 2024, when the Hai Chau District People's Committee announced the exam to promote teachers from Grade III to Grade II, I had not yet worked enough. Meanwhile, my achievement score had reached 20 points. If the suspension of the promotion exam is prolonged, it will be a great disadvantage for teachers who are expected to be eligible to participate in 2025,” Mr. Hieu confided.
While the units and schools under the Department of Education and Training of Da Nang's districts have had a promotion review and have received new salaries, the units and schools under the Department of Education and Training have not had any changes. Voter Vo Thi Huong - Group 22, Nai Hien Dong Ward (Son Tra District, Da Nang City) has also sent a petition to the People's Council of Da Nang City, requesting the Department of Education and Training to coordinate with the Department of Home Affairs to consider promotion for high school teachers.
In Official Dispatch No. 7415 dated December 15, 2023 on the implementation of regulations on promotion of professional titles of civil servants, the Ministry of Home Affairs requested that the Ministries managing professional titles of specialized civil servants promptly issue regulations on standards and conditions for promotion consideration as prescribed in Clause 16, Article 1 of Decree No. 85/2023/ND-CP, ensuring compliance with the deadline prescribed in Clause 5, Article 2 of Decree No. 85/2023/ND-CP, as a basis for Ministries, branches and localities to promptly organize the consideration of promotion of civil servants.
