Da Lat proposes to cancel the auction results of Thuy Ta restaurant

On November 24, the People's Committee of Da Lat City announced that it had just submitted a document to the People's Committee of Lam Dong Province to consider canceling the decision to approve the auction results for renting houses associated with the 10-year land use rights lease for Thuy Ta restaurant (on the scenic Xuan Huong Lake).

Unable to change name, Thuy Ta restaurant auction winner asks to 'withdraw'

Previously, the People's Committee of Da Lat City received a document from the Lam Dong Province Property Auction Service Center regarding the customer Doan Hai Ha's announcement that he would not invest in Thuy Ta restaurant. The reason Mr. Ha gave was that his preliminary business plan required him to change the name of Thuy Ta restaurant to HV restaurant, which means removing the word Thuy Ta and changing it to HV. Mr. Ha said that this name change would help him earn a large amount of revenue each year, not to mention advertising for other brands.

Mr. Ha wanted to change the name of Thuy Ta restaurant but was not approved.

According to the People's Committee of Da Lat City, Mr. Ha's proposal has no basis for implementation. Because Thuy Ta restaurant belongs to area I of the national scenic spot Xuan Huong Lake (recognized in 1988). At the same time, the urban design content of Thuy Ta restaurant (orientation of space organization, beautiful views and angles, traffic, lighting, trees, planning criteria, architecture...) has been stipulated in Decision 2609/QD-UBND (dated November 25, 2016) of the Provincial People's Committee; on the basis of the Ministry of Culture, Sports and Tourism's document (No. 1941/BVHTTDL-KHTC dated May 26, 2016) on the agreement on detailed planning of Xuan Huong Park and urban design of Xuan Huong Lake.

Changing the name of Thuy Ta restaurant (area I of Xuan Huong lake) must be processed and approved by relevant ministries. Da Lat City People's Committee does not have the authority to change this name.

Also according to the People's Committee of Da Lat City, after 15 days from the date the Provincial People's Committee approved the auction results, Mr. Ha still did not fulfill his obligation to pay the approved auction winning money, and at the same time announced that he would not invest in Thuy Ta restaurant. Although Mr. Doan Hai Ha had successfully bid and had a decision approving the auction winning results, the auction winner refused the results and refused to pay the auction winning money, so the auction winner had to lose the deposit (more than 608 million VND - PV), the cancellation of the auction winning results is in accordance with the Law on Property Auctions 2016.

In addition to the proposal to cancel the auction results, the People's Committee of Da Lat City also proposed that the Provincial People's Committee agree in principle to allow the City to continue organizing the second auction to lease Thuy Ta restaurant according to the procedures and order of the approved auction organization plan.

Previously, Thanh Nien reported that recently, public opinion was stirred up and felt "shocked" when Mr. Doan Hai Ha (Bac Tu Liem, Hanoi) won the auction to rent Thuy Ta restaurant in Da Lat city with a "huge" price of up to 15.150 billion VND/year (must pay rent once for 10 years is more than 151 billion VND), while the starting price was only 3.040 billion VND/year.
