
To promote domestic and foreign investment attraction in the new phase of industrial parks (IPs), it is necessary to remove bottlenecks in resettlement and site clearance compensation (B-GPMB).
From Bac Chu Lai Industrial Park
Bac Chu Lai Industrial Park is located in Tam Hiep Commune, Nui Thanh District with a total area of 361.4 hectares. Of which, phase 1 has an area of nearly 177 hectares and has completed BT-GPMB. Currently, CIZIDCO Company is continuing to implement phase 2, an area of 185.4 hectares.
Up to now, the company has completed land acquisition and clearance for about 134 hectares; of which, with an area of 61.8 hectares expected to be reclaimed and handed over by the Quang Nam Provincial People's Committee to Truong Hai Auto Corporation to expand the THACO Automobile Mechanical Industrial Park project, the company has completed land acquisition and clearance for 23.5 hectares.
For the remaining area of 38.3 hectares, the company has temporarily suspended the compensation and site clearance work and is completing procedures to reduce the area according to the direction of the Provincial People's Committee. For the area of 122.7 hectares, there are currently 9.2 hectares of land that must be compensated and site clearance work. CIZIDCO Company is completing procedures to complete the work and complete it in 2024.
In addition to the achieved results, the work of compensation for land acquisition and compensation still has many difficulties and problems. Specifically, regarding compensation for public land: Within the area of 9.2 hectares being implemented for compensation for land acquisition and compensation, there are 38 plots of land with an area of over 26,960m2 of public land that are being used and cultivated stably by the people. However, according to the provisions of the law, people will not be compensated for this land.
Up to now, the investment in the construction of the technical infrastructure of Bac Chu Lai Industrial Park (phase 2) has entered the urgent stage. Therefore, the People's Committee of Nui Thanh district and relevant agencies need to urgently consider and soon issue instructions to resolve the problem of public land and speed up the approval of compensation plans and resettlement arrangements for people to hand over land to the project soon.
Untie the knots for Tam Thang Industrial Park
The total area of Tam Thang Industrial Park is over 197 hectares in Tam Thang Commune (Tam Ky City). Up to now, CIZIDCO Company has completed compensation for 159.29 hectares and continues to implement about 20% of the remaining area (38.3 hectares). In this 38.3 hectares, compensation is mainly for agricultural land, residential land (perennial land, garden land, pond land), resettlement for about 100 households and relocation of 1,500 graves of all kinds.
To date, 7 compensation plans have been approved for a total of 809 graves, with money paid to 696 grave owners and 511 graves relocated. However, some households have commented that the compensation for the land graves is still low, not enough to cover the cost of building graves at the commune's new burial site.
At the same time, the burial site of Mr. Ke and the forest of Mr. Tra are low-lying and have not been relocated yet, and need to be upgraded to avoid flooding. For this, CIZIDCO Company has actively coordinated with the People's Committee of Tam Thang Commune to support the people with means of transporting earth to fill the land to speed up the compensation process.
Regarding the scope of 11ha of agricultural land, up to now, the land origin has been confirmed 12 times, with an area of 4.8ha. The biggest problem is that the current land use status of the people still has many cases that do not match the records of the Land Use Right Certificate, leading to difficulties in determining the origin of the land. Especially, there is no specific land price, so there is no basis for making a compensation plan.
Regarding residential land and housing, CIZIDCO Company has completed the inventory of 23 land plots with an area of 4.2 hectares and is continuing to implement BT-GPMB for the remaining area. However, there is currently no specific land price, so there is no basis for making a compensation plan.
In addition, other existing cases such as: the case of 5 households with houses, there was a decision approving the compensation plan at the end of November 2017, however at that time there was not enough land fund for resettlement so it was suspended until now.
Recently, the Tam Ky City Land Fund Development Center has issued report No. 639 dated April 24, 2024 on the existing contents and proposed that the Tam Ky City People's Committee consider and report to the Department of Natural Resources and Environment to advise the Provincial People's Committee to give instructions for implementation for these remaining cases, but so far there has been no guidance document from the superiors.
Create new breakthroughs
For the expanded Tam Thang Industrial Park with a total area of 242 hectares in Binh Nam commune, Thang Binh, with a total investment of 768 billion VND, CIZIDCO Company was assigned by the Prime Minister as the investor in January 2022.
Over the past 2 years, CIZIDCO Company has completed BT-GPMB for 45 hectares within the 50.1 hectares of land acquisition (phase 1), relocating 321 graves... The remaining area of 5.1 hectares has not been approved, due to problems such as Bac Chu Lai Industrial Park, Tam Thang Industrial Park in determining land prices, inheritance, 5% land, overlapping plots with Tam Thang 2 Industrial Park...
In addition, due to the need to adjust the Project Investment Certificate to have a basis for implementing land allocation and land lease according to schedule and ensuring current regulations, the completion of land lease procedures is prolonged.
Currently, the Provincial People's Committee has handed over to the Management Board of Economic Zones and Industrial Parks of Quang Nam province an area of 10.35ha/45ha that has been compensated. However, due to the lack of specific land prices, the Management Board of Economic Zones and Industrial Parks of the province has not agreed to lease the land to CIZIDCO Company. Therefore, CIZIDCO Company cannot lease the land to the investor (Hyosung Group), which affects the opportunity to attract investment in the Industrial Park.
Mr. Nguyen Vinh Duong - Deputy Director of CIZIDCO Company acknowledged that the progress of BT-GPMB at projects in the expanded Tam Thang Industrial Park has been implemented drastically, but the resolution of problems is still slow.
The project approval has not been completed due to appraisal by many competent agencies; the appraisal of the total project investment has been prolonged due to the determination of the project's investment capital; the resolution of existing problems within the 50.1ha area has not met requirements.
The objective reasons are that many procedures related to inheritance must be carried out; public land, land without compensation price, land not eligible for compensation, land overlapping boundaries; the measurement file of 89.5 hectares does not meet the requirements.
In addition, the implementation of documents and procedures related to land, resettlement, and compensation and site clearance will also be affected in the near future because we have to wait for competent authorities to direct and guide the implementation according to the new Land Law that will take effect from August 1, 2024.
From now until the end of 2024, CIZIDCO Company is determined to make a breakthrough to complete key tasks such as completing BT-GPMB 50.1ha. Approving the map, implementing compensation procedures for the area of 89.5ha; completing the approval of the Feasibility Study Report.
Approving the contractor selection plan, implementing contractor selection, and performing mine clearance. At the same time, conducting surveys, preparing and submitting for approval the design documents for construction protection of about 130 hectares; completing the adjustment of the Investment Registration Certificate for Tam Thang Industrial Park Expansion; negotiating MOU and drafting a Land Sublease Contract with Hyosung Company; preparing documents to add business lines to Tam Thang Industrial Park Expansion...
As of June 30, 2024, 3 industrial parks invested by CIZIDCO Company have attracted 55 investment projects. Of which, there are 25 domestic projects with a total registered capital of nearly 4,577 billion VND; 30 FDI projects with a total registered capital of 758.5 million USD.
Hyosung Group, Korea is the largest investor with a total registered capital of 445 million USD with 2 investment projects: Automobile airbag fabric factory (35 million USD); Curtain fabric factory (410 million USD) in Tam Thang Industrial Park and Tam Thang Industrial Park expansion, with a scale of more than 80 hectares.
