Ho Chi Minh City Inspectorate has just announced the inspection conclusion related to the management and use of state-managed real estate in District 7.

According to the inspection conclusion, in 2009, District 7 Public Service One Member Co., Ltd. (abbreviated as District 7 Public Service Company) was assigned by the Ho Chi Minh City People's Committee to use land at 8 Dao Tri Street, Phu Thuan Ward (District 7). Accordingly, the Department of Natural Resources and Environment signed a contract with District 7 Public Service Company to lease a land area of ​​15,766.9 m2 to build a garbage transfer station and a collection house for garbage collection vehicles.

The land lease term is divided into 3 areas, respectively 9,481.8 m2 (lease term is 50 years); 1,389.8 m2 (temporarily leased to the Company until the State implements the planning); 4,895.3 m2 (the Company is temporarily used and is responsible for fully implementing the contents of environmental protection).

Ho Chi Minh City Inspectorate has just announced the inspection conclusion related to the management and use of state-managed real estate in District 7.

In 2016, the Ho Chi Minh City People's Committee decided to change the purpose of 600 m2 (in the 9,481.8 m2 land area) to use as a gas station. After that, the District 7 Public Service Company was granted a Certificate of land use rights, house ownership rights and other assets attached to the land by the Department of Natural Resources and Environment for the area of ​​600 m2 and for the remaining area of ​​8,881.8 m2 .

In 2018, District 7 Public Service Company signed a business cooperation contract with Global Logistics Services Company Limited (abbreviated as Global Company) on a land area of ​​1,389.8 m2 and Nha Be River safety corridor (4,895.3 m2 ) to exploit and operate parking lots and empty containers.

Accordingly, regarding profit sharing, Toan Cau Company will share profits with District 7 Public Service Company in the amount of 90 million VND/month, the profit sharing period is calculated from September 15, 2018.

From September 15, 2018 to April 10, 2024, Toan Cau Company distributed profits to District 7 Public Service Company of more than 6.4 billion VND. Of which, District 7 Public Service Company recorded revenue of more than 5.8 billion VND and value added tax payable of more than 589 million VND. By May 2024, District 7 Public Service Company had terminated the Contract with Toan Cau Company.

The Ho Chi Minh City Inspectorate found that the area of ​​roadside land and river corridor belonging to the 15,766.9 m2 land plot with the purpose of being used as a garbage transfer station and a gathering place for garbage collection vehicles, was temporarily assigned by the Ho Chi Minh City People's Committee to the District 7 Public Service Company for use.

At the same time, although District 7 Public Service Company signed a business cooperation contract, it received a fixed profit, so according to the regulations of the Ministry of Finance, it actually leased land to Toan Cau Company.

Therefore, according to the previous decision of the Ho Chi Minh City People's Committee on land allocation, District 7 Public Service Company used the land in violation of regulations.

The Ho Chi Minh City Inspectorate said that through working with the Department of Finance, this unit believes that according to the approved plan of the Ho Chi Minh City People's Committee, the address at 8 Dao Tri Street was assigned to the District 7 Public Service Company to continue to use as a garbage transfer station. Therefore, the District 7 Public Service Company did not use it for the right purpose.

The Department of Finance requested District 7 Public Service Company to return all the money collected from the above lease to the State budget, specifically more than 5.8 billion VND.

The City Inspectorate recommended that the Chairman of the Ho Chi Minh City People's Committee assign the Director of District 7 Public Service Company to review the responsibilities of organizations and individuals with shortcomings, limitations, and violations in land management and use.

At the same time, urgently pay more than 5.8 billion VND into the account of the Ho Chi Minh City Inspectorate because the District 7 Public Service Company used the land at 8 Dao Tri Street in violation of regulations. This must be completed by January 2025.
