Rotate civil servants to receive and evaluate documents
The Ministry of Health has just issued Circular 01/2004/TT-BYT "Regulating the list and period of periodic job transfer for civil servants not holding leadership or management positions in units under the Ministry of Health and under the management scope in the local health sector" (Circular 01/2004/TT-BYT).
According to Circular 01/2004/TT-BYT, there are 40 lists of positions in 7 health sectors that must periodically transfer civil servants, including: preventive medicine; medical examination and treatment; pharmaceuticals, cosmetics, traditional medicine; food safety, nutrition; medical equipment; health insurance and science and technology.
Accordingly, job rotation is applied to civil servants in charge of receiving, processing and submitting dossiers to competent authorities for decision: granting new, re-granting, adjusting, revoking, extending, changing, supplementing, and announcing types of licenses, registrations, certificates, confirmations, certificates, dossier receipt numbers; issuing lists, programs, and documents in the fields of state management of health.
The period for periodic job transfer is from 2 to 5 years, depending on the characteristics of each job position. The time for job transfer is calculated from the date of the decision or document assigning the position. Decisions and documents assigning the position issued before the effective date of this Circular will be considered to calculate the time of assuming the position.
For units with only one position in the list of periodically converted positions, and this position has professional and technical requirements different from the remaining positions of that unit, the unit shall report to the direct superior agency, and the conversion shall be planned by the head of the direct superior agency in general.
The head of the unit shall, based on the list of positions that must be periodically transferred and the actual situation at the unit, develop a plan for transferring work positions; specify the period for periodically transferring work positions for each position of the unit.
This Circular takes effect from April 15, 2024.
Assessment and licensing of preventive medicine and medical examination and treatment
According to Circular 01/2004/TT-BYT, preventive medicine has 7 positions to review records, issue licenses, and announce types of licenses, including: certificates of testing facilities meeting biosafety standards level 3 and level 4; circulation registration numbers, import licenses, and free circulation certificates for chemicals, insecticides, and disinfectants used in the household and medical fields; certificates of advertising content for chemicals, insecticides, and disinfectants used in the household and medical fields; certificates of acceptance of conformity declarations, certificates of compliance with regulations for cigarettes; operating licenses for clinics, occupational disease treatment clinics, etc.) that need to rotate civil servants.
Regarding medical examination and treatment, civil servants working in licensing appraisal positions: practicing medical examination and treatment; medical examination and treatment activities; confirming advertising content of medical examination and treatment services; technical list of medical examination and treatment facilities... need to be rotated, according to the unit's plan, on the basis of regulations in the circular.
Most licenses are in the pharmaceutical and cosmetic fields.
According to the list in Circular 01/2004/TT-BYT, the list that needs the most appraisal and licensing is in the fields of pharmaceuticals, cosmetics, and traditional medicine, with 14 types of records and documents.
Types of licenses, including: registration for circulation of drugs, pharmaceutical ingredients; license for export, import of drugs, pharmaceutical ingredients, packaging in direct contact with drugs; pharmacy practice certificate; certificate of eligibility for trading in drugs, medicinal herbs, traditional medicines; certificate of facility meeting good manufacturing practice standards for drugs, pharmaceutical ingredients; good clinical trial practice (GCP); certificate of eligibility for cosmetic production; certificate of cosmetic advertising; registration for circulation of medicinal herbs, traditional medicines according to the provisions of law; certificate of person with traditional medicine prescription or traditional treatment method; certificate of information content, advertising content of traditional medicines and adjustment of information content, advertising content of traditional medicines...
In addition, in the field of food safety and nutrition, the above circular stipulates 6 positions of civil servants that need to be rotated, which are cases of receiving and appraising dossiers: certificate of acceptance of product declaration registration for health protection foods, mixed food additives with new uses; confirmation of advertising content for health protection foods, medical nutrition products, foods for special diets; certificate of qualified food safety facilities meeting the requirements of good manufacturing practices for health protection foods...
In the field of medical equipment, the Ministry of Health stipulates the application of job rotation for appraisal and licensing officials (medical equipment circulation number; free circulation certificate for medical equipment; medical equipment import license; certificate of registration for medical equipment inspection activities within the assigned management scope; number of receiving dossiers declaring establishments qualified to manufacture medical equipment, dossiers declaring establishments qualified to buy and sell medical equipment, etc.).
Regarding health insurance, work rotation with civil servants in charge of receiving documents, processing and submitting to competent authorities for decision on the list and rate, payment conditions for modern medicines, pharmaceutical chemicals, biological products and markers; list of medicinal herbs, traditional medicines, medicines combining active ingredients with medicinal herbs, traditional medicines, medicinal herbs, medical supplies within the scope of benefits of health insurance participants; free medicine support program for medical examination and treatment facilities to treat patients not covered by foreign non-governmental aid...
