Many hospitals recall products of fake milk production company

On April 17, 108 Central Military Hospital informed that the hospital had checked and discovered that the Hofumil Gold Plus milk product supplied in the hospital was on the list of milk products produced by one of the above companies that had just been busted by authorities.

The 108 Military Central Hospital said that the Hofumil Gold Plus milk product used in the hospital had gone through a public bidding process in accordance with the law. Therefore, if the Hofumil Gold Plus milk product is concluded by the State authorities to be a counterfeit product, the hospital and the patients will be the victims of this incident.

The hospital also confirmed that it had recalled the product to return it to the supplier; at the same time, it accompanied the patient in requesting the supplier to refund the amount of money spent on the product to protect the patient's rights.

Similarly, on April 18, informing the press, a representative of Bac Kan General Hospital said that after reviewing, it was determined that the Hapomil milk product supplied to the hospital by Happy World International Nutrition Joint Stock Company was on the list of milk products produced by Rance Pharma International Pharmaceutical Joint Stock Company [the company that produces fake milk - PV].

This product was put into use after a bidding process in accordance with legal regulations. The hospital did not sign a direct contract with Rance Pharma International Pharmaceutical Joint Stock Company.

The hospital also said that although there is no information from the authorities about whether the Hapomil milk product is fake or not, to ensure the rights and safety of patients, from April 12, the hospital's leaders have directed specialized units to stop advising on the use and recall this product to return it to the supplier.

It is known that the retail price of these milks is not cheap, even comparable to many foreign milk brands. A box of powdered milk costs from 500,000 to 600,000 VND at the lowest, while some are 800,000 to 900,000 VND. The public is asking the question, how responsible is the hospital when it lets fake milk “slip through” and advises patients?

How is the hospital responsible when fake milk is "leaked"?

Speaking to Nhan Dan Newspaper reporters, lawyer Dang Van Cuong, Head of Chinh Phap Law Office, Hanoi Bar Association, said that if this type of milk is one of the fake milks identified by the investigation agency, the investigation agency will also work with the hospital to clarify how the product is sold. What is the mechanism for selling the product to this hospital, and is it in compliance with legal regulations?

From there, the police will determine how the hospital benefits from this sales activity; whether the patients buy the products according to the instructions, guidance or requests of the hospital doctors or not? Is the hospital entitled to deduct a percentage of the commission according to the agreement with the supplier or not?...

“In case of violations in business cooperation and goods trading that cause damage to patients and their families, the hospital must take joint responsibility, specifically the officials who committed the violations (if any),” lawyer Dang Van Cuong analyzed.

Lawyer Dang Van Cuong also said that the investigation agency will also clarify the amount of powdered milk consumed at this hospital, clarify the business mechanism as well as the awareness and information of those who directly work with the milk supplier to determine legal responsibility.

In cases where there is evidence that the store, supermarket, or hospital knows that the milk is fake but still sells it because of the desire for high discounts and high sales, the violator may be criminally prosecuted for deceiving customers. In cases where the seller does not know, they may not be held legally responsible, but they are responsible for refunding customers who buy this fake milk.

During the investigation of this case, the investigation agency will also clarify all responsibilities and roles of all related organizations to consider handling according to the provisions of law. In case of assisting or supporting the consumption of counterfeit goods, they will also be handled.

Lawyer Cuong also shared that there is initial information showing that sales units can receive a discount of 40 to 60% of the product value, this is a very large discount value showing that the quality and production costs are not guaranteed, if honest, this product cannot be sold in the market.

The Ministry of Public Security's Investigation Police Agency has prosecuted and temporarily detained two masterminds, Vu Manh Cuong and Hoang Manh Ha, along with six other defendants for "Producing and trading in counterfeit food products" and "Violating accounting regulations causing serious consequences". In order to create a widespread distribution network, the subjects established and operated 11 other companies to produce and distribute 573 types of fake milk.
