After consulting with ministries and branches, the Ministry of Transport has just submitted to the Government a draft decree regulating the conditions for business of motor vehicle inspection services; organization and operation of inspection facilities; and the life span of motor vehicles.

In particular, the Ministry of Transport proposed to regulate the conditions for opening motorcycle emission testing facilities.

Specifically, the fixed area for motorcycle and motorbike emission inspection must have a minimum area of ​​15m2 corresponding to one emission measuring device.

In case the area of ​​the inspection area is used in conjunction with maintenance and repair activities for motorbikes, it must not hinder the movement of the vehicle and the operations of the inspector.

Mobile emission testing facilities do not have to meet the above regulations. However, equipment and measuring devices for emission testing are permanently installed on specialized vehicles for mobile emission testing.

Regarding human resources, the motorcycle emission inspection facility must have at least 1 inspector of grade 1 or 2 according to regulations. Of which, a grade 1 inspector must meet the conditions of having worked in inspection for 5 years and be granted an inspector certificate; a grade 2 inspector must have a bachelor's or engineer's degree in a technical field related to motor vehicles, specialized motorcycles, etc.

A third-class inspector must have a secondary school diploma in a technical field related to motor vehicles and specialized motorbikes and be granted a third-class inspector certificate according to the provisions of law.

In addition, the Ministry of Transport also stipulates that the Department of Transport will be the agency responsible for issuing new, re-issuing, temporarily suspending, and revoking certificates of eligibility for motor vehicle inspection activities and certificates of eligibility for motorcycle and motorbike emission inspection activities.

There are currently about 70 million motorbikes nationwide, of which 80% are 5 years old or older and require inspection (equivalent to nearly 56 million motorbikes).

The representative of the Vietnam Register said that the technical facilities of the inspection facility do not require much. In addition to being equipped with emission testing equipment and computers with internet connection, the minimum area required for the inspection area is 15m2/1 device and can be used in conjunction with vehicle maintenance and repair activities. According to calculations, there are approximately 3,000 facilities nationwide that ensure the implementation of motorcycle emission testing.

Automobile inspection facilities are allowed to conduct motorcycle emission testing.

Commenting on the above regulation, a representative of the Ministry of Justice said that the drafting agency needs to research and clarify whether current motor vehicle inspection facilities meet the conditions for inspecting emissions of motorbikes and motorbikes or not.

In case the motor vehicle inspection facilities are qualified to operate, the drafting agency considers not requiring the inspection facilities to be additionally granted a certificate of eligibility to operate motorcycle and motorbike emission inspection.

Or integrate the certificate of eligibility for motorcycle and motorbike emission inspection with the certificate of eligibility for motor vehicle inspection. The goal is to ensure reduction and simplification of investment and business conditions, saving compliance costs for investors.

Explaining this opinion, a representative of the Ministry of Transport said that the draft Decree stipulates that motor vehicle inspection facilities must both conduct inspections for motor vehicles and at the same time conduct emission inspections for motorbikes and scooters.

“Because the motor vehicle inspection facility, in addition to meeting the conditions for motor vehicle inspection services, also fully meets the conditions for facilities and human resources for inspection of motorcycle and motorbike emissions.

Therefore, it is enough to issue only one certificate of eligibility for motor vehicle inspection activities (not two types of certificates) to ensure reduction and simplification of procedures and conditions for investment and business, saving compliance costs for investors...", said the Ministry of Transport.

Previously, the Ministry of Transport also issued Circular 46 stipulating national technical regulations on technical facilities and locations of motor vehicle inspection facilities, motorcycle and motorbike emission inspection facilities, and national technical regulations on automobile warranty and maintenance facilities.
