The Steering Committee for the arrangement of administrative units at all levels and the construction of a model for organizing two-level local governments has just issued Official Dispatch No. 03/CV-BCĐ to the City Party Committee and Provincial Party Committee on the orientation of a number of tasks for the arrangement of administrative units and the organization of two-level local governments; on the organization of the apparatus, cadres, civil servants and public employees when implementing the arrangement.
Regarding local government at the commune level (commune, ward, special zone), the Steering Committee said the structure orientation includes the People's Council and People's Committee.
In which, the People's Council at the commune level establishes 2 Committees: the Legal Committee and the Economic - Social Committee.
The People's Committee at the commune level establishes a maximum of 4 departments and equivalents suitable to the characteristics of urban, rural and island areas, including: Office of the People's Council and People's Committee; Economic Department (for communes and special zones) or Economic, Infrastructure and Urban Department (for wards and special zones in Phu Quoc); Department of Culture - Society; Public administrative service center (identified as another administrative organization under the People's Committee at the commune level).
The Steering Committee assigns the Provincial People's Committee to decide on the appropriate number of specialized agencies under the People's Committee (but not exceeding 4 departments and equivalent). In case the locality organizes the number of specialized agencies under the Commune People's Committee under 3 focal points, it can arrange for an additional Vice Chairman of the People's Committee to directly lead and direct.
In the case of commune-level administrative units remaining the same (not rearranged), the locality shall base on the reality to consider and decide on the appropriate number of specialized agencies under the People's Committee or not to organize specialized departments according to the general guidance (except for the existing People's Council Committees) but to assign specialized civil servants to directly undertake job positions to perform functions and tasks. In the case of not organizing specialized departments under the People's Committee at the commune level, the provincial People's Committee shall decide to increase the number of staff compared to the current number of commune-level cadres and civil servants to perform the new tasks transferred from the district level. The expected number of staff shall not exceed 40 cadres and civil servants, focusing on civil servants directly undertaking the fields of Party building work, work of the Vietnam Fatherland Front and socio-political organizations, and government work.
For island districts and island cities with commune-level administrative units under their management, when being reorganized into special zones, the operation of commune-level administrative units will end and the current number of specialized agencies of island districts and island cities will be kept unchanged; then, new instructions from the Government will be implemented.
Arrange and use part-time leaders
Regarding leadership positions, implementing the policy of competent authorities on arranging commune-level leadership positions to concurrently hold the positions of heads of advisory agencies, assisting the Party Committee, the Fatherland Front, socio-political organizations, and the government to increase the number of civil servants working directly to resolve the work of people and businesses, the Steering Committee oriented the leadership of the People's Council at the commune level to include a Chairman (concurrent position) and 1 Vice Chairman (full-time position).
The leadership of the People's Committee at the commune level includes the Chairman (full-time position) and 2 Vice Chairmen (1 Vice Chairman concurrently holds the position of Chief of Office of the People's Council and People's Committee; 1 Vice Chairman concurrently holds the position of Director of the Public Administration Service Center).
The Committees of the People's Council have a Head (part-time position) and 1 Deputy Head (full-time position).
The departments and equivalents of the People's Committee have a Department Head (full-time position or concurrently held by the Vice Chairman of the People's Committee) and 1 deputy (full-time position).
In case the commune-level administrative unit remains the same (not rearranged) and does not organize specialized departments, the number of Vice Chairmen of the People's Committee at the commune level can be increased by 1 Vice Chairman to ensure the leadership and management role of the government in serving the people and businesses.
Local authorities are assigned to proactively arrange and assign part-time leaders or reduce deputy positions in specialized departments and offices based on requirements and tasks to increase the number of civil servants working directly to meet the requirements of serving people of the new commune-level administrative unit.
It is expected that each commune level will have about 32 positions on average.
Regarding staffing, the Steering Committee sets out the orientation: Transfer 100% of the existing district-level staffing to arrange commune-level staffing, in which the current leadership and management staff of the district-level political system are arranged as the core at the new commune-level units; it is possible to increase provincial-level staff, civil servants and public employees to the commune level.
The Steering Committee requests that in the immediate future, the current number of staff and civil servants at district and commune levels be maintained to arrange work at the commune level and to review and streamline staff in conjunction with restructuring and improving the quality of the team to meet task requirements, ensuring that within a period of 5 years, they will basically comply with regulations.
The average expected staff of each commune level is about 32 staff (not including party and mass organizations).
Regarding the staffing of public service units, based on the plan to arrange and restructure public service units by sector and field at the new commune level according to the guidance of the sector and field management ministry, localities are responsible for arranging the staffing quota of public service units receiving salaries from the budget within the total staffing assigned by competent authorities, ensuring the implementation of staff streamlining in conjunction with restructuring and improving the quality of the staff, promoting autonomy for public service units by sector and field in accordance with the conditions and characteristics of each locality.
For non-professional workers at the commune, village and residential group levels, it is expected that the use of non-professional workers at the commune level will end from August 1. The local authorities will consider and possibly arrange non-professional workers at the commune level who meet the requirements of the task to participate in work at the village and residential group and implement the regime and policies for cases where work is not arranged according to regulations.
In addition, the document clearly states that villages and residential groups continue to be self-governing organizations of residential communities, not administrative levels.
For now, the existing villages and residential groups will be kept intact. After completing the arrangement of administrative units at all levels, the Government will assign the Ministry of Home Affairs to study and provide guidance under the direction of competent authorities on the arrangement and reorganization of villages and residential groups in a streamlined manner, directly serving the lives of the local community.
