“Obstacles” at Hoa Lien Expressway Project

To bring the Hoa Lien – Tuy Loan Expressway Project, part of the Eastern North – South Expressway, to the finish line, Da Nang must overcome many “obstacles”, the biggest difficulty of which is the lack of land for resettlement.

Difficulties in site clearance

According to the Department of Natural Resources and Environment of Da Nang City, by the end of 2023 and early 2024, there will be relevant legal documents to have enough basis to implement land acquisition and site clearance for the Hoa Lien - Tuy Loan Expressway Project.

Specifically, by April 3, 2024, the Ministry of Transport will provide sufficient funding to cover affected land (including land areas between the main route and the parallel service road) approved by the Da Nang City People's Committee in the compensation, support and resettlement plan of the Project.

Meanwhile, the Project to Complete the Frontage Road along both sides of the Hai Van Tunnel South Bypass must be coordinated with the Hoa Lien – Tuy Loan Expressway Project. “In many cases, one household has to clear land for two projects, so the clearance needs to be done at once,” said Mr. Vo Nguyen Chuong, Deputy Director of the Department of Natural Resources and Environment of Da Nang City.

In September 2023, the People's Committee of Da Nang City had a policy to implement the Project to Complete the frontage road along both sides of the Hai Van Tunnel South Bypass, but it was not until January 2024 that the project land plot was available to implement the preparation of compensation records. On December 14, 2023, the People's Council of Da Nang City issued Resolution No. 95/NQ-HDND on accepting the policy of converting the purpose of forest use to other purposes for this project in Hoa Son and Hoa Nhon communes and Resolution No. 93/NQ-HDND approving the list of works and projects to convert the purpose of rice-growing land, protective forest land, and special-use forest land in 2024 of Da Nang City.

“Therefore, the Project Compensation, Support and Resettlement Council will receive documents from May 2023, but in reality, it will not be until early 2024 that there is enough legal basis to implement the compensation and land recovery work of the Project,” Mr. Chuong stated the reality.

Da Nang is also facing difficulties due to the large volume of clearance documents, both implementing the Hoa Lien - Tuy Loan Expressway Project and the Project to Complete the Frontage Road along both sides of the Hai Van Tunnel South Bypass, amounting to nearly 2,000 documents. Meanwhile, one clearance document must be processed twice due to providing land plots at two different times. Therefore, the site clearance work encounters many obstacles.

According to Mr. Chuong, the biggest difficulty is the lack of land for resettlement. There are about 272 files requiring resettlement, with about 792 resettlement plots (630 plots for the Hoa Lien - Tuy Loan Expressway Project and 162 plots for the Completion of the feeder road along both sides of the Hai Van Tunnel South Bypass Project). However, there are still many resettlement plots that do not have actual land, and new resettlement plots are still taking steps to implement.

Therefore, mobilizing households to clear residential land and households with houses is very difficult. According to the Department of Natural Resources and Environment of Da Nang City, Hoa Son commune does not have land for resettlement on the spot, the People's Committee of Da Nang City has a policy of arranging resettlement in neighboring areas. However, most households in Hoa Son commune are Catholics, wishing to be resettled on the spot for convenience in living and religious beliefs.

Resolutely clear the land

Identifying the site clearance work for the Hoa Lien - Tuy Loan Expressway Project as a key, central task requiring the participation of the entire political system, the Standing Committee of the Hoa Vang District Party Committee has focused on leading and directing party committees at all levels, authorities, fronts and socio-political organizations from district to commune to focus on resolutely implementing the site clearance work of the Project.

The Standing Committee of Hoa Vang District Party Committee has established 3 working groups in charge of 3 communes, regularly coordinating, supporting, propagating, and mobilizing people to hand over the remaining documents. Along with that, the District People's Committee has established 3 working groups for site clearance. In 3 communes of Hoa Son, Hoa Lien, Hoa Nhon, each commune also established 1 working group with the Chairman of the Commune People's Committee as the Head and invited the Standing Committee of the Commune Party Committee and departments, branches, and organizations to participate in propagating and mobilizing people to hand over the site.

Hoa Vang District People's Committee focuses on directing the District Land Clearance Board, the Department of Natural Resources and Environment to coordinate with relevant sectors and localities to review, complete documents, conduct legal appraisals, and promptly advise on the issuance of land recovery decisions, decisions approving compensation, support and detailed resettlement to have a basis for receiving people, resolving petitions and providing support within their authority.

"In cases where people have been met many times and policies have been satisfactorily resolved according to regulations, but the policy is still not followed, measures will be taken to enforce land recovery according to regulations," informed the People's Committee of Hoa Vang district.

For issues beyond its authority, the District People's Committee reports to the Da Nang City People's Committee and relevant departments and branches for timely support to speed up the site clearance progress of the Project.
