Among the Decisions regulating the functions, tasks, powers and organizational structure of units under the Ministry issued on the same day, in Decision No. 523 QD-BCT, Minister of Industry and Trade Nguyen Hong Dien regulated the functions, tasks, powers and organizational structure of the Import-Export Department.
About location and function
The Import-Export Department is an organization under the Ministry of Industry and Trade, performing the function of advising and assisting the Minister of Industry and Trade in state management and law enforcement of activities of export and import of goods, border trade, origin of goods, logistics services, temporary import for re-export, temporary export for re-import, border transfer, transit, purchase, sale and processing of goods with foreign countries under the state management scope of the Ministry of Industry and Trade according to the provisions of law and decentralization and authorization of the Minister of Industry and Trade.
The Import-Export Department has legal status, its own seal and account according to the provisions of law. Its operating expenses are provided by the state budget and from other sources according to the provisions of law.

On duties and powers
1. Submit to the Minister for approval, promulgate or submit to competent authorities for approval, promulgate legal documents, projects, strategies, mechanisms, policies on export, import, border trade, origin of goods, logistics services, agents for purchasing, selling, processing goods with foreign countries, temporary import for re-export, temporary export for re-import, border-gate transfer, transit of goods nationwide and services for exporting and importing goods.
2. Organize the implementation of legal documents, strategies, projects, mechanisms, policies on export, import, border trade, origin of goods, logistics services, agents for purchasing, selling, processing goods with foreign countries, temporary import for re-export, temporary export for re-import, border-gate transfer, transit of goods and export and import services after approval or promulgation.
3. Issue, within its authority, professional and technical guidance documents on export and import of goods, border trade, origin of goods, logistics services, agency for purchase, sale, and processing of goods with foreign countries, temporary import for re-export, temporary export for re-import, border-gate transfer, transit of goods and export and import services, separate documents and internal documents in accordance with the provisions of law.

7. Preside over or coordinate with the Ministry of Finance to manage the business activities of duty-free shops in accordance with the provisions of law.
8. Carry out the tasks of the WTO Technical Barriers to Trade Notification and Enquiry Point (abbreviated as TBT Office) of the Ministry of Industry and Trade.
9. Carry out the tasks of the Office of Notification and Enquiry Point on Animal and Plant Quarantine Measures in the WTO (hereinafter referred to as the SPS Office) of the Ministry of Industry and Trade.
10. Advise on state management and monitor the activities of professional associations and unions operating within the assigned industry and field.
11. Organize propaganda, dissemination, training, education, and guidance on legal documents and professional and technical matters on export and import of goods, border trade, origin of goods, logistics services, agents for purchasing, selling, and processing goods with foreign countries, temporary import for re-export, temporary export for re-import, border-gate transfer, and transit of goods, export and import services, in accordance with the provisions of law.
12. Organize research and application of scientific and technological advances in the fields of export and import of goods, border trade, and logistics services as assigned by the Ministry.
13. Synthesize, prepare periodic and ad hoc reports, evaluate the situation of export and import activities, border trade under the authority of the Ministry of Industry and Trade, apply information technology, build a database on export and import activities, international goods purchase and sale activities, and activities of agents buying, selling, processing and transiting goods with foreign countries.
14. Inspect the implementation of legal provisions related to the export and import of goods, border trade, origin of goods, and logistics services under the state management of the Ministry, and resolve complaints and denunciations in accordance with the provisions of law and the Ministry's management decentralization.
15. International cooperation in the fields of export and import of goods, border trade, origin of goods, and logistics services as assigned by the Ministry.
16. Develop and implement the Department's administrative reform program according to the goals and contents of the Ministry's administrative reform program.
17. Manage the organization, staff, civil servants, public employees and workers, implement salary regimes and policies, preferential treatment regimes on emulation, rewards, discipline, training, professional development for civil servants, public employees and workers of the Department according to the provisions of law and the management decentralization of the Ministry.
18. Manage assigned finances and assets, organize implementation of allocated budgets, and other sources of revenue according to law.
19. Perform other tasks assigned by the Minister.
Organizational structure
The apparatus assisting the Director: Office, Policy Synthesis Department; Department of Goods Origin; Department of Import and Export of Commodities, Department of International Trade; Department of Trade Facilitation.
The regional Import-Export Management Departments have the functions and tasks of assisting the Import-Export Department in granting or issuing certificates of origin for exported goods, certificates of export, import, and transit of goods in accordance with the provisions of law, under the authorization of the Minister of Industry and Trade.
The specific tasks of the Regional Import-Export Management Department are determined by the Director of the Import-Export Department; it is allowed to use its own seal and open its own account for transactions in accordance with the law. The establishment, reorganization or dissolution of units under the Department is considered and decided by the Minister of Industry and Trade upon the proposal of the Director.
The Import-Export Department is led by a Director and Deputy Directors. The Director and Deputy Directors are appointed, dismissed, transferred, rotated, rewarded and disciplined by the Minister of Industry and Trade in accordance with the provisions of law.

| Decision No. 523/QD-BCT takes effect from March 1, 2025 and replaces Decision No. 2641/QD-BCT dated December 2, 2022 of the Minister of Industry and Trade stipulating the functions, tasks, powers and organizational structure of the Import-Export Department. The Chief of the Ministry's Office, the Chief Inspector of the Ministry, the Directors of Departments, Directors of Departments and Heads of units under the Ministry are responsible for implementing this Decision. |
