Functions, tasks and organizational structure of the Department of Trade Defense

On February 28, 2025, the Ministry of Industry and Trade issued Decision No. 536/QD-BCT stipulating the functions, tasks, powers and organizational structure of the Trade Defense Department.

Location and function

According to Decision No. 536/QD-BCT, the Trade Defense Department is an organization under the Ministry of Industry and Trade, performing the function of advising and assisting the Minister of Industry and Trade in state management and law enforcement on trade defense, including the fields of anti-dumping, anti-subsidy and self-defense; preventing evasion of trade defense measures; resolving disputes in trade defense cases at international organizations; organizing and managing public service activities in the fields and scope of management of the Department according to the provisions of law and decentralization and authorization of the Minister.

The Trade Defense Department is a trade defense investigation agency. The Trade Defense Department has legal status, its own seal and account as prescribed by law, and its operating expenses are provided by the state budget and other sources as prescribed by the State.

Organizational structure

The organizational structure of the Trade Defense Department includes:

The apparatus assisting the Director: Office; Anti-dumping and Subsidy Investigation Division; Damage and Self-Defense Investigation Division; Foreign Trade Defense Handling Division; Legal Division.

Career organization under the Department: Information and Warning Center. The establishment, reorganization or dissolution of units under the Department shall be considered and decided by the Minister of Industry and Trade upon the proposal of the Director.

Leader of the Trade Defense Department

The Trade Defense Department has a Director and Deputy Directors. The Director and Deputy Directors are appointed, dismissed, transferred, rotated, rewarded, and disciplined by the Minister of Industry and Trade in accordance with the provisions of law.

The Director prescribes the functions, tasks, powers and organizational structure of the units under the Department, promulgates the Regulations on organization and operation of the Department according to the management decentralization of the Ministry of Industry and Trade.

The Director appoints, dismisses, transfers, rotates, rewards, and disciplines department-level or equivalent staff of the Department according to the provisions of law and the decentralization of personnel management of the Ministry of Industry and Trade. The Director is responsible to the Minister of Industry and Trade and before the law for all activities of the Department. The Deputy Director is responsible to the Director and before the law for the assigned work areas.

Decision No. 536/QD-BCT takes effect from March 1, 2025 and replaces Decision No. 2639/QD-BCT dated December 2, 2022 of the Minister of Industry and Trade stipulating the functions, tasks, powers and organizational structure of the Trade Remedies Authority.
