The Government issued Decree 33/2025/ND-CP stipulating the functions, tasks, powers and organizational structure of the Ministry of Construction.
Accordingly, the Ministry of Construction is a Government agency, performing the state management function of: Construction planning, architecture; construction investment activities; urban development; technical infrastructure; housing; real estate market; construction materials; road, railway, inland waterway, maritime, civil aviation transport nationwide; state management of public services in the fields of state management of the Ministry according to the provisions of law.
Duties and powers of the Ministry of Construction
Regarding planning and architecture , the Ministry of Construction organizes the establishment and appraisal of the master plan for the urban and rural system; presides over the establishment and appraisal of the urban and rural planning component in the national master plan, national marine spatial planning, regional planning and other planning according to the provisions of law on planning; promulgates norms, methods of establishment and management of costs for planning activities, establishes regulations on architectural management; develops and organizes the implementation of the Orientation for the development of Vietnamese architecture suitable for each stage, submits it to the Prime Minister for approval and promulgation; guides the establishment of a list and management of valuable architectural works; builds, manages, operates and exploits the planning and architectural database associated with the standardized national geographic database system; promulgates architectural design samples for public works, rural housing and other architectural works according to regulations; Regulations and instructions on organizing competitions for planning ideas, architectural design competitions and managing the practice of urban and rural planning and architectural practice.
Regarding construction investment activities , the Ministry of Construction is responsible for developing, submitting to competent authorities for promulgation or promulgating under its authority mechanisms, policies and regulations on construction investment project preparation, construction survey, construction design, construction, construction supervision, project management, contractor selection, acceptance, handover of works for exploitation and use, warranty and maintenance of construction works and other activities related to construction works; construction activity capacity; foreign contractors operating in construction in Vietnam; information system, national database on construction activities; building and managing information system, national database on construction activities; guidance on the application of building information modeling (BIM) in construction activities; contractor selection in construction activities in accordance with the provisions of the law on construction and the law on bidding; guide and inspect the implementation of legal provisions on contracts in construction activities, investment project contracts under the public-private partnership (PPP) method according to the provisions of law; guide the method of adjusting construction contract prices; publish construction contract templates; guide the establishment and management of costs, methods of determining prices of technical infrastructure services; perform the functions and tasks of investment decision makers and investors for construction investment projects under their authority according to the provisions of law; recognize socio-professional organizations that are qualified to grant practice certificates and certificates of capacity for construction activities; manage codes of practice certificates and certificates of capacity for construction activities; publicly post the list of individuals and organizations granted certificates according to regulations; develop and promulgate sets of questions for examination to grant practice certificates; develop and manage the operation of examination software.
Regarding urban development , the Ministry of Construction is responsible for developing strategies, programs, plans, and important national projects on urban development; indicators on the urban development sector in the task of developing the country's socio-economic situation in each period; developing and submitting to competent authorities for promulgation or promulgating under its authority mechanisms, policies, and regulations on: Managing the urbanization process; managing and investing in the development of urban space (including above-ground and underground space), urban development models; managing plans and programs for upgrading, renovating, and embellishing urban areas, improving the urban resilience to climate change; exploiting, using, and handing over the management of urban areas; a system of criteria and standards for classifying urban areas; establishing and managing costs of utility services in urban areas, costs for establishing and appraising urban development areas, urban development programs, urban classification projects and reports; Guide and inspect the management and use of urban construction land according to approved urban development plans and plans; organize activities to mobilize, promote and coordinate domestic and foreign resources for urban development investment according to the provisions of law and the assignment of the Government; organize the construction, integration, management and exploitation of the national urban data system.
Regarding road, railway, inland waterway, maritime and civil aviation infrastructure, the Ministry of Construction promulgates national technical regulations on transport infrastructure and regulates the management, exploitation and maintenance of transport infrastructure under its authority; performs the tasks and powers of the ministry managing specialized construction works, the competent authority managing investment programs and projects in transport infrastructure construction; announces the list of projects calling for investment capital and forms of investment in transport infrastructure according to the provisions of law; organizes, guides and inspects the management, exploitation and maintenance of transport infrastructure; manages and exploits transport infrastructure assets within the scope of assigned management according to the provisions of law; Submit to the Government and the Prime Minister for decision or decide under authority on the announcement, classification, naming, adjustment, closure, opening, dismantling, putting into operation, stopping, and temporarily suspending the operation of road, railway, inland waterway, maritime, and civil aviation works according to the provisions of law; organize the implementation of registration, issuance of certificates and licenses according to authority and provisions of law.
Regarding housing , the Ministry of Construction is responsible for developing mechanisms, policies and solutions for developing housing types, national target programs with housing support content, public investment programs on housing; organizing and directing the implementation of social housing development programs, national target programs with housing support content; developing the National Housing Development Strategy for each period, determining basic housing development targets in the socio-economic development tasks of each period; organizing implementation after approval by the Prime Minister; regulating the funding level for developing provincial housing development programs and plans; inspecting provincial housing development programs and plans according to regulations.
The Ministry of Construction shall promulgate sample contracts for the purchase, lease, and rental of social housing, resettlement housing, and public housing; sample documents proving the conditions and beneficiaries of social housing support policies; representative owners of public housing and social housing invested with central budget capital; student housing managed by affiliated public educational institutions; promulgate regulations on the management and use of apartment buildings; prescribe framework programs for training and professional development on apartment building management and operation; and publicly disclose the list of units qualified to manage and operate apartment buildings on the Ministry's electronic information portal.
The Ministry of Construction regulates the construction requirements for multi-storey and multi-apartment housing for individuals; inspects the allocation of land funds and the suitability of land fund arrangement for the development of social housing, workers' accommodation in industrial zones, and housing for the people's armed forces in the planning as prescribed; approves or reports to the Prime Minister for decision on the conversion of housing functions as prescribed by law.
Ministry of Construction guides and inspects the implementation of laws on real estate business.
Regarding the real estate market , the Ministry of Construction shall preside over and coordinate with ministries, ministerial-level agencies, and provincial People's Committees to develop projects and policies for development, implementation, and management of real estate business; measures to regulate the real estate market; manage the granting of real estate brokerage practice certificates, manage real estate brokerage activities; establish and organize the operation of real estate trading floors; promulgate a framework program for training and fostering knowledge of real estate brokerage practice, and operate real estate trading floors; and study the model of real estate trading floors managed by the State.
The Ministry of Construction guides and inspects the implementation of laws on real estate business, on the conditions of organizations and individuals when doing real estate business, the conditions of real estate put into business and coordinates with the Provincial People's Committee to organize inspection and review of real estate business activities according to regulations; presides over and coordinates with ministries, ministerial-level agencies, and Provincial People's Committees in building, managing, and operating the national information system on housing and real estate market; connects and shares information from the housing and real estate market database with the national database and other relevant specialized databases according to the provisions of law; builds and publishes real estate market assessment indexes nationwide.
The Ministry of Construction shall appraise or give opinions on the transfer of all or part of real estate projects under the consideration and decision authority of the Prime Minister; shall give opinions on the appraisal of investment policies and adjustment of investment policies for real estate projects in accordance with the provisions of the law on real estate business under the Prime Minister's authority to approve investment policies as prescribed; shall preside over and coordinate with relevant agencies in implementing measures to prevent and combat money laundering in the real estate business sector in accordance with the provisions of law.
Regarding construction materials , the Ministry of Construction organizes the development and submits to competent authorities for promulgation legal documents and policies on the management and development of construction materials; organizes the preparation, appraisal and submission to competent authorities for approval of planning and adjustment of planning for Group II minerals according to the provisions of law on planning and minerals; guides and inspects the implementation of mineral planning after approval by the Prime Minister; guides and inspects the People's Committees of provinces and centrally run cities in the preparation, appraisal, approval and management of the implementation of local construction materials development programs and plans; plans for exploration, exploitation and use of minerals as common construction materials of localities in provincial planning; guides and inspects localities and enterprises in implementing legal provisions on the quality of construction material products and goods.
Regarding means of transport, assemblies, systems, spare parts of means of transport; means and equipment for exploration, exploitation and transportation at sea; means and equipment for loading and unloading and specialized construction; machinery, equipment and materials with strict requirements on safety and labor hygiene in transportation (except for means serving national defense and security purposes and fishing vessels) and specialized technical equipment and devices, the Ministry of Construction regulates the registration and issuance of license plates for railway and inland waterway vehicles and specialized motorbikes participating in traffic; organizes the registration of railway, inland waterway, maritime and civil aviation vehicles according to its authority and provisions of law; regulates the quality of technical safety, environmental protection and labor safety and hygiene for means of transport; means and equipment for exploration, exploitation and transportation at sea.
The Ministry of Construction regulates and guides the implementation of standards, technical regulations, inspection, testing, certification of technical safety and environmental protection quality, management of conformity declaration activities, conformity certification of road motor vehicles, assemblies, systems, spare parts of vehicles; means of transport by railway, inland waterway, maritime, civil aviation; means and equipment for exploration, exploitation, and transportation at sea; specialized loading and unloading and construction means and equipment, specialized works, means and equipment used in transportation and other purposes as prescribed by law.
The Ministry of Construction issues Airworthiness Certificates for aircraft; issues Export Airworthiness Certificates for aircraft, aircraft engines, and aircraft propellers when exported; issues or recognizes Type Certificates for aircraft, aircraft engines, and aircraft propellers when manufactured in Vietnam or imported.
The Ministry of Construction regulates the appraisal of technical designs in the production, assembly, repair, conversion, and import of means of transport; specialized loading and unloading and construction means and equipment; means and equipment for exploration, exploitation, and transportation at sea; and specialized technical equipment and equipment for the transport sector in accordance with the provisions of law.
The Ministry of Construction regulates the training, coaching, testing, granting, recognition, and revocation of licenses, diplomas, and professional certificates for drivers of means of transport, operators of means and specialized equipment in transport (except for the task of testing and granting road motor vehicle driving licenses; drivers of means and specialized equipment serving defense, security, and fishing vessels); inspectors, professional inspection staff, and subjects working specifically in the field of transport under its authority.
The Ministry of Construction guides and inspects the implementation of transport business conditions, mechanisms and policies for transport development.
Regarding road, rail, inland waterway, maritime, civil aviation and multimodal transport , the Ministry of Construction guides and inspects the implementation of transport business conditions, mechanisms and policies for transport development, and transport support services according to Government regulations; develops and promulgates national technical regulations on the field of transport exploitation; announces civil air routes after being permitted by the Prime Minister; announces road, rail, inland waterway, maritime transport routes and public transport networks according to law provisions; guides the implementation of multimodal transport according to Government regulations; organizes the licensing of civil aviation activities; directs and inspects the implementation of regulations on coordination in the management of civil aviation activities; details the management of activities at airports, airfields (excluding flight activities), seaports, dry ports, ports, inland waterway wharves, railway stations and manages railway, inland waterway and maritime transport routes.
Regarding traffic security and safety (except for the task of ensuring aviation security in aircraft and on the ground) , the Ministry of Construction shall preside over or coordinate the implementation of strategies, programs, plans, and overall projects on ensuring traffic safety nationwide after being approved by the Government and the Prime Minister; guide and inspect the implementation of legal provisions on ensuring traffic safety on roads, railways, inland waterways, maritime, and civil aviation within the scope of the Ministry's functions and tasks; promulgate the Civil Aviation Security and Safety Program according to its authority; detail the development, assessment, and approval of ship security plans, seaport security plans, and water area and water region security plans; prescribe the issuance of certificates related to ship security and seaport security; preside over or coordinate the inspection and provision of information on civil aviation and maritime security and safety according to the provisions of law; Organize investigation of incidents, aircraft accidents, maritime accidents according to authority and regulations of law; preside over or coordinate the organization of search and rescue, response to oil spills in road, rail, inland waterway, maritime and civil aviation traffic according to authority.
Organizational structure of the Ministry of Construction
The Ministry of Construction has 23 units, of which 19 are organizations assisting the Minister in performing state management functions, including: 1- Office; 2- Inspectorate; 3- Department of International Cooperation; 4- Department of Legal Affairs; 5- Department of Organization and Personnel; 6- Department of Planning and Finance; 7- Department of Planning and Architecture; 8- Department of Transport and Traffic Safety; 9- Department of Science, Technology, Environment and Construction Materials; 10- Department of Economics - Construction Investment Management; 11- Department of State Appraisal of Construction Quality; 12- Department of Urban Development; 13- Department of Construction Infrastructure; 14- Department of Housing and Real Estate Market Management; 15- Vietnam Road Administration; 16- Vietnam Maritime and Waterways Administration; 17- Vietnam Aviation Administration; 18- Vietnam Railway Administration; 19- Vietnam Register.
The 4 units are public service units serving the state management function of the ministry, including: 1- Information Technology Center; 2- Construction Newspaper; 3- Construction Magazine; 4- Academy of Strategy, training construction staff.
This Decree comes into force from March 1, 2025.
