Commenting on the draft Land Law (amended), National Assembly Chairman Vuong Dinh Hue emphasized the view that there should be a clear distinction between commercial housing, low-cost commercial housing and social housing.

Social housing is a type of housing mainly in the form of rental or hire-purchase, developed by the State through policies and implemented by investors. Low-cost commercial housing is a type of housing that is a cross between commercial housing and social housing for sale to officials, civil servants, public employees, armed forces, etc.

Regarding the issue of using national defense and security land for housing for armed forces, National Assembly Chairman Vuong Dinh Hue proposed summarizing the implementation of Resolution No. 132/2020/QH14 on piloting a number of policies to remove difficulties and backlogs in the management and use of national defense and security land in combination with labor production and economic construction activities.

In that spirit, National Assembly Chairman Vuong Dinh Hue said that the regulations on the use of national defense and security land to build housing for officers and soldiers of the armed forces should be separated, not combined with regulations on social housing projects.

Regarding the management of national defense and security land, National Assembly Chairman Vuong Dinh Hue said that the draft law stipulates that the provincial People's Committees shall preside over and coordinate with the Ministry of National Defense and the Ministry of Public Security to carry out state management of national defense and security land in the locality. However, there are also opinions suggesting that the Ministry of National Defense and the Ministry of Public Security shall preside over and coordinate with the provincial People's Committees to manage state defense and security land. Therefore, National Assembly Chairman Vuong Dinh Hue suggested that opinions focus on further discussion on this content.

According to the report of the Economic Committee, the provisions in the draft Law on Housing (amended) in August 2023 are expanded compared to the provisions in the current Law on Housing and the draft Law on Housing (amended) submitted to the National Assembly at the 5th Session on land access conditions, which is a new policy that is favorable for the implementation of social housing projects and housing for the armed forces.

Accordingly, not only can the existing land use rights be used for all types of land, but it can also be agreed to receive the transfer of land use rights for all types of land to implement social housing projects and housing for the armed forces. Meanwhile, for commercial housing projects, it is only allowed to make agreements to receive the transfer of land use rights and use the existing land use rights for residential land or residential land and other land.
