National Assembly Chairman: Supervision must meet social needs and voters' aspirations

On the morning of October 7, continuing the 38th Session, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Law on Supervisory Activities of the National Assembly and People's Councils.

The draft law consists of 3 articles: Article 1 stipulates amendments and supplements to a number of articles of the Law on Supervisory Activities of the National Assembly and People's Councils (including 60 clauses); Article 2 stipulates amendments and supplements to a number of articles of relevant laws (including 2 clauses); Article 3: stipulates the law's effectiveness.

Presenting the Report on the review of the draft law, Chairman of the National Assembly's Law Committee Hoang Thanh Tung stated that the Law Committee agreed with the necessity of amending and supplementing a number of articles of the Law on Supervisory Activities of the National Assembly and People's Councils; and basically agreed with three viewpoints on law-making.

At the same time, the examining agency proposed to supplement and emphasize the viewpoint that the law only supplements or legalizes contents under the authority of the National Assembly and must be truly necessary, appropriate, and consistent with the structure of the current law; not to include in the law or legalize issues, processes, and procedures under the authority of the National Assembly Standing Committee.

The contents that need flexible regulations to suit practical requirements should be assigned to the National Assembly Standing Committee to regulate; for new policies, there needs to be a full impact assessment, showing effectiveness and suitability before being regulated in law.

Speaking at the session, National Assembly Chairman Tran Thanh Man emphasized that supervision must be accurate, focused, and key to the issues raised by the Party, voters, and people for the National Assembly.

According to the National Assembly Chairman, every year, the National Assembly, the National Assembly Standing Committee, the Nationalities Council and the National Assembly Committees all have supervisory topics. People's Councils at all levels and local National Assembly delegations also supervise the implementation of National Assembly resolutions; the implementation of the Party and State's guidelines, policies and laws. During the term of the 15th National Assembly, supervision work has received great attention.

"Supervision must make the supervised subjects 'convinced' through the Supervision Team pointing out strengths, limitations as well as solutions to implement in the coming time," the National Assembly Chairman stated.

The National Assembly Chairman requested that the draft law be reviewed for its conformity with the Party's guidelines and policies and the State's laws. Supervision by the National Assembly and the People's Councils does not overlap with supervision and inspection by other agencies. The National Assembly's supervisory activities must closely follow and respond to the needs of society, the thoughts, aspirations and wishes of the people and voters, and must be associated with legislative work.

The National Assembly Chairman requested the drafting agency to study, supplement, clarify and perfect the concepts of supreme supervision, thematic supervision, supervision of the National Assembly, supervision of the People's Council, in which, it is necessary to explain clearly, unify the understanding, distinguish so that when promulgated, it is clear that the law has been amended and supplemented in a concise, focused, focused, key, easy to understand, easy to implement and easy to supervise direction. At the same time, fully identify the necessary principles in supervision activities, the issue of voting and vote of confidence as well as the criteria for selecting the content of explanation.

Regarding the scope of amendments, members of the National Assembly Standing Committee requested the drafting agency to closely follow the guiding viewpoints on law-making, especially viewpoints on innovation, to review and legalize the contents appropriately, and at the same time study and amend and supplement the contents that are still problematic, inadequate, and new ideas.../.
