On the afternoon of August 2, at the National Assembly House, National Assembly Chairman Vuong Dinh Hue chaired a meeting to give opinions on the reception, explanation, revision and some major contents of the draft Land Law (amended).

The report of the Appraisal Agency said that, up to now, there are still 12 major contents in the draft Land Law (amended) with different opinions such as: Land classification, planning, land use plans, criteria for land use rights recovery and auction, bidding to select investors to implement commercial housing projects, commercial works, service works, entertainment areas, multi-purpose complexes for socio-economic development for national and public interests.
Besides, there are big issues such as applying the surplus method to value land or allocating at least 10% of the revenue from land use fees and annual land rent of the locality to the Land Development Fund.
At the meeting, Deputy Prime Minister Tran Hong Ha, Minister of Natural Resources and Environment Dang Quoc Khanh, and leaders of the Ministry of Finance informed about the issues raised by the National Assembly Chairman regarding the contents with different opinions between the drafting committee and the agency reviewing the draft Land Law (amended).

National Assembly Chairman Vuong Dinh Hue acknowledged and thanked the delegates for their opinions; highly appreciated the Standing Committee of the Economic Committee for actively and proactively coordinating with the Ministry of Natural Resources and Environment and relevant agencies and organizations in receiving and revising the draft law; and organizing a number of additional workshops in both Hanoi and Ho Chi Minh City.
“Up to this point, after receiving comments from the people and National Assembly deputies at the 5th Session, the quality of the draft law has been improved one step further,” the National Assembly Chairman emphasized.
The National Assembly Chairman noted that, up to now, the draft Land Law (amended) still has issues with different opinions, and solutions must be proposed. Even issues that have been finalized, there are still different opinions. “The remaining issues are all big, difficult, and key issues, requiring the Government and the National Assembly Standing Committee to continue to make tireless efforts to have the best draft law,” the National Assembly Chairman emphasized.
The National Assembly Chairman emphasized the general spirit of closely following and fully institutionalizing the contents of Resolution 18-NQ/TW, dated June 16, 2022 of the 13th Party Central Committee on continuing to innovate and perfect institutions and policies, improving the effectiveness and efficiency of land management and use, creating momentum to turn our country into a high-income developed country. At the same time, it is necessary to closely follow the viewpoints and principles in the concluding notices of the National Assembly Standing Committee to continue perfecting the draft law.

The National Assembly Chairman gave examples of land recovery issues after resettlement arrangements are completed; policies to ensure production land for ethnic minorities but must prevent land transfers after being allocated land for the second time; conditions for transferring rice-growing land with the implication that individuals who are not directly involved in agricultural production when receiving the transfer must establish an economic organization and have a plan to use rice-growing land for the right purpose, limiting speculation and collection of rice-growing land; decentralization to localities to decide on changing the purpose of rice-growing land use on a very cautious basis; issues of land recovery for socio-economic development for national and public interests; must stipulate land prices and methods of calculating land prices in the law; on sea encroachment activities...
The National Assembly Chairman further noted very difficult issues such as: residential land, land lease for housing must be consistent with the Housing Law; one-time payment and annual land collection must ensure feasibility and ensure the financial plan of the Investor; which cases are for bidding, which cases are for auction; the issue of land recovery and continuing to apply the case of agreement; the issue of developing land information database, administrative procedures on land; further research on planning, underground space land use plans, underground works and real estate market development; summarizing the Resolution on piloting a number of policies to remove obstacles and backlogs in the management and use of national defense and security land combined with labor production activities, economic construction, and regulations in the draft law in the direction of assigning the Government to continue to pilot as part of the draft law dossier.
The National Assembly Chairman requested that the draft Land Law (amended) must ensure consistency with other laws in the legal system, especially with the draft laws that the National Assembly is considering and deciding; this law must not be used to replace the functions of other laws.
The National Assembly Chairman requested the Economic Committee to coordinate with the Standing Committee of the Law Committee, the Ministry of Natural Resources and Environment, and relevant agencies to urgently complete the draft law dossier, report on a number of major issues to receive, explain, and revise the draft law, submit it to the Conference of full-time National Assembly deputies scheduled to take place at the end of August, and submit it to the National Assembly Standing Committee for comments before submitting it to the National Assembly for consideration and decision at the 6th Session at the end of this year.
