To handle the overlapping contents of functions and tasks between the National Assembly, the National Assembly Standing Committee and the Government under the direction of the Politburo, ensuring consistency and synchronization with the provisions of the draft Law on Organization of the Government (amended), the Standing Committee of the Committee found that the draft Law amending and supplementing a number of articles of the Law on Organization of the National Assembly has added provisions on the contents that need to be regulated by law.
Regarding decentralization, Mr. Tung stated that the Standing Committee agreed with the content on decentralization in the draft law to institutionalize the conclusion of the Politburo.
Create an important legal basis to "enhance autonomy, proactiveness, creativity, and self-responsibility of agencies, units, and localities, associated with enhancing accountability of leaders and tightly controlling power".
It is recommended that the drafting agency continue to research and perfect the content of the decentralization principle.

Giving his opinion on the discussion, National Assembly Chairman Tran Thanh Man emphasized that amending the Law on Government Organization is to decentralize and delegate more power to the Government, helping the Government proactively solve problems.

He said that the provisions related to decentralization and delegation of power in this law need to be consistent and consistent with related laws such as the Law on Organization of Local Government, the Law on Organization of the National Assembly, the Law on Promulgation of Legal Documents, and a number of laws on management of sectors and fields.

In particular, the basic principles clearly stipulate the relationship between the Government and the National Assembly, the National Assembly Standing Committee, the Central Committee of the Vietnam Fatherland Front and socio-political organizations.
Clearly define the responsibilities and authorities of executive and judicial agencies to ensure proper roles and assignments.
Regarding decentralization and delegation of power, the National Assembly Chairman reiterated General Secretary To Lam's repeated mention of the spirit of "locality decides, locality acts, locality takes responsibility". "From now on, the National Assembly will not manage the public investment portfolio or the money portfolio, but will assign a block to the Government, and the Government will be responsible for allocating it to localities.

He further emphasized the need to improve administrative procedures for smoothness. "It is said that we have actually handed over but the higher-ups are still holding on. We have handed over but if we want to do anything, we still have to go through the higher-ups...", Mr. Man added.
He requested to clarify the response capacity of decentralized agencies and organizations, ensure feasibility, and avoid shirking responsibility.
With the same law, decree, circular, some localities act decisively, without asking for anything from the central government, without saying it is difficult. But some localities keep complaining about the law, decree, circular...
The National Assembly Chairman added that in the future, the commune level will be very strong while many units will be eliminated at the district level.
"Now the district inspectors no longer exist, the district police no longer exist, and there will be many more units in the future.
"Focusing on the commune and decentralizing to the commune must be given utmost attention. In such a commune, whether the resources are guaranteed when decentralizing or delegating authority or not must be given attention," Mr. Man added.
