On October 16, the Standing Committee of Huong Hoa District Party Committee (Quang Tri) confirmed that they had just had a direct meeting with Mr. Tran Binh Thuan, Chairman of the District People's Committee, after the incident of Mr. Thuan signing the decision to re-appoint Ms. Do Uyen Thien Minh, Principal of Xy Kindergarten, for a third term, was published on Tuoi Tre Online.
According to the Standing Committee of Huong Hoa District Party Committee, at this meeting, Mr. Thuan "recognized the problem" and directed the authorities to carry out the transfer with Ms. Minh.
Speaking to Tuoi Tre Online, Mr. Thuan confirmed that he had directed his subordinates to carry out the transfer process with Ms. Minh, principal of Xy Kindergarten. The plan being implemented is that Ms. Minh will be transferred to be the principal of A Doi Kindergarten, a commune near Xy commune.
As reported by Tuoi Tre Online , on August 14, Mr. Thuan signed a decision to re-appoint Ms. Minh for a third term, despite previously receiving a written opinion with content of disagreement from the Huong Hoa District Party Committee.
Mr. Thuan explained that he appointed her for “humanity” as Ms. Minh was only one year away from being eligible to apply for the title of Excellent Teacher. Mr. Thuan also cited Decree 85/2023 on recruitment, use and management of civil servants, which stipulates that principals can be appointed an unlimited number of times.
However, the Quang Tri Department of Home Affairs affirmed that this appointment was wrong, because the clause not limiting the number of appointments included an exclusion in cases where there are other regulations of the Party or specialized laws.
The education sector has issued regulations for preschools attached to Circular No. 52, 2020. This Circular stipulates that a principal working at a public school cannot serve more than two consecutive terms.
“In this case, Circular 52 is the “specialized law” that is included in the exclusion situation in Decree 85. Therefore, this reappointment is wrong,” the leader of the Department of Home Affairs affirmed.
