Anti-smuggling and Counterfeiting:

“Localities should build an effective coordination mechanism between the central government and localities, and between forces in the fight against smuggled and counterfeit goods,” said Deputy Prime Minister and Head of the National Steering Committee 389, Bui Thanh Son, at the first quarter 2025 work conference and upcoming task deployment of the National Steering Committee 389 on the afternoon of April 21.

Crimes and violations of the law on production and trade of counterfeit goods, goods that infringe intellectual property rights, goods that violate product labels, trading in expired goods, goods of unknown origin, smuggled goods, goods without invoices or documents, etc. continue to occur in most key areas of provinces and cities.

The exploitation of e-commerce, shopping on social networking sites, express delivery, post offices , etc. to produce, trade, and transport goods of unknown origin, counterfeit goods, poor quality goods, and goods that infringe intellectual property rights, etc. is on the rise.

Regarding the tricks to bypass the authorities to transport and consume smuggled and counterfeit goods, Chief of Office of the National Steering Committee 389 Le Thanh Hai said that, taking advantage of simple procedures for transit goods, tax exemption for temporarily imported and re-exported goods, and goods sent to bonded warehouses, smugglers have mixed infringing goods with officially imported goods, smuggled them into the Vietnamese market for consumption or falsified their origin to export to third countries.

"On the Vietnam - China border, smuggling activities have emerged, transporting firecrackers, alcohol, tobacco materials, medicinal herbs, foreign currency, and frozen food," Mr. Hai informed.

In the first quarter, units and localities arrested and handled 30,651 cases of violations in trading, transporting prohibited goods, smuggled goods, intellectual property violations...; collected more than 4,616.7 billion VND for the budget.

Hanoi city alone handled 5,503 cases of smuggling, trade fraud, and counterfeit goods, collecting more than 1,273 billion VND for the state budget.

A representative of the Department of Police Investigation of Crimes of Corruption, Economy , and Smuggling added that criminals often take advantage of express delivery services, fast delivery, and openness in import and export to smuggle and illegally transport easily transportable, high-value items such as foreign currency, gold, diamonds, cigarettes, modern medicine, cosmetics, functional foods, etc.

To avoid detection by authorities, smugglers often gather goods in private homes and vacant houses in high-rise apartment buildings, making inspection and control difficult.

Need to overcome overlap in management

It is forecasted that in the second quarter of 2025, smuggling, trade fraud, and transportation of goods with fake Vietnamese origin for export to third countries will increase. Therefore, delegates recommended the early completion of regulations and legal corridors.

Authorities strengthen inter-sectoral coordination to combat smuggling, banned goods, and counterfeit goods at border gates, international railway stations, international airports, etc.; prevent crimes right at border gates.

From a local perspective, Vice Chairman of Hanoi People's Committee Nguyen Manh Quyen suggested that the National Steering Committee 389 soon issue a document guiding the consolidation of the Steering Committee 389 at the provincial and municipal levels in accordance with the arrangement of administrative units, ensuring connectivity and unity.

At the same time, central ministries and branches continue to advise the Government to perfect the legal framework on e-commerce and digital business to improve control efficiency, prevent fraud and budget loss.

In response to recommendations from localities and functional forces, Deputy Prime Minister Bui Thanh Son requested the National Steering Committee 389 to provide synchronous directions and tasks, clearly defining the responsibilities of each unit and force.

To contribute to stabilizing the market, Steering Committee 389 of ministries, branches and localities need to propose appropriate solutions to effectively combat and prevent smuggling, trade fraud and counterfeit goods in their fields and areas of responsibility and management.

In particular, localities and authorities need to promote information exchange and sharing, and coordinate the monitoring of transit shipments, temporary imports, re-exports, conditional business goods, high tax rates, etc.

The Ministry of Justice coordinates with ministries and branches to review regulations and sanctions to amend them in accordance with reality. At the same time, localities need to urgently strengthen the Steering Committee 389, build an effective coordination mechanism between the central government and localities as well as between functional forces in the fight against smuggled and counterfeit goods.
