On April 15, the Ministry of Industry and Trade issued Directive 09/CT-BCT on strengthening state management of inspection and supervision of goods origin in the new situation.
The Directive clearly states that currently, the international trade situation is complicated, rapid, unpredictable, strategic competition is increasingly strong and sensitive, especially when the United States applies reciprocal tariff policies to many countries in the world, including Vietnam.
Furthermore, escalating trade tensions have led to trade fraud, including fraud in the origin of goods, which tends to increase and become more complex in order to avoid sanctions that countries will apply to imported goods.
To proactively adapt to the new situation, with the goal of promoting balanced and sustainable trade, ensuring harmonious interests between Vietnam and countries that have signed Free Trade Agreements (FTAs) with Vietnam, the Minister requested the Import-Export Department to preside over and coordinate with the Legal Department to research and promptly advise competent authorities to amend and supplement legal documents in the field of origin of goods in accordance with the Law on Organization of the Government 2025 and the Law on Organization of Local Government 2025 to organize the implementation of the issuance of certificates of origin (C/O) in the new situation.
The Import-Export Department is also assigned to advise the Minister to issue documents requesting functional ministries, industry associations and manufacturing and exporting enterprises to strengthen management and supervision of input materials for the production of exported goods to meet food hygiene and safety requirements, quality and origin of goods according to the requirements of importing countries and to act as a focal point in coordination with the Customs Department (Ministry of Finance) to take the lead in strengthening the assessment, supervision and inspection of origin of imported goods, especially imported materials used for production and export when carrying out customs procedures according to customs laws.
“The Import-Export Department directs agencies and organizations that issue C/O to strengthen the work of issuing and checking C/O, especially determining the criteria of origin according to specific rules of goods from imported raw materials for export goods, in case of necessity, proposing specific measures to prevent illegal transshipment, combat origin fraud, protect the reputation and interests of Vietnam's export goods,” the directive stated.
In addition, Minister Nguyen Hong Dien assigned the Legal Department to coordinate with the Import-Export Department to review current relevant legal documents to propose the development of a suitable mechanism for granting C/O in the new situation.
Continue to closely coordinate with the Import-Export Department, the Trade Defense Department, and the Customs Department (Ministry of Finance) in monitoring, inspecting, and verifying the origin of imported and exported goods to promptly propose solutions in the new situation.
Regarding the Department of Foreign Market Development, the Minister requested the direction of the Vietnamese Trade Office abroad to research and learn about the mechanisms and regulations on the origin of goods of the host countries, and provide them to the Import-Export Department to complete regulations on the rules of origin of goods, issue C/O, and prevent fraud of origin of goods.
The leaders of the Ministry of Industry and Trade also requested the Department of Domestic Market Management and Development to strengthen market inspection and supervision to detect and handle acts of trading goods, especially smuggled raw materials and goods of unknown origin for export production. If necessary, transfer them to competent authorities for handling to ensure the strictness of the law.
The Directive takes effect from April 15, 2025.
