Can a husband use his wife's ID card to open a bank account?

Therefore, the husband cannot use his wife's Citizen Identification Card (CCCD) to open a bank account.

Reasons why you cannot ask someone else to open a bank account for you:

- Due to bank regulations : Each bank has its own strict regulations to protect personal information. And one of those regulations is that the bank will require you to self-verify your documents and personal information.

- Cardholder facial recognition : When you apply for a card, the bank staff will compare the face on your identification document (such as ID card or citizen ID) with the face of the person applying for the card. If they do not match, they will not agree to make the card.

- Identifying the owner's signature : You need to sign directly so that the bank can keep your signature. This signature will be used for comparison in subsequent transactions. Therefore, others cannot sign for you when opening a card. It is best to open the card yourself to keep your information secure.

More specifically , according to the provisions of Clause 2, Article 2 of Circular 16/2020/TT-NHNN, the application for opening a personal payment account includes:

- Application for opening a payment account made according to the form of the bank or foreign bank branch where the account is opened and in accordance with the provisions of Clause 1, Article 13 of this Circular;

- Identification documents include citizen identification card or valid identity card or passport or birth certificate (for individuals who are Vietnamese citizens under 14 years old and do not have a passport); valid entry visa or documents proving visa exemption (for individuals who are foreigners), except for cases where individuals are foreigners opening payment accounts according to regulations in Clause 4, Article 14 of this Circular;

- In case an individual opens a payment account through a guardian or legal representative (hereinafter referred to as the individual's legal representative), in addition to the documents specified in Points a and b, Clause 1 of this Article, the payment account opening dossier must also include:

+ In case the legal representative is an individual: identification papers of the legal representative of the individual and papers proving that person's legal representative status for the individual opening the payment account;

+ In case the legal representative is a legal entity: Decision on establishment, business license, business registration certificate or other documents as prescribed by law; documents proving the legal representative status of that legal entity for the individual opening the payment account; identity documents and documents proving the representative status of the legal representative of that legal entity.

And according to Clause 5 of this Article, there are regulations on account opening procedures as follows: Banks and foreign bank branches ensure to collect signature samples, digital certificates (if any) of the account owner or legal representative of the account owner and other related persons (if any), seal samples (if any, for the account owner being an organization) for checking and comparison during the use of the payment account.

Therefore, when opening a bank account for an individual, that individual must be the one to carry out the procedure, with a signature sample of the account owner (except in cases where the account is opened through a guardian or legal representative).
