Circular No. 26/2024/TT-BCA of the Ministry of Public Security regulating statistics, synthesis, construction, management, exploitation and use of the Database on road traffic accidents, railway traffic accidents and inland waterway traffic accidents takes effect from August 15, 2024. It clearly stipulates the classification of traffic accidents.
Specifically, Article 5 of the Circular stipulates the classification of traffic accidents as follows: According to the level of consequences of damage to people and property, traffic accidents include traffic accidents causing especially serious consequences, traffic accidents causing very serious consequences, traffic accidents causing serious consequences, traffic accidents causing less serious consequences and traffic collisions.
A traffic accident causing particularly serious consequences falls into one of the following cases:
+ Killing 3 people or more;
+ Causing injury or damage to the health of 3 or more people, with the total body injury rate of these people being 201% or more;
+ Causing property damage from 1,500,000,000 VND or more.
A traffic accident causing very serious consequences falls into one of the following cases:
+ Killed 2 people;
+ Causing injury or damage to the health of 2 or more people, with the total body injury rate of these people from 122% to 200%;
+ Causing property damage from 500,000,000 VND to under 1,500,000,000 VND.
A traffic accident causing serious consequences falls into one of the following cases:
+ Killed 1 person;
+ Causing injury or damage to the health of a person with a bodily injury rate of 61% or more;
+ Causing injury or damage to the health of 2 or more people, with the total body injury rate of these people from 61% to 121%;
+ Causing property damage from 100,000,000 VND to under 500,000,000 VND.
A traffic accident causing less serious consequences falls into one of the following cases:
+ Causing injury or damage to a person's health with a disability rate from 11% to less than 61%;
+ Causing injury or damage to the health of 2 or more people, with the total disability rate of these people from 11% to less than 61%;
+ Causing property damage from 10,000,000 VND to under 100,000,000 VND.
A traffic collision is a traffic accident causing consequences below the level of a traffic accident causing less serious consequences as prescribed above.
In addition, the determination of the percentage of disability of people injured in traffic accidents is carried out according to the provisions of Circular No. 22/2019/TT-BYT dated August 28, 2019 of the Minister of Health regulating the percentage of bodily injury used in forensic examination and forensic psychiatric examination.
Determination of property damage caused by a traffic accident is based on the conclusion of the property damage assessment or the valuation certificate or other valuable documents proving the property damage.
