Increase retirement age of workers

Pursuant to Article 169 of the 2019 Labor Code, employees who ensure the conditions on social insurance payment period as prescribed by the law on social insurance are entitled to receive pension when reaching retirement age.

The retirement age of employees in normal working conditions is adjusted according to the roadmap until reaching 62 years old for male employees in 2028 and 60 years old for female employees in 2035.

From 2021, the retirement age of employees in normal working conditions is 60 years and 3 months for male employees and 55 years and 4 months for female employees; then, each year it increases by 3 months for male employees and 4 months for female employees.

Workers with reduced working capacity; working in particularly arduous, toxic, or dangerous occupations or jobs; working in areas with particularly difficult socio-economic conditions may retire at a lower age, but not more than 05 years lower than the retirement age under normal working conditions at the time of retirement, except in cases where the law provides otherwise.

Workers with high professional and technical qualifications and some special cases may retire at a higher age but not more than 05 years older than the retirement age under normal working conditions at the time of retirement, except where otherwise provided by law.

Thus, the retirement age in 2024 for male workers under normal conditions is 61 years old; for female workers under normal conditions it is 56 years and 4 months (currently, the retirement age under normal conditions for male workers is 60 years and 9 months, and for female workers it is 56 years old).

Employees in the following cases may retire at a lower age but not more than 05 years older than the retirement age under normal working conditions at the time of retirement, except where otherwise provided by law:

- Employees who have worked for 15 years or more in arduous, toxic, dangerous or especially arduous, toxic, dangerous jobs on the list issued by the Ministry of Labor, War Invalids and Social Affairs.

- Employees who have worked for 15 years or more in areas with particularly difficult socio-economic conditions, including working time in areas with regional allowance coefficient of 0.7 or higher before January 1, 2021.

- Workers with reduced working capacity of 61% or more.

- Employees with a total working time of arduous, toxic, dangerous or especially arduous, toxic, dangerous jobs on the list issued by the Ministry of Labor - Invalids and Social Affairs and working time in areas with especially difficult socio-economic conditions, including working time in areas with regional allowance coefficient of 0.7 or higher before January 1, 2021 of 15 years or more.

Conditions for receiving pension in 2024

The increase in the retirement age of employees in 2024 compared to the regulations on retirement age in 2023 leads to changes in the conditions for receiving pensions in 2024 for employees.

Accordingly, based on the provisions of Article 54 of the Law on Social Insurance 2014 (amended by Point a, Clause 1, Article 219 of the Labor Code 2019), under normal working conditions, employees participating in compulsory social insurance are entitled to pension if they fall into one of the following cases:

(1) Case 1:

- When retiring, have 20 years or more of social insurance contributions;

- The retirement age for male workers is 61 years old and the retirement age for female workers is 56 years and 4 months old.

(2) Case 2:

- When retiring, have 20 years or more of social insurance contributions;

- Have at least 15 years of experience in a arduous, toxic, dangerous or especially arduous, toxic, dangerous job listed by the Ministry of Labor, War Invalids and Social Affairs or have at least 15 years of experience in an area with particularly difficult socio-economic conditions, including time spent working in an area with a regional allowance coefficient of 0.7 or higher before January 1, 2021.

- The retirement age for men in 2024 is not lower than 56 years old and the retirement age for women in 2024 is not lower than 51 years and 4 months old, unless otherwise provided by law.

(3) Case 3:

- When retiring, have 20 years or more of social insurance contributions;

- Have 15 years of experience working in underground coal mining.

- The retirement age for men in 2024 is not lower than 51 years old and for women is not lower than 46 years and 4 months old.

(4) Case 4:

- When retiring, have 20 years or more of social insurance contributions;

- People infected with HIV due to occupational accidents while performing assigned tasks.

(5) Case 5: Female workers who are commune-level officials, civil servants or part-time workers in communes, wards or towns who participate in social insurance when they retire and have paid social insurance for 15 to less than 20 years and are 56 years and 4 months old.

Employees participating in voluntary social insurance are entitled to pension when meeting the following conditions:

- The retirement age for male workers in 2024 is 61 years old and the retirement age for female workers is 56 years and 4 months old.

- 20 years or more of social insurance contributions.
