Previously, on February 28, 2025, Quang Tri Newspaper received a petition from Mr. and Mrs. Nguyen Ba Minh, Nguyen Van Khoi, Le Van Tho, Pham Ba Thanh, Ly Van Thong, Nguyen Du Thu, Tran Ngoc Duc, all residing in Hamlet 6, Dien Sanh town, Hai Lang district. The petition stated:
In 1991, households together reclaimed nearly 10 hectares of land around Thanh Dam Lake. After the District People's Committee planned to build the Thanh Dam Lake urban area, they reclaimed 9.2 hectares of land from households and only compensated for assets on the land, not for the land because they were told that the land was managed by the town, so no compensation was given for the land.
At the Thanh Dam Lake urban area project, the land plots of the households adjacent to the land plots of Ms. Hoang Thi Khuynh and Mr. Nguyen Van Khoi, all 3 land plots above are shown in the land register as being managed by the People's Committee of Dien Sanh town. However, Ms. Hoang Thi Khuynh's land plot was compensated for the land, while the land plots of the remaining households were not compensated for the land.
This is shown in Report No. 56/BC-UBND dated June 16, 2020 of the Town People's Committee that Ms. Hoang Thi Khuynh's land is not compensated for land; Report No. 62/BC-PTNMT dated June 24, 2020 of the District Department of Natural Resources and Environment also clearly stated: Hoang Thi Khuynh's land is managed by the Town People's Committee so it is not compensated for land. However, in Report No. 62/BC-UBND dated May 12, 2023 of the People's Committee of Dien Sanh Town, Ms. Hoang Thi Khuynh's land is determined to be compensated for land.
The households said that Report No. 62/BC-UBND dated May 12, 2023 of the People's Committee of Dien Sanh town is contrary to Report No. 56/BC-UBND dated June 16, 2020 of the People's Committee of the town and Report No. 62/BC-PTNMT dated June 24, 2020 of the District Department of Natural Resources and Environment. The households have repeatedly sent petitions to the authorities of Hai Lang district and the People's Committee of Dien Sanh town but have not been resolved. The households hope that the People's Committee of Hai Lang district will give a clear answer and at the same time request a comprehensive inspection of the Thanh Dam Lake urban area project to ensure citizens' rights.
Based on the citizen's petition, Quang Tri Newspaper sent a document to the People's Committee of Dien Sanh town, Hai Lang district, requesting to resolve the petition of the above-mentioned group of households. On April 4, 2025, Quang Tri Newspaper received document No. 54/UBND-TH of the People's Committee of Dien Sanh town regarding the response to the request to resolve the citizen's petition signed by Chairman of the People's Committee of Dien Sanh town, Le Xuan Truong. The content of the document stated:
On March 13, 2025, Hai Lang District People's Committee issued Official Dispatch No. 22/UBND-KNPA on checking and handling citizens' petitions. On March 14, 2025, Dien Sanh Town People's Committee issued Official Dispatch No. 28/BC-UBND reporting on checking and reviewing the content of citizens' petitions related to land acquisition and clearance work at Thanh Dam Lake urban area. On March 27, 2025, Hai Lang District People's Committee issued Official Dispatch No. 28/UBND-KNPA on responding to the petition of Mr. Nguyen Ba Minh's group of households, residing in Dien Sanh Town.
In Official Dispatch No. 28/BC-UBND dated March 14, 2025 of the People's Committee of Dien Sanh town and Official Dispatch No. 28/UBND-KNPA dated March 27, 2025 of the People's Committee of Hai Lang district, both affirmed: Based on the cadastral records kept at the People's Committee of the town through the periods, the opinions of Hai Lang town officials currently working at the Dien Sanh town agency and the land lease request document of the group of households, the People's Committee of Dien Sanh town confirmed the origin of the above land plot of the group of households that was lent by the People's Committee of Hai Lang town to grow forestry trees; from 2000 to present, the group of households has grown hybrid acacia and yellow cajuput trees.
Specifically, in 2000, Mr. Nguyen Ba Minh's group of households was approved by the People's Committee of Hai Lang town to borrow land for forestry planting. At the same time, in the cooperative's land lease application (for a period of 20 years, the People's Committee of the town signed and confirmed on January 20, 2000) and in the application, Mr. Nguyen Ba Minh's group of households committed to reclaiming the land when the town had a planning plan and was approved by the Chairman of the People's Committee of the town to borrow 5.0 hectares for forestry planting.
On September 14, 2023, the People's Committee of Dien Sanh town issued Notice No. 106/TB-UBND to the group of households of Mr. Nguyen Ba Minh (representative of the Forestry Tree Planting Cooperative Group) requesting the group of households to return the land borrowed for forestry tree planting. However, up to now, Mr. Nguyen Ba Minh's group of households has not returned the land according to the group of households' land loan papers.
According to the provisions of Clause 2, Article 82 of the 2013 Land Law and Clause 2, Article 18 of Decision No. 26/2021/QD-UBND dated October 27, 2021 of the People's Committee of Quang Tri province, the land area recovered from Mr. Nguyen Ba Minh's group of households and the 2 plots of land (plot No. 51 and plot No. 152/1) that Mr. Nguyen Van Khoi reported were managed by the Town People's Committee, so they are not eligible for land compensation. For the above plots of land, Mr. Nguyen Ba Minh's group of households has received compensation and support for assets on the land.
Regarding the origin and time of land use of Ms. Hoang Thi Khuynh at plot No. 50/2 and plot No. 50/3, map sheet No. 06 of the infrastructure project of Thanh Dam Lake urban area, the Town People's Committee has implemented the steps according to the process and reached a consensus to confirm: The origin of these two plots of land is that Ms. Khuynh received the transfer from Ms. Bui Thi Ngoan and her husband Nguyen Dai Duong living in the town to reclaim and cultivate before 2002; the time of transfer was 2002 and Ms. Khuynh's family has been using the land since then.
During the land use process, Ms. Hoang Thi Khuynh's family used the two plots of land 50/2 and 50/3 stably, continuously, and without any disputes. Based on the above information and data and comparing with the provisions of Clause 2, Article 77 of the 2013 Land Law, the plots of land 50/2 and 50/3, map sheet No. 6 of Ms. Hoang Thi Khuynh's family are eligible for land compensation.
In case Mr. Nguyen Ba Minh's group of households believes that the confirmation of the People's Committee of Dien Sanh town and the agencies and units that reported is not in accordance with regulations, affecting the rights of the group members, they have the right to make complaints, denunciations, recommendations, and reflections in accordance with regulations or file an administrative lawsuit in court in accordance with the provisions of the Law on Administrative Procedures.
Quang Tri Newspaper welcomes the People's Committee of Dien Sanh town and the People's Committee of Hai Lang district for promptly receiving information, actively checking, verifying, handling the petition according to legal regulations and informing citizens clearly.
