The Government seeks comments on draft decrees related to the Law on Real Estate Business and the Law on Housing

On March 28, 2023, at the 6th Session, the 15th National Assembly passed the Law on Real Estate Business with 10 chapters and 83 articles (referred to as the Law on Real Estate Business 2023). In this Law, the National Assembly assigned the Government to detail a number of contents to ensure the basis for the implementation of the Law on Real Estate Business.

The Draft Decree detailing a number of articles of the Law on Real Estate Business consists of 7 chapters and 37 articles. The chapters include: General provisions; Trading in existing real estate and trading in future real estate; Procedures for transferring real estate projects; Real estate business contracts; Real estate service business; Regulation of the real estate market; Implementation provisions.

The Draft Decree detailing a number of Articles of the Law on Real Estate Business on the construction and management of information systems and databases on housing and real estate markets consists of 4 chapters and 27 articles including: General provisions; Contents of the database on housing and real estate markets; Construction, management, operation, publication and exploitation of information systems on housing and real estate markets; Organization of implementation.

The Draft Decree detailing a number of articles of the Housing Law on the development and management of social housing consists of 7 chapters and 78 articles, including: General provisions, Stages of investment projects in the construction of social housing and housing for the people's armed forces; On social housing; On workers' accommodation; On housing for the people's armed forces; Implementation organization; Implementation provisions.

The promulgation of the Decree detailing a number of articles of the Housing Law on renovation and reconstruction of apartment buildings includes 8 chapters and 48 articles, including: General provisions; Investment stages in construction of apartment building renovation and reconstruction projects; Relocation, forced relocation and temporary accommodation arrangement; Compensation, support, resettlement; Implementation of apartment building renovation and reconstruction projects in the case of consolidation; Incentive mechanisms for apartment building renovation and reconstruction projects; Contribution of funds to rebuild apartment buildings; Implementation provisions.

The Draft Decree detailing a number of articles of the Housing Law consists of 12 chapters and 95 articles, including: General provisions; Provisions on housing ownership; Specific provisions on provincial-level housing development programs and plans; Phases of housing construction investment projects; Development and management of public housing; Development of housing for resettlement, development of multi-storey housing, multi-apartment housing; Capital mobilization for housing development; Conversion of housing functions; Management and use of housing belonging to public assets; Classification of apartment buildings; Management and use of apartment buildings; Implementation provisions.

At the meeting, ministries, branches, provincial People's Committees, and Business Associations had many comments on the draft of the above decrees. Some delegates contributed their opinions such as considering and regulating criteria on the time of enterprise establishment to determine "newly established enterprises" on that basis, determining the owner's equity according to the actual contributed charter capital according to the provisions of law; considering regulations on "small-scale real estate business" so that localities have a basis for implementation. Many phrases were proposed, considered, and amended by delegates to make the meaning clearer. Regulations on capital mobilization in the implementation of housing projects, urban areas, etc.

Concluding the conference, Deputy Prime Minister Tran Hong Ha assessed that the comments on the documents were of high quality, profound and effective. The Deputy Prime Minister requested the drafting agencies to seriously and fully absorb the opinions of the delegates to complete the contents of the draft Decree on time and in accordance with regulations.

Ministries, branches, central and local agencies actively coordinate with the Ministry of Construction to research and review documents and continue to make in-depth contributions to draft written decrees and send them to the Ministry of Construction.
