On January 7, Prime Minister Pham Minh Chinh chaired the Government's special meeting on law-making in January 2025 to discuss and give opinions on 7 contents including laws and resolutions of the National Assembly, many of which are related to perfecting the law, in sync with the arrangement of the apparatus organization.
According to the agenda of the meeting, the Government reviewed and commented on: Draft Law on Government Organization (amended); Draft Law on Organization of Local Government (amended); Law on Promulgation of Legal Documents (amended); Law on Participation in United Nations Peacekeeping Forces; Resolution of the National Assembly on the establishment of a number of Ministries of the 15th Government, term 2021-2026; Resolution of the National Assembly on the structure of the number of Government members for the 16th National Assembly; Resolution of the National Assembly resolving issues arising in legal provisions related to the arrangement of the apparatus.
Speaking at the meeting, Prime Minister Pham Minh Chinh emphasized that this is the first specialized meeting on law-making in 2025 to implement the policy of building and perfecting institutions as one of the three strategic breakthroughs. This is a "breakthrough of breakthroughs", institutions are the resources and driving force for development, but the current institutions are also "bottlenecks of bottlenecks". Therefore, we must focus on all three important strategic breakthroughs, which have been identified from the recent Party Congresses and the 14th Party Congress next year will still identify the same; with the spirit of "open policies, smooth infrastructure, smart management" to unleash all social resources for investment in national development, for the country to rise up in the new era of rich, civilized and prosperous development.
Prime Minister Pham Minh Chinh stated that this session discussed 7 draft laws and very important resolutions related to the issue of organization, promptly institutionalizing the Party's policies and guidelines on innovating the organization of the Government and local authorities to ensure "Straighten-Strong-Efficient-Effective-Effective", promoting the prescribed efficiency. With the spirit of strong innovation, organizing from top to bottom and bottom to top, "The Central sets an example, the locality responds", with the spirit of "running and lining up at the same time", not to interrupt work, the new organizational model must be better, more effective, the people will enjoy more of this achievement.
The Prime Minister stated that this work is very difficult, from now until the Central Committee meeting and the National Assembly meeting next February, to completely resolve the issue related to the organization of the apparatus in the political system; therefore, it must be very urgent.
The Prime Minister requested that Ministers and Heads of sectors directly direct the work of building institutions; innovate thinking in building laws related to organizations with a practical spirit, enhance the responsibility of implementation at all levels, avoid cumbersome procedures, resolutely cut all unnecessary procedures, both manage in an open manner and unblock resources, strengthen decentralization, delegation, and authorization, along with resource allocation, authority goes hand in hand with responsibility; whoever is assigned to decentralize, delegate, or authorize must decide, and when deciding, must be responsible; levels that are decentralized, delegated, or authorized are responsible before the Government and the law for the implementation of decentralized, delegated, or authorized powers.
The powers of the Government and local authorities are concentrated in the Law on Organization of the Government and the Law on Organization of Local Authorities, not scattered, fragmented, or dispersed in specialized laws. There must be a mechanism to control power; decentralization and delegation of authority go hand in hand with streamlining the apparatus, streamlining the payroll, digital transformation, applying artificial intelligence (AI), reducing input costs, and building digital data to have AI commensurate with the work of agencies, units, and localities.
Research on decentralized agencies that are not further decentralized but must be authorized; authority must go hand in hand with responsibility; abandon the mindset of "if you can't manage, then ban, if you don't know, then manage"; thoroughly grasp the mindset of whoever does the best job, then hand it over. People and businesses that can do it, or can do it better, then hand it over. What is prohibited should be put into law, what is not prohibited should be left to people and businesses to be creative, innovative and allowed to do; institutionalize the contents stated in Resolution 27 of the Central Committee on continuing to build and perfect the socialist rule of law state in the new period; promptly resolve issues that arise, sudden and unexpected issues; handle contradictory, overlapping and inappropriate regulations.
Prime Minister Pham Minh Chinh said that the current situation is changing very quickly, so the thinking of making laws must be simple, fast, timely, applicable to life, not prolonged, cumbersome, not losing opportunities, trust, resources; making laws must be easy to understand, easy to remember, easy to do, easy to check, easy to monitor. What is ripe, clear, proven to be correct in practice, effectively implemented, and agreed by the majority, then legalize; what is still fluctuating, we design to have a wide path to adjust according to the requirements of reality. There are things to make a framework, on that basis, operate within the framework. The process of doing is to do and perfect, gradually expanding with the spirit of not being perfectionist, not being hasty.
Emphasizing that there is a lot of content, little time, high requirements, wide scope, sensitive, difficult and complicated content, the Prime Minister therefore requested that members of the Government focus their intelligence, research, listen to reports, speak briefly and concisely, go straight to the core issues, focus on discussing issues with different opinions, issues that can fluctuate and change, especially issues that are currently stuck at all levels and sectors. We must also ensure the progress and quality of the meeting.
The Prime Minister highly appreciated the Ministry of Home Affairs for "working day and night" with very difficult tasks that have long been stuck, related to streamlining and reorganizing the apparatus, especially the three Decrees 177, 178 and 179/2024/ND-CP, which basically create consensus in society, among cadres, civil servants and public employees. We need to continue to listen to what is unreasonable and reflect it accurately, in accordance with procedures and regulations. Through the recent implementation, a number of mechanisms and policies need to be reviewed and anything that has not been fully covered, is still omitted or overlapped should be reflected.
The Ministry of Home Affairs is finalizing documents for ministries and branches that do not need to merge or consolidate to report to competent authorities so that on that basis, it can continue to streamline the internal apparatus, re-define functions, tasks, and powers without overlap or omission; assign one task to only one person, one person to do many tasks. On that basis, review the functions, tasks, and powers of ministries and branches. The Prime Minister requested that the Ministers and Heads of branches directly do this work promptly, with quality, and support the Ministry of Home Affairs in doing this work; must study and propose to ensure the best possible conditions, without perfectionism or haste.
For issues with different opinions, continue to listen and discuss to create a high level of consensus, first of all in the Government, encourage discussion to find the best solution, once a decision is made, "just say one word, not a second word". In discussion, encourage the promotion of democracy, once a decision is made, it must be implemented according to the principle of democratic centralism, the minority obeys the majority, the lower level obeys the higher level, the individual obeys the collective. It is necessary to promote this spirit because this is the leadership principle of the Party.
The Prime Minister stated that, up to now, we are satisfied with the results achieved, especially the three decrees; the organization and internal apparatus have basically been arranged according to the direction of the Central Steering Committee and the Government; some ministries and sectors have not been streamlined according to the set goals, and need to continue reviewing the goals to ensure real and substantial streamlining, and to perfect the functions and tasks. Whatever is done first, do not let it stagnate or prolong, except for ministries and sectors that require the opinions of the Central Committee and the National Assembly.
