At the thematic meeting on law-making in April 2025 (Session 2), the Government resolved on the following draft laws:
Draft Law amending and supplementing a number of articles of the Law on Planning
The Government basically agrees with the draft Law amending and supplementing a number of articles of the Law on Planning submitted by the Ministry of Finance in Submission No. 141/TTr-BTC dated April 13, 2025. The Ministry of Finance is assigned to preside over and coordinate with relevant ministries and agencies to study and absorb the maximum opinions of Government members; closely coordinate with National Assembly agencies in the process of examining and submitting to the National Assembly and the National Assembly Standing Committee for consideration and approval of the draft Law, ensuring the following requirements:
Study to promote maximum decentralization, delegation of authority and allocation of resources along with supervision and inspection; thoroughly reduce and simplify administrative procedures according to Resolution No. 66/NQ-CP of the Government on the Program to reduce and simplify administrative procedures related to production and business activities in 2025 and 2026, without lobbying, asking - giving, specifically: (i) Decentralize to the People's Committees, Chairmen of the People's Committees of provinces and centrally run cities the authority to establish, adjust, supplement planning and organize planning implementation; (ii) Decentralize from the Prime Minister to the Minister to establish the National Planning Appraisal Council, regional planning; (iii) Assign the authority with the authority to approve the planning to be proactive and self-responsible in deciding to establish the planning appraisal council and determine the composition of the appraisal council to ensure strictness, efficiency and suitability with the nature and scope of the planning.
Review the list of specialized technical planning types; study the consolidation of some plans that are overlapping and overlapping (such as: inter-provincial river basin master planning and irrigation planning; dike planning and flood prevention planning of diked rivers...); supplement open regulations to allow the Government to supplement the list of specialized technical planning types in addition to the list prescribed in the Law on Planning to meet the requirements of state management and socio-economic development.
The Minister of Finance is assigned to, on behalf of the Prime Minister, report to the National Assembly and the National Assembly Standing Committee on the draft Law amending and supplementing a number of articles of the Law on Planning; promptly report to the Government and the Prime Minister in accordance with the Law on Promulgation of Legal Documents. The Government assigns Deputy Prime Minister Nguyen Chi Dung to direct the revision and completion of the draft Law.
Draft Law amending and supplementing a number of articles of the Law on Enterprises
The Government assigned the Ministry of Finance to preside over and coordinate with relevant ministries and agencies to study and absorb as much as possible the opinions of Government members and opinions at the Government meeting, promptly complete the draft Law dossier, ensuring the following requirements: Fully and promptly institutionalize the Party's guidelines and viewpoints on enterprise development and innovation; resolve difficulties, inadequacies, and limitations of current regulations; create conditions for enterprises to develop, increase participation in the global supply chain, be proactive and pioneer in research, transfer of science and technology, innovation, and promote the rapid, strong, and sustainable development of our country's economy.
Fully review the recommendations of the Financial Action Task Force (FATF), on that basis, evaluate and correctly identify the requirements, to internalize and supplement regulations on beneficial owners, ensuring proper and full implementation of Vietnam's commitments to the FATF.
The Ministry of Finance is responsible for the content of the acceptance and completion of the draft Law; on that basis, the Minister of Finance is assigned, under the authorization of the Prime Minister, to sign on behalf of the Government the Government's Submission on the draft Law amending and supplementing a number of articles of the Law on Enterprises, to submit to the National Assembly and the National Assembly Standing Committee according to regulations; to proactively report and explain during the process of examining and accepting the opinions of the National Assembly Standing Committee on the draft Law. The Government assigned Deputy Prime Minister Nguyen Chi Dung to direct the revision and completion of this draft Law.
Draft Law on State Budget (amended)
The Government requests the Ministry of Finance to urgently complete the draft Law on State Budget (amended), ensuring: The leading role of the central budget and the initiative of local budgets; prioritizing development investment expenditures; reviewing to have appropriate regulations on the central budget supporting localities to implement investment in works and projects; using local budgets to invest in works and projects under the expenditure tasks of the central budget; studying to increase the level of state budget reserve allocation.
Review and revise the draft Law to ensure consistency and synchronization with relevant laws in the legal system (such as the Law on Public Investment, the Law on Fees and Charges, the Law on Promulgation of Legal Documents, etc.). The Ministry of Finance is responsible for the content of the acceptance and completion of the draft Law; on that basis, assign the Minister of Finance, authorized by the Prime Minister, to sign on behalf of the Government the Submission of the draft Law on State Budget (amended), submit it to the National Assembly Standing Committee and the National Assembly as prescribed; proactively report and explain to the National Assembly, the National Assembly Standing Committee and the National Assembly agencies as prescribed. The Government assigned Deputy Prime Minister Ho Duc Phoc to direct the revision and completion of this draft Law.
Draft Law amending and supplementing a number of articles of the Law on Bidding, the Law on Investment under the public-private partnership model, the Customs Law, the Law on Export Tax and Import Tax, the Investment Law, the Law on Public Investment, and the Law on Management and Use of Public Assets
The Government assigned the Ministry of Finance to preside over and coordinate with relevant ministries and agencies to study and absorb the opinions of Government members and opinions at the Government meeting, ensuring a number of requirements: Review and study additional provisions in the draft Law on Bidding that investors decide and are responsible for bidding or designating contractors to select contractors, while the process and procedures must be quick and not cumbersome as in current regulations; the establishment and composition of the Appraisal Council need to be studied to be more concise, not too cumbersome, and time-consuming.
Carefully review the contents that need transitional provisions in the draft Law to ensure compliance with the provisions of the Law on Promulgation of Legal Documents, avoiding creating legal gaps after this Law comes into effect. The Government assigned Deputy Prime Minister Ho Duc Phoc to direct the revision and completion of this Law project.
Draft Law amending and supplementing a number of articles of the Law on Credit Institutions
The Government assigned the State Bank of Vietnam to preside over and closely coordinate with the Ministry of Justice, relevant ministries, agencies and agencies of the National Assembly in the process of examining and submitting the draft Law to the National Assembly and the National Assembly Standing Committee for consideration and approval, ensuring the requirements: Promoting maximum decentralization, delegation of authority and allocation of resources along with supervision and inspection; thoroughly cutting and simplifying administrative procedures according to Resolution No. 66/NQ-CP, not allowing lobbying, begging - giving; removing difficulties and obstacles in handling bad debts and banking activities, speeding up the progress of handling bad debts and ensuring the safety of the system of credit institutions, national financial and monetary security, creating conditions to support businesses and people in developing production and business, stabilizing the macro-economy, promoting economic growth, ensuring major balances of the economy.
Complete regulations on seizure of secured assets to ensure the legitimate rights and interests of relevant entities; carefully review the contents that require transitional provisions in the draft Law to ensure compliance with the provisions of the Law on Promulgation of Legal Documents, avoiding creating legal gaps after this Law comes into effect.
Assign the Governor of the State Bank of Vietnam, authorized by the Prime Minister, to report on behalf of the Government to the National Assembly and the National Assembly Standing Committee on the draft Law amending and supplementing a number of articles of the Law on Credit Institutions; promptly report to the Government and the Prime Minister in accordance with the provisions of the Law on Promulgation of Legal Documents. The Government assigns Deputy Prime Minister Ho Duc Phoc to direct the revision and completion of this draft Law.
