Embezzled company money for gambling, sentenced to 8 years in prison

Defendant Pham Minh Tuan was sentenced to 8 years in prison.

Tuan and Mr. Tran Minh Dat (born in 1987) have been working together since 2018 at the Hue Branch of TK Distribution Joint Stock Company (address: Tan Phong Ward, District 7, Ho Chi Minh City), specializing in trading food products.

In April 2022, TK Company signed a distribution contract with Moc Tra Company (Dong Ba Ward, Hue City). After purchasing goods under the contract, Moc Tra Company transferred money to Mr. Dat's account 10 times; of which, 9 times Mr. Dat transferred it back to TK Company.

On the 10th time, on July 18, 2022, due to being busy with work, Mr. Dat could not transfer money to TK Company. Therefore, Mr. Dat transferred the entire amount of 1.875 billion VND to Tuan's account to ask him to deposit it into the company's account.

After receiving the money, on July 22, 2022, Tuan only transferred 900 million VND to TK Company's account. Tuan used the rest for online gambling.

In addition to appropriating the above amount of money for personal purposes, Tuan also provided information that TK Company had a promotional policy when buying wine products so that customers could place orders. Trusting them, some customers agreed to buy wine, but Tuan asked them to transfer money to him and then appropriated a total of more than 70 million VND.

After deliberation, the Trial Panel sentenced defendant Pham Minh Tuan to 7 years in prison for the crime of "Abuse of trust to appropriate property" and 1 year in prison for the crime of "Fraudulent appropriation of property", for a total of 8 years in prison.
