The Directive states: Implementing the Resolution of the 13th National Party Congress, the Socio-Economic Development Plan of the country for the period 2021-2025, the Resolutions of the National Assembly and the Resolution of the Government, the Working Program of the Central Steering Committee on corruption prevention and control, and annual negative practices; based on the provisions of the law on inspection, every year, the Government Inspectorate presides over and coordinates with ministries, branches and localities to develop and submit to the Prime Minister for approval the Inspection Program Orientation and implementation instructions, in which, the Government Inspectorate and inspection agencies have paid attention to inspecting and examining public service activities, focusing on the performance of assigned duties and tasks of agencies, organizations, units and cadres, civil servants and public employees.
In addition, heads of state management agencies at all levels have paid attention to the inspection and supervision of public service activities. Through inspection, examination and supervision of public service activities, inspection agencies and heads of management agencies have detected and handled violations of the law, corruption and negativity in public service activities, and at the same time, implemented measures to rectify public service activities and improve policies and laws in the inspected fields.
However, the work of inspection, examination and supervision of public service activities still has limitations. Many agencies and units have not yet conducted inspection, examination and supervision of public service activities to detect, rectify and handle in a timely manner in order to tighten discipline in the performance of public service. Recently, there has been a situation where a number of cadres, civil servants and public employees have avoided and pushed away work; are afraid of making mistakes and being responsible; do not dare to advise, propose work handling, and do not decide to handle work within their authority. This situation leads to a prolonged work handling process, causing waste of time, resources and development opportunities, reducing the effectiveness and efficiency of state management, and hindering the direction and administration of authorities at all levels for the socio-economic development of the country.
Timely handling of violations of public ethics
To overcome the above situation, in order to enhance the responsibility in performing public duties of cadres, civil servants and public employees in state agencies, public service units and state-owned enterprises; it is necessary to strengthen the inspection, examination and supervision of public service activities. The Prime Minister requests Ministers, Heads of ministerial-level agencies, Heads of Government agencies, Chairmen of People's Committees of provinces and centrally-run cities and Heads of state administrative agencies at all levels to effectively implement the Government's Resolutions and directions of the Prime Minister, especially Official Dispatch No. 280/CD-TTg dated April 19, 2023 of the Prime Minister on rectifying and enhancing responsibility in handling work of ministries, branches and localities, Official Dispatch No. 968/CD-TTg dated October 16, 2023 of the Prime Minister on continuing to rectify and strengthen discipline and order in state administrative agencies at all levels; Regularly organize inspections, checks, and supervision of the performance of assigned tasks and powers of agencies, organizations, and individuals under management, especially the performance of tasks and powers related to handling work and administrative procedures for people and businesses, and the implementation of ethical standards, codes of conduct, internal rules, and working regulations of agencies and units.
The Prime Minister requests that during the inspection and supervision process, if violations are detected, apply or recommend competent state agencies to apply handling measures according to the provisions of law to prevent, correct and promptly handle violations of the law and violations of public ethics; if necessary, request or suggest competent agencies to conduct inspections; if signs of crime are detected, recommend competent agencies to clarify and strictly handle according to the provisions of law.
Strengthening post-inspection processing
The Inspector General of the Government, Ministers, Heads of ministerial-level agencies, Heads of Government agencies, Chairmen of People's Committees of provinces and centrally run cities shall thoroughly grasp and closely direct the inspection work within the scope of assigned state management in accordance with the provisions of the 2022 Inspection Law and Decree No. 43/2023/ND-CP dated June 30, 2023 of the Government detailing a number of articles and guiding the implementation of the Inspection Law. Every year, when developing an inspection plan, it must include the inspection of public service activities.
Heads of inspection agencies shall strengthen management and direction of the implementation of inspections of public service activities in accordance with the provisions of law on inspection. At the same time, strengthen post-inspection handling, monitoring, urging, and checking the implementation of inspection conclusions; promptly handle responsibilities for agencies, organizations, units, and cadres, civil servants, and public employees who violate the law in the performance of public duties.
Supervise recruitment, appointment and disciplinary action of staff
The Prime Minister requested the Minister of Home Affairs to review and advise on the completion of legal regulations related to public service activities, especially the assessment and comments on the completion of assigned duties and tasks of state agencies and cadres, civil servants and public employees; at the same time, to strengthen the direction, guidance, implementation of inspection, examination and supervision of the implementation of recruitment, appointment, training, fostering, transfer, rotation, secondment, dismissal, commendation and disciplinary action against cadres, civil servants and public employees who have violated the performance of public duties.
The Minister of Information and Communications guides and directs press agencies and mass media to increase information and propaganda on public service activities and the results of inspection, examination and supervision of public service activities; in which, pay attention to propaganda and praise of advanced models with achievements in public service activities, individuals who dare to think, dare to do, have breakthroughs, contribute to improving the effectiveness of socio-economic development, at the same time, detect, give comments and criticize individuals who lack responsibility, cause obstacles, difficulties and troubles for people and businesses or have illegal, corrupt and negative behaviors.
The Prime Minister requested the National Assembly Standing Committee, the Nationalities Council and Committees of the National Assembly, People's Councils at all levels, the Central Committee of the Vietnam Fatherland Front, socio-political and socio-professional organizations, the business community and the people to strengthen supervision of public service activities of agencies, organizations, units and cadres, civil servants and public employees.
