Prime Minister rectifies land use rights auction work
Prime Minister Pham Minh Chinh has just signed and issued Official Dispatch No. 82/CD-TTg dated August 21, 2024, directing relevant agencies to promptly rectify the work of auctioning land use rights.
The telegram sent to the Ministers of Natural Resources and Environment, Construction, Finance, Justice, Public Security; Chairmen of People's Committees of provinces and centrally-run cities clearly stated:
Recently, the Government and the Prime Minister have directed and issued documents detailing the implementation of the 2024 Land Law, which will take effect from August 1, 2024, including regulations on land use rights auctions. A number of localities have successfully organized land use rights auctions, contributing to supplementing local budget revenues. However, some cases where the winning auction price is many times higher than the starting price (some cases are unusually high as reported by the media) are attracting great attention from public opinion, which may impact socio-economic development, the investment and business environment, and the housing and real estate markets.
To improve the effectiveness and efficiency of land management, improve the real estate market, and promote socio-economic development, the Prime Minister requests:
1. The Chairman of the People's Committee of the provinces and centrally-run cities shall direct the relevant agencies and units to review the organization of land use rights auctions in the area to ensure compliance with the law, publicity and transparency; promptly detect and strictly handle violations of legal regulations in land use rights auctions, and prevent acts of taking advantage of land use rights auctions for personal gain and disrupting the market.
2. The Minister of Natural Resources and Environment shall preside over and coordinate with the Ministers of the Ministries of Justice, Finance, Construction and the Chairmen of the People's Committees of provinces and centrally-run cities to urgently review and inspect the organization of land use rights auctions in cases showing signs of abnormality, handle according to their authority violations of legal provisions on land use rights auctions, promptly detect shortcomings in legal provisions to advise and propose competent authorities to amend, adjust and supplement, prevent profiteering, and at the same time handle and propose solutions to strictly handle acts of taking advantage of land use rights auctions to disrupt the market and report to the Prime Minister before August 30, 2024.
3. The Minister of Construction shall preside over and coordinate with the Ministry of Natural Resources and Environment and the People's Committees of provinces and centrally-run cities to study and specifically assess the impacts of the recent land use rights auction results, especially cases with unusually high auction results, many times higher than the starting price, on the land and housing price level, on the housing and real estate market (supply and demand), proactively regulate and resolve according to authority and have effective solutions or propose solutions to limit negative impacts (if any), and report to the Prime Minister.
4. The competent authorities direct units and localities to strengthen their grasp of the situation, promptly detect, prevent and strictly handle violations of legal regulations in the auction of land use rights, especially acts of collusion to manipulate the market, inflate prices to create an unhealthy market, not true to reality for profit.
5. Ministers of the Ministries of Natural Resources and Environment, Construction, and Finance shall urgently guide and organize training for localities on new policies of the Land Law, Housing Law, Real Estate Business Law and tasks directed by the Prime Minister in Official Dispatch No. 79/CD-TTg dated August 13, 2024.
6. Assign Deputy Prime Minister Tran Hong Ha to directly monitor and direct the implementation of this Official Dispatch.
7. The Government Office regularly monitors the situation and promptly reports to the Prime Minister and Deputy Prime Minister in charge on urgent and arising issues.
Hanoi inspects all land auctions in Thanh Oai and Hoai Duc districts.
The Hanoi People's Committee has just issued a document directing the inspection, detection and handling of violations of the law related to the unusually high auction results of land use rights in Thanh Oai and Hoai Duc districts.
The document clearly states that recently, in the city, there has been a phenomenon of land use rights auctions with winning prices many times higher than the starting price, such as in Thanh Oai district, 7-8 times higher, and in Hoai Duc district, the highest price is 18 times higher.
The above unusually high winning bids may affect socio-economic development, investment and business environment, housing and real estate markets.
In order to effectively implement state management, ensure the auction of land use rights in accordance with the law, and contribute to stabilizing socio-economic development, the Hanoi People's Committee requests the Department of Natural Resources and Environment to immediately coordinate with relevant departments and branches to inspect all land auctions in Thanh Oai and Hoai Duc districts in the recent past, promptly detect and resolutely handle any violations of the law (if any).
The Hanoi Department of Natural Resources and Environment will coordinate with the departments of Justice, Finance, Inspection, and Public Security to review the procedures, processes, and regulations on land use rights auctions in districts. Thereby, it will report to the Hanoi People's Committee to direct the implementation of measures to ensure the organization of land use rights auctions strictly in accordance with the law.
The Hanoi People's Committee also requested the People's Committees of districts to review all land use rights auctions in the area to ensure compliance with legal regulations; report to the City People's Committee any difficulties and problems beyond their authority.
Hanoi will have more than 8,000 social housing units.
The Hanoi People's Committee has just approved detailed updates on 6 social housing projects, 121 commercial projects and new urban areas in Hanoi for the 2021-2025 period (Phase 3).
This is a list of housing and urban area construction investment projects in the city's housing development plans.
Accordingly, of the 6 social housing projects, there are 3 projects in Long Bien, including: Hoan Kiem District resettlement housing area in Viet Hung urban area with an area of over 5 hectares, total investment of over 3,700 billion VND with 3,505 apartments. Expected to be completed in 2026.
Social housing project at land plot CT in planning block CT1 belongs to the project to invest in building technical infrastructure of the land auctioned for land use rights in Long Bien ward, Long Bien district with 290 apartments, built on an area of 0.47ha, total investment of 300 billion VND). Proposed completion time from quarter II/2025-IV/2028.
The social housing project in planning block C14/NO1, Phuc Dong ward has an area of nearly 3.7 hectares with 1,220 apartments, total investment of 1,000 billion VND. Expected to be completed in the fourth quarter of 2025-fourth quarter of 2029.
There is also a housing area for sale to low-income people of Ba Dinh District Police in Xu Dong Bao Van, Ngoc Ha Ward (Ba Dinh District) with 77 apartments. Proposed completion in 2026.
Social housing for sale to officers and soldiers of the Ministry of Public Security in Thuong village, Thanh Liet commune (Thanh Tri district) with 660 apartments. Expected to be completed in 2028.
The social housing project in Bac Phu Cat residential area in Thach Hoa Commune (Thach That District) has an area of about 3 hectares, with nearly 2,600 apartments.
In the updated list of commercial housing and urban area construction investment projects (phase 3), there are 121 projects. Of these, 10 projects are under implementation and are expected to be completed in the 2021-2025 period. There are 26 projects expected to be completed after 2025. The remaining 85 projects are projects under implementation and are preparing for investment.
The City People's Committee assigned the Department of Planning and Investment and the Department of Natural Resources and Environment to proactively review, advise, propose, and report to the City People's Committee for consideration and settlement according to regulations for projects that are allowed to continue implementation or are not eligible to continue implementation (no extension of project implementation progress, no extension of land use/land lease period, projects subject to termination of operations according to regulations of the law on investment, or cases where projects are subject to land recovery due to violations of land law)...
Only case is granted red book for household
Households are no longer granted household red books, except for one case according to Article 4 of the 2024 Land Law.
According to Clause 25, Article 3 of the 2024 Land Law, land-using households are those who have marital, blood, or foster relationships according to the provisions of the law on marriage and family, are living together, and have the right to use common land at the time the State allocates land, leases land, recognizes land use rights, or receives land use rights transfer before the effective date of the 2024 Land Law.
Article 4 of the 2024 Land Law, households are no longer subjects of land use rights. Therefore, red books will no longer be issued to households. However, one case that is still granted a red book to households is the case where the land under the household's right of use is determined before August 1, 2024.
Accordingly, in this case, a red book will be issued with the full names of members sharing the household's land use rights. According to Article 259 of the 2024 Land Law, the household's land use rights are as follows: Participating in legal relations on land as a group of land users with the same rights and obligations as individual land users.
When land is allocated or leased to implement an approved compensation, support and resettlement plan, it is necessary to specifically record the individuals who are members of a household with shared land use rights in the land allocation or lease decision.
Households that have been allocated land by the State without collecting land use fees or with collecting land use fees, or leased land before August 1, 2024, may continue to use the land for the remaining land use term. When the land use term expires, it will be extended in the form of land allocation or lease to individuals who are members of that household.
