In order to improve the effectiveness of state management of land in the province, since 2024, the Department of Natural Resources and Environment (now the Department of Agriculture and Environment) has issued many documents urging and guiding districts and cities to carry out land registration, prepare land allocation records, and issue land use right certificates for cultural houses and sports grounds in the province. However, the process of implementing the issuance of land use right certificates at cultural houses and sports grounds at the village and commune levels has encountered many difficulties and obstacles.
Mr. Ta Quoc Vinh, Deputy Director of the Provincial Land Registration Office, Department of Agriculture and Environment, said: According to Instruction No. 115 dated September 21, 2022 of the Department of Culture, Sports and Tourism on implementing the criteria of "cultural facilities"; "cultural" criteria in building new rural areas, advanced new rural areas, and new model new rural areas in Lang Son province in the period of 2022-2025, village cultural houses have a minimum construction area of 200 m2 for communes in area I. However, in reality, many village cultural houses have been built and put into use for a long time, the land area according to the current usage status is less than 200 m2. At the same time, the district authorities and People's Committees of some communes and towns have not closely directed the work of preparing land allocation records and granting land use right certificates for cultural and sports institutions; Many land plots have not been updated by the district People's Committee on the current status of the land plots into the district's land use planning and plans as a basis for land allocation and issuance of land use certificates according to regulations.
By the end of March 2025, the whole province had only 36/110 commune-level cultural houses granted land use right certificates by competent authorities, reaching 32.7%; 415/1,712 village cultural houses granted land use right certificates, reaching 24.2%; 12/157 commune-level sports fields granted land use right certificates, reaching 7.64%; 180/994 village sports fields granted land use right certificates, reaching 18.1%. |
In addition, in some areas of cultural houses and sports fields, households donated land for construction and put into use a long time ago, but there are no documents or papers on the donation of land use rights of households and individuals; land change registration procedures have not been carried out, and land use certificates have not been revoked according to regulations, making it difficult to prepare land records...

Loc Binh is one of the districts with a low rate of communal and village-level sports grounds and sports fields granted land use right certificates. Mr. Vi Van Thang, Head of the District Department of Agriculture and Environment, said: With the function of advising the District People's Committee in state management of land, since 2021, the department has advised the District People's Committee to issue documents directing and guiding the People's Committees of communes, towns, and organizations assigned land by the State to register land and issue land use right certificates for public land plots; guiding the People's Committees of communes to prepare land allocation dossiers and issue land use right certificates for communal and village-level sports grounds and sports fields in the area. However, the People's Committees of communes and towns have not been proactive in implementing this. This is also due to difficulties in site clearance and land recovery from households and individuals who donate land and voluntarily return land. In addition, the coordination in measuring and preparing land allocation records for granting land use right certificates between relevant agencies and commune-level People's Committees is not yet tight. Therefore, up to now, the whole district has only 20/201 village cultural houses granted land use right certificates; 2/11 commune cultural houses granted land use right certificates; 22/22 commune sports grounds, 110/110 village sports grounds have not been granted land use right certificates according to regulations.
Similar to Loc Binh, Cao Loc is also a district with a low rate of communal and village cultural houses and sports grounds granted land use right certificates. According to statistics, Cao Loc district has 7 communal cultural houses, 174 village cultural houses, 12 communal sports grounds and 36 village sports grounds. However, up to now, the whole district has only 23/174 village cultural houses and 1/12 communal sports grounds granted land use right certificates by competent authorities according to regulations.
Ms. Hoang Hai Yen, Party Secretary and Chairman of the People's Committee of Hoa Cu Commune, Cao Loc District, said: Currently, only 4/5 village cultural houses and 2/5 village sports grounds have completed their dossiers to submit to competent authorities for issuance of land use right certificates according to regulations. The remaining cultural houses and sports grounds have not completed their dossiers to request land use right certificates because the land plots are not in accordance with the approved land use planning. In addition, some village cultural houses were built by households who donated land for construction a long time ago but have not completed the donation procedures. When the People's Committee of the commune prepares dossiers to request land use right certificates according to regulations, it is necessary to consult all members of the household, while many members work far away and are not present in the locality. This also causes difficulties in completing dossiers to obtain land use right certificates for village cultural houses in the area.
In the coming time, the Land Registration Office will continue to advise the Department of Agriculture and Environment to coordinate with the Department of Culture, Sports and Tourism, the People's Committees of districts and cities to advise the Provincial People's Committee to review, update and supplement the planning and land use plans for unsuitable land plots, ensuring the conditions for land allocation and granting of land use right certificates; urge land-using units to prepare land allocation records and grant of land use right certificates according to regulations. At the same time, it is recommended that the People's Committees of districts and cities base on the regulations on land use norms and instructions on implementing the criteria of "cultural facilities"; the criteria of "culture" in building new rural areas, advanced new rural areas, and new model new rural areas to re-determine land use needs, thereby propagating and mobilizing people to create land funds to build cultural houses in villages to ensure the minimum scale and area according to regulations.
