In what cases are traffic police required to stop vehicles?
According to Article 16 of Circular 32/2023/TT-BCA, Traffic Police (TS) when conducting patrol and control tasks according to plan are allowed to stop vehicles for control in the following 4 cases:
- Directly detect or through professional means and equipment detect and collect traffic violations and other violations.
- Implement orders and plans for general traffic control to ensure order, traffic safety, and social order; patrol, control, and violation handling plans according to the topics issued by competent authorities.
- There is a written request from the Head, Deputy Head of the investigation agency; Relevant authorities to stop vehicles to control and ensure security and order; Fight against crime; prevent and combat natural disasters, fires and explosions; Prevent and combat epidemics; Rescue and other violations.
- There are reports, reflections, recommendations and denunciations from people about illegal acts of people and vehicles.
Thus, in case of directly detecting violations or receiving reports or reflections on violations by people and vehicles, performing general inspection tasks... the traffic police have the right to request to stop the vehicle for inspection.
Can traffic police check goods on vehicles?
At point c, clause 2, Article 12 of Circular 32/2023/TT-BCA, the content of inspection of goods on vehicles by traffic police is regulated as follows:
“ Patrolling and control content
2. Control content
b) Control traffic conditions of vehicles.
Conduct inspections in order from front to back, from left to right, from outside to inside, from top to bottom, including the following contents: Shape, external dimensions, paint color, license plates on the front, back and both sides of the vehicle; technical safety and environmental protection conditions of road motor vehicles and specialized motorbikes according to regulations.
c) Control compliance with regulations of law on road transport safety.
Control the legality of goods, types, weight, quantity, specifications, and dimensions. Actual objects and number of people transported compared to permitted regulations and safety measures in road transport.
d) Control other relevant content according to the provisions of law ”.
Thus, from September 15, 2023, the effective date of Circular 32/2023/TT-BCA, traffic police are authorized to inspect goods on vehicles, including:
- Legality of goods, type, volume, quantity, specifications, size.
- Objects.
- Actual number of people carried compared to permitted number of people and safety measures in road transport.
