On January 7, the Ho Chi Minh City People's Court opened the first instance trial of the inheritance dispute; requesting the cancellation of a separate decision and claiming a house for temporary residence related to the inheritance of Mr. Vo Van Ngoan (aka the late artist Vu Linh), between the plaintiff, Ms. Vo Thi Hong Nhung (younger sister of Meritorious Artist Vu Linh) and the defendant, Ms. Vo Thi Hong Loan (daughter of Meritorious Artist Vu Linh).
Ms. Hong Nhung presented a lawsuit request, including: requesting the court to declare the birth certificate and adoption certificate between Mr. Vo Van Ngoan and Ms. Hong Loan null and void; determining that Mr. Ngoan has no first-line heir; requesting the defendant to leave house number 5 Doan Thi Diem (Phu Nhuan district, Ho Chi Minh City), and hand over the house and car documents to the plaintiff.
Hong Loan presented a counterclaim, not accepting all of the plaintiff's lawsuit requests. The defendant is the first heir and has submitted to the court all documents confirming that she is the legitimate child of Meritorious Artist Vu Linh. Ms. Loan filed a counterclaim, requesting Ms. Nhung and Ms. Le Thi Hong Phuong to move all of their assets out of house number 5 Doan Thi Diem.
Hong Loan confirmed that she is a legitimate child.
During the interrogation, the lawyer protecting the legal rights and interests of Ms. Hong Nhung asked Ms. Hong Loan about the process of living together between Ms. Loan and Meritorious Artist Vu Linh, as well as whether Ms. Loan was the biological or adopted child of Meritorious Artist Vu Linh. In response to the lawyer's question, Ms. Loan said: "I am my father's child. The birth certificate does not state whether I am an adopted or biological child. My father never said I was an adopted child."
Ms. Hong Loan added that when she was 3 months old, Mr. Tran Quoc Thanh took her to his grandmother's house (Meritorious Artist Vu Linh's mother) to raise her. Because Meritorious Artist Vu Linh was often away from home performing, Ms. Loan was taken care of by Mr. Thanh and the maid. During their time together, there were no conflicts between her and Meritorious Artist Vu Linh. At the age of 17, Ms. Loan got married and moved to live with her husband, occasionally visiting Meritorious Artist Vu Linh.
In this dispute, Hong Loan is the defendant.
Regarding the funeral of Meritorious Artist Vu Linh, Ms. Loan said that when Meritorious Artist Vu Linh fell ill and then passed away in March 2023, she and her family organized and took care of the funeral. However, because she was so sad at that time, she did not remember exactly how much money she contributed to the funeral. Regarding the construction of the tomb, Ms. Loan did not know because she did not have the right to participate.
When asked why she had to declare her inheritance, Ms. Loan said that this arose after Meritorious Artist Vu Linh passed away, Hong Phuong went to the media and confirmed that Ms. Loan was her adopted daughter. At the same time, in a family meeting, Ms. Nhung and Ms. Phuong requested to be joint owners of Meritorious Artist Vu Linh's house.
Ms. Hong Nhung said that the birth certificate is illegal.
Next, the lawyer asked Ms. Hong Nhung about the process of adopting Ms. Hong Loan. Ms. Nhung explained that in 1987, Mr. Thanh brought Ms. Loan home to raise. After Ms. Nhung's mother passed away, she and other family members took care of Hong Loan.
Regarding the adoption papers and birth certificates showing that Meritorious Artist Vu Linh recognized Hong Loan as his child, Ms. Nhung affirmed: "My brother never did any paperwork for Ms. Hong Loan. The paperwork was done on Saturdays and Sundays... my brother is an artist, he sings two shows on the weekends, he is very busy so he cannot do the paperwork. Ms. Loan's birth and adoption certificates are not legal so there is no first-line heir."
Ms. Hong Nhung answers lawyer's questions at the trial
At the same time, Ms. Nhung added that Meritorious Artist Vu Linh had told her about Ms. Loan making him sad. Ms. Nhung felt very sorry for him so she stepped in many times to mend the relationship between Meritorious Artist Vu Linh and Ms. Loan.
Regarding the reason she filed a lawsuit, requesting to divide the inheritance right after Meritorious Artist Vu Linh passed away, Ms. Nhung said that her family had taken care of Ms. Loan for many years, but Ms. Loan's behavior was very cruel, she chased her family out of the house, so she had to seek legal protection.
At the trial, Ms. Le Thi Hong Phuong stated that she did not request to divide the inheritance of house number 5 Doan Thi Diem because when he was still alive, Meritorious Artist Vu Linh had told her about this house and asked her to come and live there.
Hong Phuong also believes that birth certificates and adoption certificates are illegal.
"In 2017, my uncle got sick and told many people to tell me this house. In 2021, my uncle asked me to record a clip of the house and I made a record. After my uncle passed away, my family met to discuss so that everyone could live together in the house, but on April 27, 2024, Ms. Loan presented the house transfer papers and asked me and my mother to leave the house," Hong Phuong explained.
Ms. Phuong also said that the birth certificates and adoption papers were illegal. Regarding the media response that Meritorious Artist Vu Linh did not have a biological child, Ms. Phuong said that because Ms. Loan stood in front of the press and said that she was the biological child, she had to make a correction to avoid affecting Meritorious Artist Vu Linh's reputation.
The court is continuing its deliberations.
