The work of building the Law on Forces Participating in Protecting Security and Order at the Grassroots Level is to institutionalize the Party's viewpoints and policies on building and consolidating the movement of the entire people to protect security, order and social safety at the grassroots level; adjusting the functions, tasks, regimes and policies for the forces participating in protecting security and order at the grassroots level in conjunction with consolidating the force, streamlining focal points, reducing state budget expenditures, strengthening security, order and safety work at the grassroots level; concretizing the provisions of the 2013 Constitution on ensuring human rights, civil rights and obligations to participate in protecting national security, order and social safety.
This is a draft law of important significance in building and consolidating forces participating in protecting security and order at the grassroots level; creating a unified legal basis, improving the quality of state management of security and order, effectively serving the work of ensuring security and order at the grassroots level.
Delegate Nguyen Van Thuan, National Assembly Delegation of Ninh Thuan province, spoke at the National Assembly.
Up to now, based on the opinions of the National Assembly deputies at the 10th session of the 14th National Assembly. The direction of the Politburo, agencies and organizations, the Government has studied, absorbed, explained and completed the draft law dossier to submit to the National Assembly. Delegate Nguyen Van Thuan basically agreed with the content of Submission No. 51/TTr-CP dated February 28, 2023 of the Government and the review of the National Defense and Security Committee on the draft law.
In order to complete the draft law, delegate Nguyen Van Thuan proposed to clarify some of the following specific contents: In the current situation of complex security and social order, with increasingly sophisticated crimes, the coordination of mass forces with regular forces in protecting security and order is necessary and urgent. In addition, in order to ensure the rights of grassroots forces and mobilize the strength of the entire population to participate in protecting national security, the promulgation of the Law on Forces Participating in Protecting Security and Order at the Grassroots Level is necessary. However, in the entire content of the Law, it is necessary to identify that this force is only a support force for the regular Commune Police in performing the task of protecting security and order at the grassroots level, not the main force. Therefore, the provisions on support policies in the draft Law need to be consistent with the nature of this force.
Regarding Article 4 of the Draft, regulations on the selection and use of forces participating in protecting security and order at the grassroots level. It is proposed to study and stipulate the maximum age of forces participating in protecting security and order at the grassroots level, in order to ensure sufficient health to perform tasks and renew the personnel of those participating in the force. It is proposed to stipulate the maximum age of this force is 65 years old.
At point d, clause 2, Article 20 of the draft Law stipulates compensation and support for forces participating in protecting security and order at the grassroots level. When performing tasks far from the place of residence, without conditions; going back and forth every day, they will be arranged a place to stay, guaranteed means, travel expenses or paid for train or bus fare for one round trip, and supported with food at the level decided by the Provincial People's Council. However: I find the above issue: not suitable for the force operating at the grassroots level. Because the force operating at the grassroots level is mainly in the Village, Hamlet; Commune, Ward, etc. where people live and work there. Therefore, I: Suggest studying and re-regulating this content in a direction that is suitable for the reality and functions and tasks of this force, mainly supporting the resolution of on-site problems at the grassroots level, is it necessary to mobilize this force to resolve complex problems far from the place of residence?
In addition, delegate Nguyen Van Thuan also proposed to review the expenditure tasks of the Ministry of Public Security (Article 22 of the draft Law) and the expenditure tasks of the local budget (Article 23 of the draft Law) to avoid overlap and facilitate the process of law enforcement. At the same time, consider transferring the expenditure task at Point c, Clause 1, Article 23 of the draft Law (Purchasing uniforms, badges, insignia, signs, and certificates of the Forces participating in protecting security and order at the grassroots level) to the expenditure task for the Ministry of Public Security to create unity in the force nationwide and limit the purchase and sale of uniforms, badges, insignia, signs, and certificates of this force in the market.
According to Report No. 145/BC-CP dated April 26, 2023, accepting and explaining the opinions of the National Assembly Standing Committee on the draft law on forces participating in protecting security and order at the grassroots level, the government affirmed that it would not increase budget expenditures after the consolidation of forces and positions into one force. The calculations and explanations are mainly based on actual expenditures of localities in the past time. Delegates noted that the draft Law stipulates many expenditure contents; therefore, in the process of implementing the Law, there needs to be supervision and inspection by competent authorities to ensure relative fairness between localities and ensure a reasonable total expenditure within the balance of the State budget and local budgets.
