Do a good job of prevention
On the morning of November 21, the National Assembly discussed in the hall the work reports of the Supreme People's Court and the Supreme People's Procuracy; crime prevention and control and law violations; judgment enforcement; and corruption prevention and control in 2023.
Speaking, National Assembly Deputy Tran Cong Phan - Vice President, General Secretary of the Vietnam Lawyers Association, delegate of Binh Duong delegation expressed his agreement with the reports of the Government, judicial agencies, especially the verification report of the National Assembly's Judicial Committee, which clearly stated the achieved and unachieved issues and recommendations for good implementation in the coming time.
Through the reports, delegate Tran Cong Phan recognized the great efforts of the judicial agencies, most of the targets were achieved and exceeded the targets assigned by the National Assembly.
“The quality of investigation, prosecution, and trial has all been improved, prosecuting and trying the right people for the right crimes and there have been no cases of wrongly convicting innocent people,” Mr. Tran Cong Phan stated, emphasizing that these are very encouraging indicators, demonstrating great efforts by judicial agencies in 2023.

Delegate Tran Cong Phan said that the results were achieved under conditions of inadequate staffing and funding, and a lot of work pressure.
Although the judicial agencies have achieved many positive results in the fight against crime, crime is still increasing. Therefore, agreeing with the report of the Judicial Committee, the delegate suggested that more attention should be paid to prevention work, focusing on fundamental research on the causes and conditions leading to crime in order to do a good job of prevention.
“This is not the responsibility of only law enforcement agencies and judicial agencies, but the responsibility of the whole society and all agencies,” delegate Tran Cong Phan expressed, saying that there are two types of phenomena: “positive” and “negative”. If we reduce the negative, we can directly attack the negative, but there are measures that we must increase the positive, from economic and social measures... to increase the positive, then we will reduce the negative, not just focus on reducing the negative.
"Therefore, I suggest that we pay close attention to this and it is time to organize fundamental research on the causes and conditions leading to crime in order to do a good job of prevention," Mr. Tran Cong Phan emphasized.
Considering that there are still some agencies that have not coordinated well, delegate Tran Cong Phan suggested that law enforcement agencies in the fight against crime need to: "Further strengthen coordination to do the right thing, find the truth, not coordinate so that we agree to do the wrong thing. Because crime only has "guilty" or "not guilty" and "what crime?". Therefore, agencies must persuade and coordinate with each other to find the truth: what crime is it? or not. Although coordination is based on the functions and tasks of the agencies, it must be further strengthened."
In reality, prosecutors, investigators, and judges do not apply the law consistently in many cases. Therefore, the delegate suggested that the solution should be to increase guidance and explanation so that when applying the law, there is a unified opinion.
Realizing that agencies such as the Court and the Procuracy have very special characteristics, delegate Tran Cong Phan expressed that providing funding, staffing, and equipment similar to administrative agencies would be very difficult.
Therefore, the delegates suggested that the National Assembly and the Government pay attention to the judicial agencies in general and the Procuracy and the Court in particular in allocating funds, staffing, and equipment commensurate with the assigned tasks. Because the tasks are increasing and the pressure is getting higher, it is necessary to supplement them appropriately.
Limiting the conditions that give rise to crime
Delegate Ho Thi Kim Ngan (Bac Kan National Assembly delegation) agreed and highly agreed with the contents assessed in the reports of the Government, Chief Justice of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy, and the inspection report of the Judiciary Committee.
The basic reports reflected and analyzed the advantages, difficulties, challenges and newly arising issues that need to be resolved, clearly stating the results achieved according to the targets assigned by the National Assembly, the limitations, difficulties, causes and proposing solutions to overcome them in the coming time.

However, the delegate pointed out that in 2023, the number of violations of social order increased, and the number of deaths, injuries, and property damage increased. Complex crimes returned, such as intentional injury, child abuse, especially murder due to conflicts, debt conflicts, land and property disputes, and some cases were committed by mentally ill people and drug addicts.
The female delegate said that currently, with the development of media and social networks, the level of information dissemination has changed dramatically. Exploiting the thrilling details of each case to attract viewers has created negative impacts, affecting the perception and behavior of people accessing information.
Therefore, it is recommended that the Government conduct further research, analysis and assessment of the causes of this group of crimes, including analyzing the causes related to education issues, the negative impact of information explosion, and distorted perceptions that need to be analyzed and clarified, and provide fundamental solutions, especially solutions on education to form and nurture human moral character; how to approach and filter information; the responsibility of state agencies in managing activities in cyberspace, etc.
Thereby, improving the effectiveness of social prevention and professional prevention, limiting the conditions for crime and law violations .
