On the morning of November 21st, the National Assembly held a plenary session to discuss the reports on the work of the Supreme People's Court and the Supreme People's Procuracy ; the work of crime prevention and control; the work of enforcement of judgments; and the work of anti-corruption in 2023.

Speaking at the meeting, National Assembly Deputy Tran Cong Phan - Vice Chairman and General Secretary of the Vietnam Lawyers Association, and a representative from Binh Duong province - expressed his agreement with the reports of the Government and judicial agencies, especially the verification report of the National Assembly's Judicial Committee, which clearly outlined the achievements, shortcomings, and recommendations for better implementation in the future.

Based on the reports, delegate Tran Cong Phan noted the tremendous efforts of the judicial agencies, with most targets being met or exceeded the targets set by the National Assembly .

"The quality of investigation, prosecution, and trial has improved, ensuring that the right person is prosecuted and tried for the right crime, and there have been no cases of wrongful convictions of innocent people," Mr. Tran Cong Phan stated, emphasizing that these are very encouraging indicators, reflecting the great efforts of the judicial agencies in 2023.

Representative Tran Cong Phan argued that the achievements were made under conditions of insufficient staffing and funding, and with a lot of work pressure.

Although the judicial authorities have achieved many positive results in combating and preventing crime, crime continues to increase significantly. Therefore, agreeing with the report of the Judicial Committee, the delegates suggested that more attention should be paid to prevention, focusing on fundamental research into the causes and conditions leading to crime in order to improve prevention efforts.

"This is not just the responsibility of law enforcement agencies and judicial bodies, but the responsibility of the entire society, of all agencies," Representative Tran Cong Phan expressed, adding that there are two types of phenomena: "positive" and "negative." While reducing negativity can be achieved by directly attacking it, there are measures we must take to increase positivity, from economic to social measures... increasing positivity will reduce negativity, rather than focusing solely on reducing negativity.

"Therefore, I suggest that we must pay close attention to this and that it is time to conduct thorough research on the causes and conditions leading to crime in order to improve prevention," Mr. Tran Cong Phan emphasized.

Noting that some agencies still lack effective coordination, delegate Tran Cong Phan suggested that law enforcement agencies in the fight against crime should: "Further strengthen coordination to do things right and find the truth, not to agree to wrongdoing. Because criminals are only 'guilty' or 'not guilty' and 'what crime?' Therefore, agencies must persuade and coordinate with each other to find the truth about what crime is guilty or not guilty. Although coordination should be based on the functions and duties of the agencies, it must be further strengthened."

The representative pointed out that in reality, prosecutors, investigators, and judges apply the law inconsistently in many cases. Therefore, the representative suggested that this should be remedied by strengthening guidance and explanations so that when applying the law, there is a unified opinion.

Recognizing the unique nature of institutions like the courts and the procuracy, delegate Tran Cong Phan expressed concern that allocating funding, staffing, and equipment in the same way as administrative agencies would be very difficult.

Therefore, the delegates proposed that the National Assembly and the Government pay attention to the judicial agencies in general, and the Procuracy and the Courts in particular, in allocating funding, personnel, and equipment commensurate with the tasks assigned. Because the tasks are increasing and the pressure is rising, appropriate supplementation is necessary.

Limit the conditions that give rise to crime.

Representative Ho Thi Kim Ngan (from the Bac Kan National Assembly delegation) expressed strong agreement with the contents assessed in the reports of the Government, the Chief Justice of the Supreme People's Court, the Prosecutor General of the Supreme People's Procuracy, and the verification report of the Judicial Committee.

The basic reports reflected and analyzed the advantages, difficulties, challenges, and new issues that had arisen and needed to be addressed, clearly stating the results achieved according to the targets set by the National Assembly, the limitations, difficulties, their causes, and proposing solutions for overcoming them in the future.

However, delegates pointed out that in 2023, the number of social order violations increased, as did the number of deaths and injuries, and property damage. Complex crimes such as intentional injury, child abuse, and especially murders stemming from conflicts, debt disputes, land and property disputes, and some cases committed by mentally ill individuals or drug addicts, also resurfaced.

The female delegate stated that, with the development of media and social networks, the level of information dissemination has changed dramatically. Exploiting sensational details of each case to attract viewers has created negative impacts, affecting the perceptions and behaviors of those accessing the information.

Therefore, it is suggested that the Government should conduct a more in-depth study and analysis of the causes of this type of crime, including an analysis of causes related to education, the negative impact of the information explosion, and distorted perceptions. These need to be analyzed and clarified, and fundamental solutions should be proposed, especially solutions regarding education to shape and nurture human moral character; approaches to information access and filtering; and the responsibility of state agencies in managing activities in cyberspace…

This will improve the effectiveness of social and professional crime prevention, and limit the conditions that give rise to crime and violations of the law .
