Secretary General of the National Assembly Bui Van Cuong has just issued Document No. 4255/TB-TTKQH announcing the Conclusion of the National Assembly Standing Committee on the draft Law on Chemicals (amended).

The National Assembly Standing Committee highly appreciated the preparation process of the draft Law on Chemicals (amended) and the Preliminary Review Report of the Standing Committee of the Science, Technology and Environment Committee.
The National Assembly Standing Committee requested the Government to study and absorb the opinions of the National Assembly Chairman and members of the National Assembly Standing Committee, the Preliminary Review Report of the Standing Committee of the Science, Technology and Environment Committee to complete the draft Law to submit to the National Assembly.
In particular, focusing on a number of issues as follows: First, continue to review and fully institutionalize the Party's viewpoints and policies on the development of the chemical industry, meet the needs of basic production materials of the economy, prioritize resources and have strong enough incentive mechanisms and policies to develop priority areas of the basic industries, including chemicals.
Prioritize the development of basic chemicals, petrochemicals, pharmaceuticals, fertilizers, encourage the development of mechanical and chemical industries and biotechnology to serve agricultural production, agricultural, forestry and fishery processing; study and institutionalize Conclusion No. 36-KL/TW dated June 23, 2022 of the Politburo on ensuring water security and safety of dams and reservoirs by 2030, with a vision to 2045, especially the development and implementation of a roadmap to ban the use of toxic chemicals that pollute water sources and Conclusion No. 81-KL/TW dated June 4, 2024 of the Politburo on continuing to implement Resolution of the 7th Central Committee, Session XI, on proactively responding to climate change, strengthening resource management and environmental protection, especially the requirement to implement green transformation, circular economy, and equitable energy transition.
The draft Law on Chemicals (amended) is a specialized law with many specialized contents. Therefore, to ensure the quality of the draft Law, it is recommended to review and ensure strict implementation of Regulation No. 178-QD/TW dated June 27, 2024 of the Politburo on controlling power, preventing and combating corruption and negativity in law-making work. Continue to study and separate the provisions in the draft Law on the functions and tasks of relevant state management agencies.
Second , continue to review the scope of regulation and applicable subjects to meet the objectives and requirements of amending the Law, not creating legal gaps in the management of chemical activities, ensuring conformity and compatibility with international treaties and conventions on chemicals; fully supplement documents according to the opinions of the examining agency; review concepts and technical terms to fully explain, ensure clarity, ease of understanding, avoid duplication and do not prescribe unnecessary concepts.
Review and resolve conflicts, overlaps and inadequacies with other laws to ensure consistency and unity of the legal system, especially the laws mentioned in the Preliminary Review Report and the attached appendix, including the Law on Promulgation of Legal Documents, Law on International Treaties, Law on Investment, Law on Planning, Law on Construction, Law on Environmental Protection, Law on Pharmacy, Law on Civil Defense, Law on Government Organization, Law on Foreign Trade Management and other relevant laws.
Maximize the content in the draft Law that has been tested and applied stably in practice; review regulations on law application and enforcement provisions to ensure feasibility and avoid problems in application; only include necessary content in the Law, comply with the Law on Promulgation of Legal Documents, ensure consistency in law application and do not stipulate detailed content under the authority of the Government, Ministries and branches that have been stipulated in other laws.
Third , continue to review and perfect regulations on State policies in the chemical sector on the basis of fully specifying the Party's viewpoints and policies; have appropriate, selective, focused and key investment policies to develop the chemical industry. Clarify and separate State preferential policies and State investment policies. Policies need to be practical and fully specified in the draft Law to ensure practicality and feasibility in practice.
Fourth , review, clarify, absorb and supplement the opinions of the examining agencies on the chemical industry development strategy and the responsibility for developing and implementing the chemical industry development strategy, chemical projects, investment incentives for key chemical industry sectors, chemical consulting activities and conditions for chemical consulting, chemical activity management, especially production, export and import of banned chemicals and hazardous chemicals in commodity products, increase sanctions for violations in chemical activity management; chemical safety, state management of chemicals and many other contents stated in the Preliminary Examination Report.
The National Assembly Standing Committee requested the Government to direct the drafting agency and relevant agencies to complete the draft Law dossier no later than September 27, 2024, and send it to the Committee on Science, Technology and Environment for official review and submission to the National Assembly at the 8th Session of the 15th National Assembly.
