According to Nam Dinh province's policy, if the supported person is re-employed in agencies, organizations, or units receiving salaries from the State budget within 60 months from the date of resignation, he/she must return the support amount received.
On February 20, the People's Council of Nam Dinh province announced the Resolution on "Regulations on additional support policies for cadres, civil servants, public employees, and workers in the implementation of organizational restructuring under the management of Nam Dinh province", approved at the meeting held on February 19.
According to the resolution, the subjects of the policy are: Cadres, civil servants, public employees receiving salaries from the State budget, people working under labor contracts in agencies, organizations, units of the Party, State, Vietnam Fatherland Front, socio-political organizations from provincial to district levels in the implementation of organizational restructuring under the management of Nam Dinh province, who are on leave and enjoy the regime and policies according to Decree No. 178/2024.
Including cadres, civil servants, and public employees receiving salaries from the State budget; people working under labor contracts according to the provisions of labor law before January 15, 2019 in administrative agencies, organizations and public service units whose regular expenditures are guaranteed by the State budget and public service units that partially self-guarantee regular expenditures.
Also according to the resolution, in addition to the Government's policies and regimes for cadres, civil servants, public employees, and workers in the implementation of the organizational arrangement of the political system, Nam Dinh province provides one-time additional support for subjects applied in the resolution on retirement (early retirement and resignation) equal to 30% of the allowance that the retiree is entitled to according to the provisions of Clause 1, Article 7, Clause 1, Article 9 and Clause 1, Article 10 of Decree No. 178/2024.
However, according to the resolution, the beneficiaries of additional support “if they are re-employed in agencies, organizations, or units receiving salaries from the State budget within 60 months from the date of implementation of the work according to the decision of the competent authority, they must return the support amount received. The re-hiring agency, organization, or unit is responsible for recovering the entire amount of support and paying it to the State budget according to regulations”.
Regarding funding sources for implementing support policies, the resolution clearly states that for cadres, civil servants and employees in agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, and socio-political organizations at the provincial and district levels: Funding for policy settlement is provided by the provincial budget.
For civil servants receiving salaries from the State budget and employees in public service units whose regular expenditures are guaranteed by the State budget: Funding for policy settlement is provided by the provincial budget.
For civil servants receiving salaries from the State budget and employees in public service units that self-insure a portion of their regular expenses: Funding for policy settlement comes from the unit's revenue from public service activities, State budget allocations and other legal sources. The provincial budget will allocate funding for policy settlement based on the number of employees receiving salaries from the State budget assigned by competent authorities.
Regarding the settlement of regimes and policies for cadres who retire early due to the restructuring and streamlining of the apparatus, as Dai Doan Ket Online reported, on the same morning, the People's Committee of Nam Dinh province announced the decision of the Chairman of the Provincial People's Committee to allow Mr. Do Hai Dien, 54 years old, Director of the Department of Science and Technology of the province to retire early to enjoy the regime according to Decree No. 178/2024 and the policy of Nam Dinh province; the retirement date is from March 1, 2025. Previously, Mr. Do Hai Dien had submitted an application to voluntarily retire early.
Mr. Do Hai Dien is the first department-level leader in Nam Dinh to be allowed to retire early to enjoy benefits under Decree No. 178.
