The notable point is that the decree stipulates the early retirement regime for cadres who do not meet the age requirements for re-election or reappointment, or are still old enough to be re-elected or reappointed but have 30-60 months left to retire, but due to the arrangement of Party committee personnel, they wish to retire and are approved by competent authorities, or cadres under the management of the Politburo or Secretariat are allowed by competent authorities to retire, they will receive pensions and other regimes according to the provisions of the law on social insurance and will not have their pension percentage reduced due to early retirement for a period of 5 years (60 months) or less.

In addition, they are subsidized 5 months of current salary at the time of retirement for each year of early retirement; subsidized 5 months of current salary for the first 20 years of work with compulsory social insurance contributions. From the 21st year onwards, for each year of work with compulsory social insurance contributions, they are subsidized 0.5 months of current salary.

In case of 15 years of work or more, paying compulsory social insurance and being eligible for pension according to the provisions of the law on social insurance at the time of leaving work or retiring, the employee will be subsidized 5 months of current salary for the first 15 years of work; from the 16th year onwards, for each year of work with compulsory social insurance payment, the employee will be subsidized 0.5 months of current salary.

In the case of salary classification for positions, if the salary level 1 of the current position has been held for 48 months or more, the position will be ranked up to level 2 of the current position for retirement.

In the case of professional and technical salary classification and leadership position allowance, if the final salary grade in the current grade is not yet assigned and there is still a gap of 1 to 12 months to be eligible for a regular salary increase according to regulations, the salary increase will be granted ahead of schedule.

In some cases, they are also considered for promotion in military rank and salary increase according to the provisions of law.

What is new compared to before is that in the group of subjects not old enough to be re-elected, there are also cases of cadres who are eligible for re-election to the Party Committee but not old enough to be re-elected to leadership positions of the government, Vietnam Fatherland Front, and socio -political organizations at the time of election, and congresses at the same level to elect those positions.

The addition of this regulation aims to resolve difficulties and problems from practice, due to the time of organizing congresses of agencies at different times, leading to cases where people are old enough to be re-elected at the agency or organization where they work but are not old enough to be re-elected at the Party Committee.

For the group that is still old enough to be re-elected, 30 - 60 months before retirement age, but due to the arrangement of Party committee personnel, they themselves wish to retire, according to the policy of the Politburo , the decree stipulates a mechanism to motivate, encourage, and resolve early retirement.

For the group of cadres under the management of the Politburo and Secretariat who are allowed to retire or retire by competent authorities according to the Conclusion Notice No. 20-TB/KL of the Politburo, the Decree adds this group of subjects to create a legal basis for resolving cases under the management of the Politburo and Secretariat who commit violations and are allowed to retire or retire early by competent authorities.

In addition, the decree also adds provisions allowing the application of the regime to cases where no disciplinary action is taken but the person wishes to quit his job or retire early.

Mr. Nguyen Tuan Ninh also informed about the policy of continuing to work until reaching retirement age, because if many cases are not old enough to be re-elected but still choose to stay working, it will be very difficult to arrange and assign work positions. Therefore, it is necessary to encourage the policy of quitting work and retiring immediately.

"The regimes and policies applied to people who are not old enough to be re-elected and retire before the age of retirement are higher than those in the current decree according to the principle of being higher than streamlining the payroll," said Mr. Ninh.

Specifically, compared to the old regulation, the new regulation increases the benefit level from 3 months of average salary to 5 months of current benefit for those who have 20 years or the first 15 years of work with social insurance payment.

During the process of drafting this decree, units within the Ministry of Home Affairs closely coordinated to ensure the policies and regimes issued by the Government in the context of focusing on streamlining the organization and apparatus in the political system.

Therefore, the decree stipulates that beneficiaries of this decree's policies who are also subject to policies and regimes in the implementation of organizational restructuring can choose to enjoy higher policies and regimes.
