Around the end of February 2024, many customers and acquaintances of Ms. Tran Thi Yen - Deputy Director of Ma Chau Silk Company Limited (Duy Xuyen) contacted to report that someone was using the logo of the Ma Chau brand but advertising the product elsewhere.
Specifically, a social media account named TN used the logo image of Ma Chau Silk, then added his personal name and used it to insert into this person's silk advertising images, then posted it in many garment trading communities nationwide.
Knowing the information, Ms. Yen contacted the person using the account named TN to work with information about the brand and brand identity of Ma Chau silk, including the logo image that had been granted a certificate of protection since 2018. And the use of the logo image of the Ma Chau brand without consent and for commercial purposes violated the provisions of the law. Ms. Yen asked this person to withdraw the advertising articles about the product using the Ma Chau Silk logo image and write a correction article to the customer.
"Right from the time we established the company, we were very concerned about the issue of brand protection, because Ma Chau silk has existed for a long time, is relatively famous and is imprinted in the memories of many people. This is the only competitive basis to deal with some competitors in the market if there is any infringement or imitation of the brand to deceive customers, causing discredit to the company as well as the collective of units producing silk in Ma Chau" - Ms. Yen said.
However, not all units are concerned with brand protection issues like Ma Chau Silk Company Limited, there are many cases of counterfeit product packaging and brand names.
A coconut cake manufacturing company in the province has just discovered that 2 product packaging samples used since 2020 have been copied by another unit with 95% of the interface, only changing the name.
Or in the case of Ms. NTBT, who specializes in producing and trading products from Cordyceps, an individual with the same name BT also took over the brand identity and also traded in similar products.
Multiple support mechanisms
According to Mr. Pham Ngoc Sinh - Deputy Director of the Department of Science and Technology and Head of the Provincial Creative Startup Support Executive Board, among many policies to support the development of production and trade of local products, Quang Nam is very interested in creating all conditions for individuals, units and businesses to protect their trademarks in particular and intellectual property in general.
Since 2019, at the 10th Session, the 9th Provincial People's Council issued Resolution 02/2019/NQ-HDND stipulating a number of mechanisms and policies to support the development of science and technology activities in Quang Nam province in the period of 2019 - 2025. In Article 4, the Resolution clearly states the support for establishing and developing industrial property rights for products and services in the province.
Specifically, for trademark registration, the province will support a maximum of VND 5 million/brand and no more than 5 brands/facility; collective trademark registration will be supported with a maximum of VND 10 million/brand; certification trademark registration will be supported with a maximum of VND 20 million/brand; patent registration will be supported with a maximum of VND 20 million/patent; industrial design registration will be supported with a maximum of VND 10 million/design and no more than 5 industrial designs/year/facility...
Currently, many start-up projects or OCOP entities take lightly the registration of trademark protection or intellectual property rights because they think their business model is still small. This is a very serious problem, because the brand is the easiest asset to "steal" and it will develop and grow with the business model without you knowing until it is actually violated.

Or more specifically, in 2021, at the 4th Session, the 10th Provincial People's Council issued Resolution 42/2021/NQ-HDND stipulating the level of support for registration of protection for inventions, industrial designs and trademarks; registration of protection and recognition of new plant varieties until 2030.
Specifically, for industrial design protection registration, protection of 1 plan/product set will be supported with 8 million VND/protection certificate; for industrial designs protected with 2 plans/product sets or more, support will be 10 million VND/protection certificate; for trademark protection registration will be supported with 4 million VND or more...

According to Mr. Sinh, based on the province's support mechanisms, individuals, units and enterprises should contact the Economic Department or the District-level Economic Infrastructure Department, the Industrial Management Department - Department of Science and Technology or the Provincial Startup Support Executive Board to be guided on procedures and methods of implementing issues related to trademark, brand and industrial design protection.
