According to the People's Committee of Cam Lam District, the district's land use plan until 2030 was approved by the People's Committee of Khanh Hoa Province in Decision No. 507/QD-UBND dated February 18, 2022, and the 2023 land use plan of Cam Lam District was approved by the People's Committee of Khanh Hoa Province in Decision No. 943/QD-UBND dated April 26, 2023.
The People's Committee of Cam Lam District announces the temporary suspension of receiving and processing applications for land use purpose conversion for households and individuals in the area.
However, the People's Committee of Cam Lam District argues that the land use plan is not consistent with the Khanh Hoa Provincial Planning for the period 2021-2030, with a vision to 2050, which was approved by the Prime Minister in Decision No. 318/QD-UBND dated March 29, 2023. The reason is that at the time of drafting the land use plan, there was no orientation to develop Cam Lam District into a modern, ecological, and world-class airport city in accordance with the spirit of Resolution No. 09-NQ/TW dated January 28, 2022, of the Politburo on building and developing Khanh Hoa province until 2030, with a vision to 2045.
At the same time, based on Clause 4, Article 11 of Government Decree No. 43/2014/ND-CP dated May 15, 2014 (amended and supplemented by Clause 9, Article 1 of Government Decree No. 148/2020/ND-CP dated December 18, 2020), it is stipulated that: "After the provincial planning is approved, if the district-level land use planning conflicts with the provincial planning, it must be adjusted accordingly."
Based on Clause 3, Article 4 of the Planning Law dated November 24, 2017, which stipulates the basic principles in planning activities, specifically: "Ensuring compliance, continuity, inheritance, stability, and hierarchy within the national planning system."
Based on the above, the People's Committee of Cam Lam District announces the temporary suspension of receiving and processing applications for land use conversion for households and individuals in Cam Lam District according to the 2023 Land Use Plan until consistency with approved planning maps is ensured or until a directive is issued by the competent authority.
The People's Committee of Cam Lam District stated that once the conditions for land use conversion are met according to regulations, the People's Committee of Cam Lam District will notify the public.
Cam Lam was once a "hot spot" for the illegal practice of donating land for roads and then subdividing and selling it, leading to disciplinary action and dismissal of many local leaders.
Specifically, between January 1, 2018, and June 30, 2021, several organizations and individuals in Cam Lam District violated land law regulations by allowing 114 cases of land donation or voluntary return of land to the state for road construction and land subdivision, resulting in a total of 2,835 plots with a total area of over 57 hectares.
In September 2022, the People's Committee of Nha Trang City also issued a document temporarily suspending land subdivision to prevent illegal land donation for road construction and unauthorized land partitioning.
However, this document received many reactions from the public, and subsequently, the Chairman of the People's Committee of Nha Trang City, Nguyen Sy Khanh, issued a notice requesting the Nha Trang Branch of the Land Registration Office to consider resolving land subdivision issues within its authority, in accordance with the law, and ensuring the legitimate rights and interests of the people, preventing any cases of illegal land subdivision and sale.
