Prohibit "price inflation" that disrupts the real estate market

To limit the situation of organizations and individuals taking advantage of legal loopholes to commit violations in the real estate sector, the Department of Construction issued Document No. 1707/SXD-QLN&PTDT dated September 26, 2024 to strengthen the management and control of real estate price fluctuations in the province. There are many notable contents.

Prohibit

Thanh Ba district organized an auction of the right to use 14 land lots in zone 3, Luong Lo commune.

Specifically, the Department of Construction requested the People's Committees of districts, cities and towns to inspect and control the activities of buying and selling real estate properties that have been transferred many times, especially land plots in technical infrastructure areas divided into lots or areas where people request to separate land plots to transfer to organizations and individuals with abnormal price increases, causing disturbances and "virtual fever" in the market. At the same time, inspect and check to take measures to correct acts of price inflation, price manipulation and real estate speculation.

Localities conduct surveys, grasp and clarify the causes of price fluctuations of each type of real estate such as individual houses and residential land to propose solutions to ensure market regulation, stable, healthy and sustainable development. Land use rights auctions must be in accordance with the law, public and transparent to prevent acts of taking advantage of land use rights auctions for profit and disrupting the market.

Organize the announcement and disclosure of information on the real estate market, disclose information to agencies, organizations and people to clearly understand the housing development program and plan; land use planning and plan; infrastructure development investment and merger, establishment and upgrading of local administrative units; approved real estate projects; project investors eligible to mobilize capital according to regulations; conditions of housing and future construction works put into business to ensure transparency of market information, prevent fraud, deception and scams in real estate business.

Project investors in the province must fully perform their obligations and be responsible before the law when establishing, appraising, approving and implementing the project. Investors must ensure financial resources to implement the project according to the approved schedule. They are not allowed to authorize other organizations or individuals to sign contracts for deposits, purchase, sale, transfer or lease of houses, construction works, etc.

The investor of the project shall construct houses, works, technical infrastructure, and social infrastructure in the project in accordance with the detailed planning, approved design, construction permit, and the content of the project investment policy approval by the competent state agency.

In recent times, the real estate market has not really developed sustainably, with many potential risks. Some investors and real estate brokers have spread rumors, bought and sold, causing information confusion to push up real estate prices for profit, some projects are behind schedule because investors do not fulfill their commitments... The Law on Real Estate Business (amended) takes effect from January 1, 2025. The moves to strengthen inspection and control of real estate price fluctuations will make the real estate market develop healthily, contributing to the socio-economic growth of localities.
