1. Principles of applying electricity prices
According to Article 3 of Circular 16/2014/TT-BCT (amended and supplemented in Circular 25/2018/TT-BCT), the regulations on applying electricity prices are as follows:
- Electricity prices must be applied according to the correct subjects and purposes of electricity use as prescribed in Circular 16/2014/TT-BCT.
The electricity buyer is responsible for declaring the correct purpose of electricity use to calculate the electricity price according to the provisions of Circular 16/2014/TT-BCT.
In case of change in the purpose of electricity use that changes the applicable price, the electricity buyer must notify the electricity seller 15 days in advance to adjust the price in the contract according to the purpose of use. The electricity seller must check and promptly apply the electricity price according to the prescribed subjects.
In case of applying the wrong price for the purpose of electricity use causing damage to the buyer or seller of electricity, it is necessary to collect or refund the electricity bill. In case the time of incorrect price application is not clearly determined, it is calculated with the time of 12 months from the time of discovery and before.
- In case the electricity buyer uses electricity for many different purposes:
+ For customers who sign a contract to use electricity for domestic purposes after a meter but use a part for other purposes (production, business, services), the retail price of domestic electricity will be applied to the entire electricity output measured at that meter;
+ For customers who sign a contract to use electricity for non-domestic purposes after a meter, the two parties buying and selling electricity will agree on the percentage of electricity used for each type of purpose based on the actual electricity usage situation.
+ For urban areas and high-rise apartments, the investor has handed over the house to the customer but has not completed the procedures for asset settlement to hand over the power grid to the electricity industry for management:
During the time waiting for the handover of the power grid and electricity customers, the two parties buying and selling electricity will, based on the actual electricity usage situation, agree on the ratio of electricity output applying the retail price of household electricity and the electricity output applying the retail price of electricity for purposes other than household purposes (production, business, administrative work) as the basis for applying the electricity selling price.
For electricity used for domestic purposes, the electricity price is applied according to the general standard principle of the electricity buyer, which is equal to the standard of each level multiplied by the number of households using electricity for domestic purposes (based on the actual purpose of electricity use, house purchase contract, apartment handover minutes, household registration book, temporary residence book or temporary residence confirmation document of the local police agency).
- On the day of electricity price change according to the provisions of the Decision on electricity price list issued by the Ministry of Industry and Trade, the electricity seller must finalize the index of all meters operating on the grid, except for retail electricity meters for household use.
The finalization of indexes of three-price meters, specialized station meters, and wholesale electricity meters must be confirmed by the customer representative or witness or by a method agreed upon by both parties.
2. How to calculate retail electricity price for students and workers renting houses
Retail electricity prices for students and workers renting houses are regulated in Point c, Clause 4, Article 10 of Circular 16/2014/TT-BCT (amended and supplemented in Circular 09/2023/TT-BCT) as follows:
In case of renting a house to students and workers (the tenant is not a household):
- In case the tenant has a rental contract of 12 months or more and has temporary or permanent residence registration (determined according to the information on residence at the location of electricity use), the landlord directly signs the electricity purchase contract or the tenant's representative signs the electricity purchase contract (with the landlord's commitment to pay the electricity bill);
- In case the rental period is less than 12 months and the landlord cannot fully declare the number of electricity users, the retail price of household electricity of level 3 will be applied:
From 101 - 200 kWh for the total electricity output measured at the meter.
In case the homeowner fully declares the number of people using electricity, the Electricity Seller is responsible for providing the quota to the homeowner based on the information about residence at the place of electricity use; every 04 (four) people are considered as one household using electricity to calculate the quota applied to the retail price of household electricity, specifically:
+ 01 (one) person is counted as 1/4 of the norm.
+ 02 (two) people are counted as 1/2 of the norm.
+ 03 (three) people are considered 3/4 of the norm.
+ 04 (four) people are counted as 1 norm.
When there is a change in the number of tenants, the landlord is responsible for notifying the electricity seller to adjust the electricity bill calculation rate.
The electricity seller is allowed to request the electricity buyer to provide information about residence at the location of electricity use as a basis for determining the number of people to calculate the electricity bill.
