Information from the Ministry of Agriculture and Environment on April 15 said that this agency has just sent a document to the People's Committees of provinces and cities, guiding localities to arrange land for housing construction for households with difficulties in housing land, in order to achieve the goal of eliminating temporary and dilapidated houses nationwide before October 31, 2025, according to the direction of the Prime Minister.
Previously, in Notice 158/TB-VPCP dated April 5 on the conclusion of the Prime Minister at the 3rd national online meeting of the Steering Committee for the elimination of temporary and dilapidated houses nationwide, the Ministry of Agriculture and Environment was assigned to preside over and coordinate with ministries and branches to guide localities in arranging land for housing construction for households with difficulties in housing land.
Accordingly, the ministry guides localities to base on the residential land fund identified in the land allocation and zoning plan in the provincial planning for the 2021-2030 period, with a vision to 2050, and the district-level land use planning and plans approved by competent authorities, to review and prioritize the allocation of residential land for households with difficulties in residential land in the form of land allocation without auctioning land use rights; exempt and reduce land use fees according to the provisions of Articles 124 and 157 of the 2024 Land Law.
For agricultural land in residential areas, agricultural land in the same plot of land with residential land or non-agricultural land that is not residential land of households and individuals in accordance with district-level land use planning, localities need to have policies to encourage people to carry out procedures to change land use purpose to residential land and be exempted from land use fees when changing land use purpose according to the provisions of law to promptly build houses.
The Ministry of Agriculture and Environment also requested localities to review the land area of agricultural and forestry farm origin, to recognize land use rights for people who are using land (including residential land) with papers from state-owned agricultural and forestry farms before July 1, 2004; or to reclaim land according to the provisions of the Land Law to allocate to people without residential land according to regulations.
In cases where the State reclaims land, localities need to prioritize land funds developed and managed by land fund development organizations to arrange timely resettlement so that people have a place to live. Resettlement areas must meet the provisions on conditions and criteria in the land law; be consistent with the cultural traditions, customs and practices of the residential community where the land is reclaimed, and preserve national identity associated with the customs, practices and beliefs of ethnic groups.
In addition, in the process of arranging land for housing construction for households with difficulties in housing land according to the direction of the Prime Minister , localities need to direct all levels and functional branches to carry out land procedures (such as land division, land registration, new issuance or exchange of land use right certificates) according to a simplified process and without collecting fees./.
Recently, regarding the current situation of removing temporary and dilapidated houses, Minister of Ethnic Minorities and Religions Dao Ngoc Dung said that the most difficult problem in rural areas, especially for ethnic minorities in mountainous areas, is the issue of residential land and production land. Therefore, if the poor and ethnic minorities are required to have a red book to build a house, it will be very difficult because "where do the red books come from, who issues the red books?" Faced with such difficulties, the head of the Ministry of Ethnic Minorities and Religions said that localities need to have mechanisms to clear the way. Regarding this issue, the Central Steering Committee has implemented the elimination of temporary and dilapidated houses nationwide, as well as had a meeting and came up with the motto: "If the land where people have lived for a while and there is no dispute, then the State must take care of it, build houses, and issue red books to the people..." |
